About approval of the Regulations on procedure for provision of data in electronic form in the Unified licensed register

According to the Law of Ukraine "About licensing of certain types of economic activity" and in pursuance of the resolution of the Cabinet of Ministers of Ukraine of November 8, 2000 N 1658 "About approval of the Procedure for forming, maintaining and use of data of the licensed register and their provision in the Unified licensed register" I ORDER:

1. Approve Regulations on procedure for provision of data in electronic form in the Unified licensed register (further - the Provision) which are applied.

2. (Yeliseyev O. V.) in five-day time to give to management of registration and licensed registers of Head Department of registration and licensing the Provision on state registration to the Ministry of Justice of Ukraine.

3. To administration (Mintsevich E. M.) in ten-day time to send the Provision to bodies of licensing, to representations Gospredprinimatelstva of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol.

4. Declare invalid the order of Licensed chamber of Ukraine of 28.04.98 N49 "About Approval of the Regulations on Procedure for Provision of Data in Electronic Form for Maintaining the Unified Licensed Register" registered by the Ministry of Justice of Ukraine 08.05.98 for N 293/2733.

5. To impose control over the implementation of this order on the vice-chairman Tretyakov S. I.

Regulations on procedure for provision of data in electronic form in the Unified licensed register

1. General provisions

1.1. This Provision is developed according to article 19 of the Law of Ukraine "About licensing of certain types of economic activity", in pursuance of the resolution of the Cabinet of Ministers of Ukraine of November 8, 2000 N1658 "About Approval of the Procedure for Forming, Maintaining and Use of Data of the Licensed Register and Their Provision in the Unified Licensed Register".

1.2. The provision establishes single procedure for preparation, registration and provision of data in electronic form from the licensed register in the Unified licensed register.

1.3. Accounting of receipt of data and replenishment of the Unified licensed register by them is performed by Head department of registration and licensing Gospredprinimatelstva of Ukraine (further - Head department).

2. Licensed register

2.1. The body of licensing creates the licensed register by certain type of economic activity. Text information in the licensed register is kept in state language.

2.2. Normative and help base of the licensed register is:

the classification of forms of business of housekeeping approved by the order of Gosstandart of Ukraine of 22.11.94 of N288;

the classification of types of economic activity approved by the order of Gosstandart of Ukraine of 22.10.96 of N441;

the classification of objects of administrative-territorial way of Ukraine approved by the order of Gosstandart of Ukraine of 31.10.97 N 659;

system of designations of state bodies.

2.3. The body of licensing keeps licensed the register with use of the codifier of works which are coordinated with Head department.

2.4. The codifier structurally consists of two parts: code and the name of work (transaction, service) which is carried out within certain type of economic activity.

The code has hierarchical classification system and system of the coding in format:

XX.YY.YY.YY.YY,

where: XX - code of type of economic activity from the reference book of codes of types of economic activity on the Unified licensed register (appendix 1);

YY.YY.YY.YY - work code (transactions, services) which is carried out within type of economic activity according to the given hierarchical structure:

YY - the Section;

YY.YY - group;

YY.YY.YY - class;

YY.YY.YY.YY - subclass.

Value of each level can be from "01" to "99".

Note. Depending on type of economic activity the code of work can consist from 1 to 4 levels of groups.

2.5. The body of licensing monthly (not later than the 15th next month) gives to Head department for entering in the Unified licensed register of the information about subjects of housekeeping and their branches or other separate divisions which during the accounting period grants licenses and their copies licenses are renewed, duplicates of licenses are issued; about the licenses cancelled or recognized invalid; about the issued orders concerning elimination of violations of licensed conditions.

3. Forming of data in the Unified licensed register

3.1. Data on the granted licenses or on modification of the Unified licensed register are created separately by each type of economic activity for each month under report in four files prepared with use of the coding RUS cp866 and in the DBASE-IV format according to appendix 2.

3.2. The structure of the file with data on the issued, renewed licenses, on the issued duplicates of licenses for implementation of certain type of economic activity, about cancelled or recognized invalid licenses is given in the tab. of 1 appendix 2.

3.3. The structure of the file with data about separate works (transactions, services) which are carried out within certain type of economic activity is given in the tab. 2 appendices 2.

3.4. The structure of the file with data on branches or other separate divisions of the licensee which perform economic activity based on the issued copy of the license on liquidation of branch or other separate division, about the termination of implementation by branch or other separate division of certain type of economic activity is given in the tab. 3 appendices 2.

3.5. The structure of the file with data on the orders issued by body licensing on elimination of violations of licensed conditions is given in the tab. 4 appendices 2.

3.6. Names of files shall correspond to format:

NNNZXXYY.dbf,

where: NNN - the three-digit code name of type of economic activity according to appendix 3;

Z - the sign like data, can accept value: The "V" data on the issued, renewed licenses granted duplicates of licenses for implementation of certain type of economic activity on the licenses cancelled or recognized invalid;

"R" - data on separate works (transactions, services) which are carried out within certain type of economic activity;

"F" - data on branches or other separate divisions of the licensee which perform economic activity based on the issued copy of the license, about liquidation of branch or other separate division, about the termination of implementation by branch or other separate division of certain type of economic activity;

"U" - data on the orders issued by body licensing on elimination of violations of licensed conditions;

XX - number of month for which the report (from 01 to 12) is provided;

YY - two last figures of year for which the report is provided.

For example, in the files UGPV0101.dbf, UGPR0101.dbf, UGPF0101.dbf, UGPU0101.dbf Head department of the State fire protection of the Ministry of Internal Affairs of Ukraine reporting data go to the Unified licensed register about licensed activity in January, 2001.

4. Procedure for acceptance of data in the Unified licensed register

4.1. The prepared files with data are sent to Head department by e-mail or go on diskette directly the official of body of licensing.

4.2. Data go together with the cover letter and with the report on licensed activity on form which is given in appendix 4. The example of filling of the report on licensed activity is given in appendix 5.

If data are sent by e-mail, then the corresponding file with the cover letter shall contain logo of the form of body of licensing, date and number of registration of the letter.

4.3. The head department enters data from files in the Unified licensed register by means of the corresponding software which issues the protocol of result of introduction of information.

4.4. In the protocol are specified:

the number of the records provided in files with information on the licenses issued, renewed, cancelled, recognized invalid;

the number of the records entered into the Unified licensed register (without mistakes);

the number of the records duplicating records which already are in the Unified licensed register;

the number of records in which errors are found.

4.5. The head department reports to body of licensing about result of introduction of information from files in the Unified licensed register. In case of identification of mistakes the body of licensing shall transfer repeatedly within seven working days in Head department the corrected files in full.
