About approval of the Regulations on procedure for realization by the Central bank of the Republic of Uzbekistan to the State scientific and production enterprise "Fonon" of the values turned and transferred to the income of the state from precious metals and gemstones

According to the resolution of the President of the Republic of Uzbekistan of August 10, 2017 No. PP-3199 "About measures for the state support of the jewelry industry", and also for the purpose of further enhancement of procedure for realization and ensuring effective use of the values turned and transferred to the income of the state the Cabinet of Ministers decides:

1. Approve Regulations on procedure for realization by the Central bank of the Republic of Uzbekistan to the State scientific and production enterprise "Fonon" of the values turned and transferred to the income of the state from precious metals and gemstones according to appendix.

2. Permit the Central bank of the Republic of Uzbekistan to direct 2 percent from the cost of implementable values to its separate account, for the purpose of strengthening of material and technical resources, and also covering of the expenses connected with storage, transportation, realization of values and involvement of experts of the Ministry of Culture of the Republic of Uzbekistan.

3. Recognize invalid Items 1 and 2 of the resolution of the Cabinet of Ministers of June 5, 2013 as No. 156 "About measures for ensuring effective use of the values withdrawn and turned into the income of the state" (SZ of the Republic of Uzbekistan, 2013, No. 23, the Art. 304).

4. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan D. A. Kuchkarov.

Regulations on procedure for realization by the Central bank of the Republic of Uzbekistan to the State scientific production enterprise "Fonon" of the values turned and transferred to the income of the state from precious metals and gemstones

Chapter 1. General provisions

1. This Provision according to the resolution of the President of the Republic of Uzbekistan of August 10, 2017 No. PP-3199 "About measures for the state support of the jewelry industry" determines procedure for realization by the Central bank of the Republic of Uzbekistan (further - the Central bank) to the State scientific production enterprise "Fonon" (further - GNPP "Phonon") the values turned into the income of the state in the form of scrap and products from precious metals, semiprecious and gemstones and pearls, ownerless values, treasures, and also the values donated by owners in the income of the state (except for archaeological and museum objects or museum collections, and also products having other cultural value).

2. In this Provision the following basic concepts are applied:

precious metals - gold, silver, platinum and metals of platinum group (palladium, iridium, rhodium, ruthenium, osmium) in any kind and condition, including in raw materials, alloys, jewelry and other products, scrap and production wastes;

gemstones - natural diamonds, diamonds, rubies, emeralds, sapphires and alexandrite;

semiprecious stones - zirconium, cubic zirconia, onyx, corals, aquamarine, jasper, corundum, fell down, amber, garnet, tourmaline, amethyst, chrysoberyl, group berilic, malachite, topaz, nephrite, tanzanit, agate, turquoise, hematite, rock crystal, quartz, lazurite, chrysoprase;

values - precious metals, precious and semiprecious stones, and also natural pearls;

the values withdrawn and turned into the income of the state - withdrawn by authorized bodies (Service of state security, the Ministry of Internal Affairs, the State Customs Committee, the State Tax Committee of the Republic of Uzbekistan, Department on fight against economic crimes under the Prosecutor General's Office of the Republic of Uzbekistan (further - Department under the Prosecutor General's Office)) values in the form of objects and tools of crimes, and also physical evidences and the states turned into the income based on the become effective judgments and resolutions of these bodies;

the values transferred to the income of the state - the ownerless values, treasures, values donated in voluntary procedure by owners in the income of the state, including the values placed under customs regime of refusal for benefit of the state.

Chapter 2. Procedure for realization of values

Realization of GNPP "Phonon" of values (except for archaeological and museum objects or museum collections, and also products having cultural value) is made on contractual basis according to the scheme according to appendix to this Provision, for national currency (bags) on the terms of complete advance payment in the following procedure:

for precious metals - at the price of morning fixing of the London exchange of precious metals and Central Bank rate of the Republic of Uzbekistan of date of the statement of the account of payment (in terms of the net weight of precious metals);

for semiprecious both gemstones and pearls - on basis assessment which is carried out by the estimative organizations in accordance with the established procedure, with covering of the corresponding expenses of GNPP "Phonon".

4. Assessment semiprecious and gemstones and pearls is made by the estimative organization for the prices operating on the date of assessment on the basis of the available data on environment of the internal and external markets of jewelry.

5. The estimative organization upon completion of assessment submits the valuation report which is integral part of the contract between the Central bank and GNPP "Phonon" on realization of values.

6. The money obtained from realization of values in process of their revenues to the separate account of the Central bank during three banking days is distributed in the following procedure:

1) on the values withdrawn and turned into the income of the state till July 15, 2009 - in the amount of 100 - percent into special accounts of the republican budget of the Republic of Uzbekistan which details are provided by the Ministry of Finance of the Republic of Uzbekistan;

2) on the values withdrawn and turned into the income of the state after July 15, 2009:

98 percent - into the special account of Bureau of forced execution under the Prosecutor General's Office of the Republic of Uzbekistan, for further distribution of money according to the procedure, established by the legislation;

2 percent - into the separate account of the Central bank;

3) on the values transferred to the income of the state:

98 percent - in the republican budget of the Republic of Uzbekistan;

2 percent - into the separate account of the Central bank;

4) on the values placed under customs regime of refusal for benefit of the state:

50 percent - in the republican budget of the Republic of Uzbekistan;

50 percent - into the off-budget special accounts (or the personal accounts opened in the relevant divisions of Treasury of the Ministry of Finance of the Republic of Uzbekistan) authorized body on management of state-owned property directed to covering of the expenses of authorized body on management of state-owned property connected with assessment, storage and realization of the values which are drawn up under customs regime of refusal for benefit of the state and implementation of administrative and managerial functions.

7. Central Bank in case of money transfer into the special account of Bureau of forced execution under the Prosecutor General's Office of the Republic of Uzbekistan submits the relevant documents, with indication of the body which performed withdrawal of these values separately according to each writ of execution.

Chapter 3. Final provisions

8. The expert of the Ministry of Culture of the Republic of Uzbekistan bears complete responsibility according to the procedure, established by the legislation, for reliability of the conclusion about archaeological and museum objects or museum collections, and also the products having other cultural value issued to them.

9. The estimative organization bears complete responsibility according to the procedure, established by the legislation, for accuracy of the data, provided in the valuation report.

10. Specialists of the Central bank bear complete responsibility according to the procedure, established by the legislation, for ensuring timely transfer of the obtained money.
