About the Order of interaction of state members of the Eurasian Economic Union in case of prevention, diagnostics, localization and liquidation of the centers especially dangerous, quarantine and zoonotic of diseases of animals and carrying out regionalization and compartmentalization

According to the paragraph the second Item 3 of article 58 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 54 of appendix No. 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, Council of the Eurasian economic commission solved:

1. Approve the enclosed Order of interaction of state members of the Eurasian Economic Union in case of prevention, diagnostics, localization and liquidation of the centers especially dangerous, quarantine and zoonotic of diseases of animals and carrying out regionalization and compartmentalization.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

Paragraphs two and third Item 41 of the Procedure approved by this Decision become effective from the effective date Decisions of Council of the Eurasian economic commission on approval of single criteria for evaluation of management system biological safety of the objects which are subject to veterinary control (supervision) for the purposes of carrying out compartmentalization.

Order of interaction of state members of the Eurasian Economic Union in case of prevention, diagnostics, localization and liquidation of the centers especially dangerous, quarantine and zoonotic of diseases of animals and carrying out regionalization and compartmentalization

I. General provisions

1. This Procedure is developed according to Item 3 of article 58 of the Agreement on the Eurasian Economic Union of May 29, 2014 (further – the Agreement) and determines rules of interaction of state members of the Eurasian Economic Union (further respectively – state members, the Union) in case of prevention, diagnostics, localization and liquidation of the centers especially dangerous, quarantine and zoonotic of diseases of animals (further – diseases), and also rules of carrying out regionalization and compartmentalization.

2. State members perform interaction in case of prevention, diagnostics, localization and liquidation of the centers of diseases for the purpose of the prevention of emergence of the centers of diseases, ensuring protection of customs area of the Union from import and distribution of causative agents of diseases and (or) the goods under control to veterinary control (supervision) dangerous in the veterinary and sanitary relation, and also carry out regionalization and compartmentalization for determination of subpopulations of the animals having certain zoosanitary status for the purpose of prevention of diseases and (or) implementation of trade with the third countries and between state members according to this Procedure.

3. Interaction of state members in case of prevention, diagnostics, localization and liquidation of the centers of diseases is performed concerning diseases according to the list according to appendix No. 1.

4. The Eurasian economic commission (further – the Commission) performs coordination of interaction of the bodies in the field of veterinary science authorized on implementation of actions according to the legislation of state members (further - authorized bodies), concerning prevention, diagnostics, localization and liquidation of the centers of diseases, and also regionalization and compartmentalization.

II. Determinations

5. For the purposes of this Procedure concepts which mean the following are used:

"safe kompartment" – kompartment in which lack of the causative agent of specific disease is proved according to the requirements established by the Code of health of land animals and the Code of health of water animals of World Health Organization of animals for the purpose of recognition of the status of wellbeing of kompartment by this disease;

"the safe region" – the region in the territory of which in case of observance of conditions of recognition of the safe zoosanitary status of subpopulation of the animals established by the Code of health land zhivotnykh the Code of health of water animals of World Health Organization of animals, and in case of their absence – according to the acts entering the right of the Union, the legislation of state member absence of disease is proved;

"buffer (protective) zone" – the zone established for protection of the zoosanitary status of subpopulation of animals in the safe region or the region with the unspecified status by holding veterinary and sanitary actions for the purpose of non-admission of drift of infecting agent;

"susceptible animal species" – the animals belonging to species in which organism the causative agent of infectious disease can breed. Such animals as a result of infection and the subsequent reproduction in organism of the causative agent of infectious disease can show clinical signs of this disease of any severity or can not have clinical signs of disease and be the hidden carriers of infecting agent;

"diagnostics" – the procedure of establishment of the diagnosis of disease of animals based on complex of clinical, laboratory and diagnostic, epizootological, pathoanatomical and other data;

"medical examination of animals" – system of the veterinary diagnostic and treatment-and-prophylactic actions directed to timely identification of early preclinical and clinical signs of diseases, prevention of diseases and treatment of sick animals;

"zone" – the part of the territory of state member limited to administrative or natural borders on which the antiepizootic events organized in connection with the outbreak of disease around its center or for protection of this territory against emergence of infectious diseases are held;

"the zoosanitary status" – the condition of subpopulation of animals, the territories and (or) objects which are subject to veterinary control (supervision) by any disease determined according to the criteria established by Kodeksomzdorovya land zhivotnykh the Code of health of water animals of World Health Organization of animals;

"quarantine" – the legal regime providing system of the veterinary and sanitary, organizational and economic actions and administrative measures directed to restriction or the termination of economic bonds and suspension of transportation (movement) of goods under control to veterinary control (supervision) between the epizootic center, the territory in which the epizootic center, and the territory of safe epizootic condition for the purpose of liquidation of the epizootic center and non-admission of spread of disease is established;

"quarantine zone" – the limited territory in which one or several objects infected or suspected of infection by diseases which are subject to veterinary control (supervision) which geographical boundaries are determined taking into account epizootic factors and results of researches are located and within which preventive measures for non-admission of spread of disease are taken;

"kompartment" – the subpopulation of animal one or several livestock farms with single system of management of biological safety having certain zoosanitary status by one or several diseases concerning which take measures of veterinary control (supervision), prevention and biological safety for the purpose of trade. According to the legislation of state members objects in which territories are performed slaughter of the animals containing in the specified livestock farms, conversion and storage of products of animal origin received from such animals, except for objects on which products of animal origin which passed the technological stages guaranteeing its disinfecting are stored or processed only can belong to kompartment;

"compartmentalization" – the procedures performed by authorized body for establishment of kompartment;

"liquidation of disease" – eradication of focus of the disease by destruction of its activator through impact on different links of epizootic chain;

"localization of disease" – restriction of further spread of disease by application of complex of veterinary and sanitary, organizational and economic actions and administrative measures;

"restrictions" – the legal regime providing the sistemuveterinarno-sanitary, organizational and economic actions and administrative measures directed to partial restriction of economic deyatelnostiya suspension of transportation (movement) under control to veterinary control (supervision) of tovarovn of the territory in which the epizootic center, for the purpose of non-admission of spread of diseases and achievement of safe epizootic condition is established;

"the plan of ensuring biological safety" – complex of the actions directed to establishment of potential ways of drift and spread of disease in the region, zone or kompartment and providing veterinary and sanitary measures which were accepted or planned for the purpose of decrease in the risks connected with disease according to recommendations of the Code of health land zhivotnykh of the Code of health of water animals of World Health Organization of animals;

"prevention of disease" – complex of the special veterinary and sanitary, organizational and economic events and administrative measures directed to the prevention of origin and drift of infectious diseases and distribution of their activators, including causative agents of diseases, general for the person and animals;

"region" – the part of the territory of state member limited to administrative borders on which subpopulation of animals has certain zoosanitary status on infectious disease concerning which veterinary and sanitary control measures (supervision), prevention, eradication and ensuring biological safety of the objects which are subject to veterinary control (supervision) are taken;

"regionalization" – process of determination of the status of the state or its administrative and territorial unit (the republic, area, edge, the earth, the county, the state, the province, the area etc.) on infectious disease;

"subpopulation of animals" – the part of population of animals of certain type living and (or) containing in certain territory of state member determined based on regionalization and (or) compartmentalization taking into account its zoosanitary status;

"cross-border diseases" – the diseases which are characterized by bystry distribution out of limits of frontier of state member in the territory of which there is epizootic center;

"emerdzhentny diseases" – again arisen diseases caused by the unknown earlier infecting agent or new kind (strain, type etc.) of the activator known earlier from whom the new version differs in pathogenicity or immunobiological properties;

"the epizootic center" – the limited territory or the room in which are infecting agent source, factors of transfer and susceptible animal species;

"epizootic zoning" – the procedures performed by the representative органомв the determination purposes in the territory of state member of subpopulation of the animals having the certain zoosanitary status determined mainly based on geographical criterion;

"epizootological monitoring" – data collection system about distribution of causative agents of diseases and their statistical processing for the purpose of efficiency analysis of veterinary and sanitary actions, and also assessment and forecasting of epizootic condition of certain territories;

"epizootological investigation" – complex of the actions directed to identification of source of infection, factors and ways of transfer of causative agents of diseases, and also conditions (reasons) promoting origin, drift and spread of diseases for the purpose of preparation of offers of authorized bodies on prevention, localization and liquidation of diseases.

6. Other concepts used in this Procedure are applied in the values defined by the Agreement, other international treaties, including prisoners within the Customs union and the Common economic space and the acts entering the right of the Union, Kodeksomzdorovya of land animals and the Code of health of water animals of World Health Organization of animals (further respectively - codes of VOZZh, VOZZh) and the legislation of state members.

III. Interaction of state members in case of prevention of disease

7. Prevention of disease on customs area of the Union includes realization of veterinary and sanitary actions taking into account recommendations of codes of VOZZh, requirements of the acts entering the right of the Union, and the legislation of state members including:

a) medical examination of animals;

b) use of preventive, medical and other medicines for the prevention of infection of animals;

c) evaluating quality and efficiency of preventive actions;

d) holding other actions for prevention of disease.

8. Planning, the organization and holding actions for prevention of disease, and also their financing are performed according to the legislation of state members.

9. Interaction of state members in case of prevention of disease can be performed in the following forms:

a) development and implementation of joint programs and actions plans for prevention of disease;

b) development and use of the general principles and rules of prevention of disease;

c) mutual informing on development and program implementation (plans) of state members for control (supervision) of diseases;

d) realization of the approved approaches of state members to carrying out identification, registration and traceability of animals and products of animal origin dangerous in the veterinary and sanitary relation;

e) mutual informing on emergence of focus of the disease and identification of the goods under control to veterinary control (supervision) connected with risks of distribution of causative agents of diseases including in the border territories of state members;

e) mutual informing on results of epizootological monitoring of diseases;

g) approval of programs of state members for vaccinal prevention cross-border diseases;

h) the organization and carrying out joint research operations in the field of prevention of disease;

i) holding scientific and practical conferences, meetings, consultations, seminars and other actions for questions of prevention of disease.

10. Authorized bodies take the measures directed to non-admission of origin, import and distribution on customs area of the Union of causative agents of infectious diseases and the goods under control to veterinary control (supervision) dangerous in the veterinary and sanitary relation.

11. Authorized bodies without delay, but no later than 48 hours, inform each other on identification of batch of animals and (or) products of animal origin posing threat of drift and spread of infectious diseases.

IV. Interaction of state members in case of diagnostics

12. Diagnostics is performed according to the laboratory and diagnostic techniques approved according to the procedure, established by the legislation of state member, and applied taking into account recommended and alternative diagnostic tests (methods) provided by the Management of World Health Organization of animals on diagnostic tests and vaccines.
