1. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of May 5, 2015 No. 320 "About approval of Rules of appointment and payment of the government address public assistance" (No. registered in the Register of state registration of regulatory legal acts 11426, published on July 09, 2015 in information system of law of Ad_let) the following change:

2. To provide to department of the public assistance of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for inclusion in Reference

control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan;

4) bringing this order to managements of coordination of employment and social programs of areas, cities of Astana and Almaty;

5) within ten working days from the date of state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

4. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Zhakupova S. K.

5. This order becomes effective since January 1, 2018 and is subject to official publication.

Rules of appointment and payment of the government address public assistance

Chapter 1. General provisions

1. These rules of appointment and payment of the government address public assistance (further - Rules) are developed according to item 4 of article 7 of the Law of the Republic of Kazakhstan of July 17, 2001 "About the government address public assistance" (further - the Law) and determine procedure for appointment and payment of the government address public assistance.

2. In these rules the following basic concepts are used:

1) the assistant - the employee of Jobcenter of the population performing functions on rendering assistance to the consultant for social work and the akim, the settlement, the village, the rural district in carrying out consultation, interview, and also monitoring of accomplishment of obligations under the social contract;

2) authorized organization for payment of the address public assistance - the organizations having the license of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, or territorial subdivisions of Kazpochta joint-stock company;

3) measures of social adaptation - the complex of actions including the measures of social resettlement of disabled people determined by article 21 of the Law of the Republic of Kazakhstan of April 13, 2005 "About social protection of disabled people in the Republic of Kazakhstan" the special social services rendered to persons which are in difficult life situation according to the Law of the Republic of Kazakhstan of December 29, 2008 "About special social services" and also other measures state the supports given according to the procedure, stipulated by the legislation the Republic of Kazakhstan;

4) the consultant for social work (further - the consultant) - the employee of Jobcenter of the population performing assistance in purpose of the address public assistance and exit of needy person (family) from the situation caused by stay it below the poverty line;

5) the social contract - the agreement determining the rights and obligations of the Parties on participation in active measures of assistance of employment between the citizen of the Republic of Kazakhstan or the oralman from among jobless, independently busy, and also other persons in the cases provided by the Law of the Republic of Kazakhstan "About employment of the population" (further - the Employment act of the population), and jobcenter of the population, and in the cases provided by the Employment act of the population with the physical persons and legal entities involved in the organization of active measures of assistance of employment and also about rendering the government address public assistance;

6) able-bodied person (the able-bodied family member) - person or the family member of sixteen years to retirement age, stipulated in Item 1 article 11 of the Law of the Republic of Kazakhstan of June 21, 2013 "About provision of pensions in the Republic of Kazakhstan", capable to work and performance of work of certain qualification, amount and quality;

7) the average per capita income - the share of comprehensive income of family falling on each family member in month;

8) comprehensive income - the amount of the income types considered in case of purpose of the address public assistance;

9) the standard list of actions for assistance of employment and social adaptation (further - the Standard list) - the list of active measures of assistance of employment and social adaptation approved by the central executive body in the field of social protection of the population, and recommended for use in case of the conclusion of the social contract;

10) active measures of assistance of employment of the population - measure of social protection from unemployment and employment of the population, the state support of citizens of the Republic of Kazakhstan and oralmans from among jobless, independently busy, and also other persons in the cases provided by the Employment act of the population;

11) needy persons (families) are persons (family) having the average per capita income per month below the poverty line, established in areas, the cities of republican value, the capital;

12) the individual plan of the help to family (further - the individual plan) - the actions plan on assistance of employment and (or) social adaptation constituted by Jobcenter of the population together with person who addressed for rendering the address public assistance, and (or) members of his family;

13) the Orleu project - complex of actions for provision of the caused monetary assistance to family (person) on condition of participation of able-bodied family members (person) in the state measures of assistance of employment and passing, in case of need, social adaptation of family members (person), including able-bodied;

14) authorized body - the local executive body of the city of republican value, the capital, area, city of regional value, the area in the city, the cities of district value performing purpose of the government address public assistance;

15) the precinct election commission - the special commission created by the decision of akims of the corresponding administrative and territorial units for carrying out inspection of financial position of persons (families) which asked for the government address public assistance according to the Standard regulations on precinct election commissions approved by the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of January 28, 2009 No. 29-p "About approval of the Standard regulations on precinct election commissions" (No. registered in the Register of state registration of regulatory legal acts 5562);

16) the district (city) commission on questions of employment of the population - the commission on questions of employment of the population formed for the purpose of realization of state policy in the field of employment of the population in the territory of the area, the city, the cities of regional and republican value, the capital, according to the Standard regulations on the district (city) commission on questions of employment of the population approved by the order of the Minister of health and social development of the Republic of Kazakhstan of June 7, 2016 No. 482 "About approval of some standard documents" (registered in the Register of state registration of regulatory legal acts for No. 13867) (further - the order No. 482);

17) regional commission concerning employment of the population - the commission on questions of employment of the population formed for the purpose of realization of state policy in the field of employment of the population in the territory of the area (the capital, the city of republican value), according to the Standard regulations on regional commission concerning employment of the population approved by the order No. 482;

18) jobcenter of the population (further - the Center) - the public institution created by local executive body of the area, the cities of regional and republican value, the capital for the purpose of realization of active measures of assistance of employment and the organization of social protection from unemployment and other measures of assistance of employment according to the Employment act of the population.

Chapter 2. Procedure for purpose of the government address public assistance

3. The government address public assistance (further - the address public assistance) is provided to person or family with the average per capita income which is not exceeding the poverty line established in areas, the city of republican value, the capital according to Item 1-2 of article 2 of the Law in the form of the unconditional or caused monetary assistance.

4. Person or family applying for receipt of the address public assistance for receipt of information on procedure for purpose of the address public assistance addresses to the Center for the residence, and in case of lack of the Center at the place of residence - to the akim of the settlement, village, rural district (further - the akim).

5. In the course of the address of person or family with it consultation during which to it is carried out:

1) information is provided:

about conditions of receipt of the unconditional and caused monetary assistance;

about conditions of participation in active measures of assistance of employment and (or) in programs of social adaptation;

about need of the conclusion of the social contract, obligations of the parties participating in the social contract, and conditions of termination of the social contract;

about conditions of reduction of the sizes and (or) suspensions of the address public assistance;

about the list of documents, and the data necessary for purpose of the address public assistance;

about the list of the data requested from the corresponding information systems of state bodies and the organizations;

2) predesign of the average per capita income of person or family and the extent of the address public assistance is made.

Consultation in the Centers is carried out by consultants, in case of the address of person to the akim - assistants.

6. By results of consultation, person or family (further - the applicant) from themselves personally or on behalf of family files petition on purpose of the address public assistance in form according to appendix 1 to these rules.

The following documents are enclosed to the application:

1) the identity document (the identity certificate (passport) of the citizen of the Republic of Kazakhstan, the residence permit of the foreigner who is constantly living in the Republic of Kazakhstan, the certificate of the stateless person, the certificate of the refugee), and for oralmans - the certificate of the oralman - for identification;

2) data on availability of personal subsidiary farm in form according to appendix 2 to these rules;

3) data on bank account number in authorized organization for payment of the address public assistance;

4) the certificate about the births (death) of the child (on all children) - on the registration made in the territory of the Republic of Kazakhstan till August 13, 2007;

5) the registration certificate of the conclusion (termination) of scrap, in case of discrepancy of data of the applicant with data in the certificate of birth of the child - on the registration made in the territory of the Republic of Kazakhstan till June 1, 2008;

6) the reference of educational institution in form according to appendix 4 to Rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits, public social benefits on disability, on the occasion of loss of the supporter and on age, the public special welfare payments from authorized organization, the approved order of the Minister of health and social development of the Republic of Kazakhstan of April 14, 2015 No. 223 "About approval of Rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits, public basic social benefits on disability, on the occasion of loss of the supporter and on age, the public special welfare payments from authorized organization" (registered in the Register of state registration of regulatory legal acts for No. 11110), if dependents aged from eighteen up to twenty three years are studying full-time in the organizations of secondary, technical and professional, postsecondary education, higher educational institutions, is requested from educational institution once a year.
