About approval of Licensed conditions of implementation of economic activity on search (investigation) of minerals

According to article 8 of the Law of Ukraine "About licensing of certain types of economic activity" and the resolution of the Cabinet of Ministers of Ukraine of 14.11.2000 N1698 "About Approval of the List of Bodies of Licensing"

WE ORDER:

1. Approve Licensed conditions of implementation of economic activity on search (investigation) of minerals which are applied.

2. To management of licensing of types of economic activity of Department of registration and licensing Gospredprinimatelstva of Ukraine (Efremov O. V.), to Department of geology and use of subsoil Minekoresursov of Ukraine (Gursky D. S.) in accordance with the established procedure to provide provision of this order on state registration in the Ministry of Justice of Ukraine.

3. (Gursky D. S.) to provide to department of geology and use of subsoil the publication of this order in mass media.

4. Declare invalid the order of Licensed chamber of Ukraine and the State committee of Ukraine on geology and use of subsoil of 08.04.99 N33/58 "About Approval of the Instruction about Conditions and Rules of Implementation of Business Activity (Licensed Conditions) on Search (Investigation) and Operation of Mineral Deposits and Control of Their Observance" registered in Ministry of Justice of Ukraine 24.04.99 for N 258/3551.

5. To impose control of execution of this order on the vice-chairman Gospredprinimatelstva of Ukraine Tretyakov S. I. and deputy minister of ecology and natural resources of Ukraine Lizun S. O.

Licensed conditions of implementation of economic activity on search (investigation) of minerals

1. General provisions

1.1. These Licensed conditions N1698 "About Approval of the List of Bodies of Licensing" are developed according to the Law of Ukraine "About licensing of certain types of economic activity", the Code of Ukraine about subsoil and the resolution of the Cabinet of Ministers of Ukraine of 14.11.2000, determine conditions of implementation of economic activity on search (investigation) of minerals within the territory of Ukraine, its continental shelf, exclusive (sea) economic zone.

1.2. Action of Licensed conditions extends on all business entities irrespective of their forms of business and patterns of ownership performing activities for search (investigation) of minerals.

1.3. Licensed conditions determine qualification and organizational requirements to implementation of economic activity by search (investigation) of minerals (appendix 1) which are carried out by the principles of calculation, geological economic evaluation and stock accounting of minerals, single for the State fund of subsoil of Ukraine, according to the Classification of inventories and resources of minerals of the state fund of subsoil approved by the resolution of the Cabinet of Ministers of Ukraine of 05.05.97 of N432.

1.4. If the subject of housekeeping performs economic activity on search (investigation) of minerals not in full, and partially or on separate special works, then licensed conditions extend to the subject of housekeeping in the part establishing requirements to implementation of the economic activity specified in the license.

1.5. Economic activity on search (investigation) of minerals shall be performed according to requirements of instructions for application of classification of inventories to mineral deposits (appendix 2), the minerals determining procedure for geological studying of separate type.

1.6. Economic activity on search (investigation) of minerals shall be performed with observance of requirements of the Law of Ukraine "About licensing of certain types of economic activity", the Code of Ukraine about subsoil and the current legislation concerning use of natural resources.

2. Requirements to implementation of economic activity on search (investigation) of minerals

2.1. The subject of housekeeping which carries out activities for search (investigation) of minerals shall have:

the specialists having the corresponding geological or mining education and professional training on work which makes sure documents of the state sample. At the same time persons having the finished mining education on the corresponding specialty can perform of exploration works technical guidance;

the equipment, machines and mechanisms manufactured according to standards or specifications according to the scope specified in the maintenance instruction;

technological means which operation meets the requirements of the specifications and technical documentation of manufacturing plant, repair documentation, requirements for labor and environmental protection;

buildings, rooms, production sites equipped taking into account unhealthy work conditions and meeting the requirements of sanitary standards according to Health regulations of planning and building of the settlements approved by the order of the Ministry of Health of Ukraine of 19.06.96 of N173 and registered in the Ministry of Justice of Ukraine 24.07.96 N 379/1404;

the laboratories certified according to the Procedure for accreditation of measuring laboratories approved by the order of Gosstandart of Ukraine of 05.11.98 of N886 and registered in the Ministry of Justice of Ukraine 22.12.98 for N 806/3246.

2.2. Economic activity needs to be performed:

with maintaining geological, geophysical, surveying and executive technical documentation, its storage, and also samples of rocks and ores, duplicates of tests;

with completeness of studying of geological structure of subsoil, mining, hydrogeological and accomplishment of other conditions necessary for operation of the reconnoitered fields;

with reliability of determination of quantity and quality of inventories of all minerals and available components in them according to the Instruction about content, registration and procedure for representation for consideration of the State Commission on Mineral Reserves of materials of geological economic evaluations of fields of metal and nonmetallic minerals approved by the order of State commission of Ukraine on inventories of minerals (further - GKZ) of 04.09.95 N35 and registered by the Ministry of Justice of Ukraine 01.11.95 for N394/930;

with conducting works as the methods and methods excluding unjustified losses of minerals, decrease in their quality, excessive destruction of soil cover and environmental pollution and providing effective recultivation of the territory.

3. Special requirements to implementation of economic activity

3.1. Results of the carried-out works on search (investigation) of minerals and the recommendation about their use are stated in geological reports on investigation of fields and the GKZ protocols on approval of inventories of mineral raw materials.

3.2. Economic activity on search (investigation) of minerals in case of carrying out trial development of fields shall provide completeness of withdrawal and complex rational mining.

3.3. The subject of housekeeping in case of requirement the geological information necessary for implementation of works on search (investigation) of minerals, shall receive on conditions according to the Regulations on procedure for the order geological information approved by the resolution of the Cabinet of Ministers of Ukraine of 13.06.95 of N423.
