1. Bring in the order of the Minister of investments and development of the Republic of Kazakhstan of December 9, 2015 No. 1194 "About approval of Rules of provision of the state support to subjects of the industrial and innovative activities directed to performance improvement of work and development of territorial clusters" (registered and the Register of state registration of regulatory legal acts of the Republic of Kazakhstan at No. 12640, published on January 28, 2016 in information system of law of Ad_let) the following change:

Rules of provision of the state support to subjects of the industrial and innovative activities directed to the performance improvement of work and development of territorial clusters approved by the specified order to state in edition according to appendix to this order.

2. To provide to committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order is entered into actions after ten calendar days after day of its first official publication.

Rules of provision of the state support to subjects of the industrial and innovative activities directed to performance improvement of work and development of territorial clusters

Chapter 1. General provisions

1. These rules of provision of the state support to subjects of the industrial and innovative activities directed to performance improvement of work and development of territorial clusters (further - Rules) are developed according to the subitem 24) of Item 2 of article 100 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 and determine procedure for provision of the state support to subjects of the industrial and innovative activities directed to performance improvement of work and development of territorial clusters.

2. Performance improvement of work for subjects of industrial and innovative activities is competitive advantage and is based on the factors connected with the personnel potential, production material and technical resources, organizational and economic actions, optimum combination of production and its realization.

3. In these rules the following basic concepts and reducings are used:

1) Six sigma (Six Sigma) - element of economical production, the management concept production providing need of improvement of quality of exits of each of processes, minimization of defects and statistical variations in operating activiies (further - Six Sigma);

2) comprehensive plan of the industrial and innovative project - packet of necessary economic, technical, managerial and other documentation;

3) authorized body in the field of the state support of industrial and innovative activities (further - authorized body) - the central executive body performing management in the field of the industry and industrial and innovative development and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination and participation in realization of the state support of industrial and innovative activities;

4) subjects of industrial and innovative activities - the physical and (or) legal entities realizing industrial and innovative projects in priority sectors of economy or performing activities for promotion of the domestic processed goods, works and services on internal and (or) the foreign markets;

5) Kaizen - element of economical production, the Japanese philosophy or practice which is focused on continual process improvement of production, development, auxiliary business processes and managements, and also all aspects of life (further - Kaizen);

6) Kanban - element of economical production, the system of production organization and supply allowing to realize the principle "just in time" (further - Kanban);

7) the draft of the Map - the industrial and innovative project realized by the subject of industrial and innovative activities in priority sectors, and included in the Card of industrialization or in the Card of support of entrepreneurship of the region;

8) operator of non-financial support - The national chamber of entrepreneurs performing the state non-financial support to entrepreneurs within the fourth direction of the Single program of the support and business development "The road map of business of 2020" approved by the order of the Government of the Republic of Kazakhstan of March 31, 2015 No. 168, except for of the components "Joint Financing of Consulting Projects of the Advanced Companies by Involvement of External Consultants (the Program of the European Bank for Reconstruction and Development for Support of Small and Medium Entrepreneurship of the Republic of Kazakhstan)", "Training of Top Management of Small and Medium Entrepreneurship";

9) General care of the equipment (Total productive maintenance (TPM) - element of economical production, the concept of management of production equipment aimed at increase in efficiency of maintenance (further - TPM);

10) the operator of the tool - the legal entity with 100 percent participation of the state in its authorized capital providing tools, and (or) the affiliated organizations of national institute of development, national managing holding;

11) the contractor - the physical person or legal entity rendering services to the applicant within these rules;

12) products - the goods made by the applicant and/or the works and/or services which are carried out and rendered by the applicant;

13) the applicant - the subject of industrial and innovative activities who submitted the application for receipt of the tool within these rules;

14) the top manager - the head of the legal entity or the member of its executive body or the head of the structural unit on production and/or promotion made products/services, except for financial (accounts department), administrative, legal division;

15) economical production - the management concept production enterprise based on permanent aspiration to elimination of all types of losses, including elements: Kaizen, TPM, Six Sigma, 5 S, Kanban and other;

16) energy efficient technologies are technologies which are directed to effective (rational) use of energy resources. Use of smaller amount of energy for ensuring the same level of energy providing buildings or engineering procedures on production;

17) 5S - element of economical production, system of the organization and rationalization of workplace (working space) (further - 5S).

4. To applicants costs on the actions financed or financed at the expense of means of republican and/or local budgets within other measures of the state support, stipulated by the legislation the Republic of Kazakhstan are not subject to compensation.

5. The costs shown by the applicant on journey and accommodation, suffered by the company by preparation and/or retraining of personnel, including top managers, within increase in competence of the company, are compensated in the sizes which are not exceeding the limit rates established by the order of the Government of the Republic of Kazakhstan of February 6, 2008 No. 108 "About compensation by the government employee of expenses on official foreign journeys at the expense of means republican and local budgets".

6. At the time of the conclusion of the contract between the applicant and the contractor the contractor conforming to requirements of Items 11, of 12, of 13, of 26, of 27, of 35 and 43 these rules is attracted.

Chapter 2. Procedure for provision of the state support to subjects of the industrial and innovative activities directed to work performance improvement

7. The state support to subjects of the industrial and innovative activities directed to work performance improvement within these rules consists in provision of the following tools:
