1. Approve the enclosed Federal aviation rules "Requirements to Procedure for Development, Approval and Contents of Programs of Training of Specialists according to the List of Specialists of Aviation Personnel of Civil Aviation".

2. Determine that this order becomes effective in 180 days from the date of its official publication.

Federal aviation rules "Requirements to Procedure for Development, Approval and Contents of Programs of Training of Specialists according to the List of Specialists of Aviation Personnel of Civil Aviation"

I. General provisions

1. These rules establish requirements to procedure for development, approval and contents of programs of training of specialists according to the list of specialists of aviation personnel of civil aviation (further - the program of preparation).

2. These rules do not regulate the legal relationship connected with development and approval of educational programs.

II. Requirements to development and contents of programs of preparation

3. The program of preparation is developed by persons specified in Item 3 of article 8 of the Air code of the Russian Federation, the operator of aircraft of general purpose, and also person having the certificate with the record about the right of carrying out training of pilots of light civil aircrafts and pilots of extralight civil aircrafts of aircraft of general purpose made in it according to the procedure of individual preparation (the qualification mark "instructor" in the certificate of the pilot).

4. The program of training of candidates for receipt of certificates, qualification marks shall contain:

1) the title page with the name of the program of preparation, and also the approval signature stamp in the right upper corner containing the signature, position, surname, initials of person approving the program of preparation, and date of its approval;

2) table of contents (the list of Chapters with indication of pages);

3) Chapter "General provisions" containing introduction, the purpose of training of specialists of aviation personnel of civil aviation according to the approved program of preparation, the requirements established by the air legislation of the Russian Federation to person having training, and the list of the regulatory legal acts establishing these requirements, and also the documents confirming preparation passing, issued to person in case of passing of the program of preparation;

4) Chapter "The plan of preparation" containing information on preparation form (internal, intramural and extramural, correspondence with indication of possibility of application of electronic training and remote educational technologies), duration and the mode of occupations (total quantity of class periods, the maximum duration of school day in hours), preparation stages (theoretical, training, flight, practical training (training)), the list of Sections and subject matters with indication of number of hours according to each Section and discipline;

5) Chapter "Thematic plan" containing distribution of the class periods according to Sections, subject matters provided by the plan of preparation (the thematic plan is constituted on each subject matter (subject) in the form of the table in which are introduced the name of subject corresponding to its content, the name of types of classes in each subject (to lecture, independent preparation, practical training, occupations using the remote training technologies, exit occupations), total quantity of the school hours allowed for studying of subject matter (subject), distribution of time by types of occupations;

6) Chapter "Contents of the program of preparation" containing summary of the main questions of discipline, methodical recommendations about training, the list of methodical materials, benefits, technical means of training in the questions which are subject to studying on each subject;

7) Chapter "Procedure for control of knowledge, skills (abilities)" including procedure for control of knowledge, skills (abilities) both in process and following the results of development of the program of preparation or its separate parts (modules), the control forms applied in case of intermediate and/or final assessment of knowledge, skills (abilities);

8) other Chapters, Sections, and also the appendices included according to the solution of developer in the program of preparation.

5. The program of preparation specified in item 4 of these rules shall provide experience, knowledge and skills (abilities) established by federal aviation rules concerning specialists according to the list of specialists of aviation personnel of civil aviation approved by the order of the Ministry of Transport of the Russian Federation of August 4, 2015 No. 240 (registration No. 38810) is registered by the Ministry of Justice of the Russian Federation on September 4, 2015.

6. Training in the program of preparation, except for programs of the preparation specified in item 4 of these rules shall provide implementation of the requirements established by federal aviation rules to preparation, training and control of knowledge and skills of persons from among specialists of aviation personnel of civil aviation, legal entities and individual entrepreneurs specified in Item 3 of article 8 of the Air code of the Russian Federation.

The program of preparation shall contain:

1) the title page with the name of the program of preparation, and also the approval signature stamp in the right upper corner containing the signature, position, surname, initials of person approving the program of preparation, and date of its approval;

2) table of contents (the list of Chapters with indication of pages);

3) determinations and reducings;

4) Chapter "General provisions" containing the purpose of carrying out training of persons from among specialists of aviation personnel of civil aviation according to the approved program of preparation, the requirements established by federal aviation rules to person having training and references to provisions of the specified rules establishing these requirements, documents confirming passing of the program of preparation, preparation form (internal, intramural and extramural, correspondence with indication of possibility of application of electronic training and remote educational technologies), procedure and forms of intermediate and/or final assessment of knowledge, skills (abilities), methodical recommendations about carrying out types of preparation, use of technical means of training;

5) Chapter "Training of the worker for accomplishment of the obligations assigned to it" containing preparation type (land, training, flight, practical), preparation duration in hours and/or in flights on the aircraft or on the training device, frequency of preparation according to requirements of federal aviation rules, preparation stages (theoretical (land), training, flight, practical), thematic content of stages of preparation (summary of the main questions), samples of the documents issued by results of final control of buildings, skills (abilities);

6) Chapter "Scope of periodic land preparation" containing the name of subject corresponding to its content, training form on each subject (independent preparation, using the remote training technologies, practical training, lectures), total quantity of the school hours allowed for practical training, lectures;

7) other Chapters, Sections, and also the appendices included according to the solution of developer in the program of preparation.

III. Approval procedure of programs of preparation

7. The program of preparation affirms Federal Air Transport Agency or territorial authorities of Federal Air Transport Agency (further - authorized body) at the choice of developer of the program of preparation.

8. Person who developed the program of preparation (further - the applicant), directs the statement for approval of the program of preparation in which are specified to authorized body:

the name with indication of form of business, trade name (in the presence), the location, identification taxpayer number, phone number and the e-mail address - for the legal entity, the individual entrepreneur;

surname, name and middle name (in the presence), the residential address, phone number (fax) and the e-mail address (in the presence) - for physical person;

name of the program of preparation;

method of informing applicant on results of consideration of the application.

The application is signed by the applicant or person having the right to act on behalf of the applicant, with appendix to the statement of the documents confirming the right of the representative to act on behalf of the applicant.

The program of preparation in duplicate is enclosed to the application. In case of modification of earlier adopted agenda of preparation for the statement the program of preparation with the made changes and the description of the made changes is attached.

The statement and documents attached to it are submitted by the applicant to authorized body directly or go the registered mail with the assurance of receipt, and also can be submitted by the applicant electronically.

The application is electronically signed by the strengthened qualification digital signature.

9. It is forbidden to require from the applicant of making of any actions, provision of the data and documents which are not provided by these rules and also inclusion in programs of preparation of the requirements which are not provided by federal aviation rules.

10. The authorized body within five working days from registration date of the statement checks its compliance to requirements of Item 8 of these rules and the program of preparation enclosed to the application to requirements of items 4 or 6 these rules regarding its registration.

If as a result of consideration of the application and the program of preparation discrepancies to the requirements containing in Item 8 of these rules are revealed, the authorized body within two working days after the expiration specified in paragraph one of this Item informs the applicant in any manner, specified in the statement, on the revealed discrepancies.

11. If by results of consideration of the application and the program of preparation according to Item 10 of these rules of discrepancy are not revealed, the authorized body within 20 working days from receipt date of the statement considers the program of preparation.

In case of compliance to requirements of these rules the program of preparation affirms authorized body.

12. In case of detection of discrepancies of the program of preparation to requirements of these rules by its consideration according to Item 11 of these rules, the authorized body within three working days after the expiration specified in Item 11 of these rules notifies the applicant on the revealed discrepancies.

13. The applicant in time of no more than 20 working days from the date of receipt of information on the discrepancies revealed by authorized body has the right to eliminate them and to send the modifed program of preparation to authorized body.

14. The authorized body considers the modifed program of preparation no more than 10 working days from the date of its receipt in time and in case of elimination of the discrepancies specified in Item 12 of these rules approves the program of preparation.

15. The authorized body within three working days from the date of approval of the program of preparation informs the applicant in any manner, specified in the statement, and issues to the applicant or his legal representative adopted agenda of preparation.

16. If the applicant did not eliminate in the discrepancy time established in Item 13 of these rules, specified in Item 12 of these rules, the authorized body makes the decision on refusal in approval of the program of preparation and within three working days after the term specified in Item 13 of these rules informs on it the applicant by the method specified in the statement with indication of causes of failure and the revealed discrepancies to these rules.

17. In case of refusal in approval of the program of preparation the repeated appeal to authorized body of the applicant for approval of the program of preparation is performed according to Item 8 of these rules.

18. The applicant has the right to appeal the decision of authorized body on refusal in approval of the program of preparation according to the procedure, established by the legislation of the Russian Federation.

19. In case of introduction of amendments to the air legislation of the Russian Federation, the concerning requirements to specialists according to the list of specialists of aviation personnel of civil aviation whose training is provided by the program of preparation and also in the solution of the faces specified in Item 3 of these rules changes for ensuring compliance to requirements of the air legislation of the Russian Federation are made to it.

In case of modification of earlier adopted agenda of preparation the program of preparation with the made changes is subject to approval according to the procedure, established by these rules.

20. The program of preparation specified in item 4 of these rules and approved according to these rules is published on the website of Federal Air Transport Agency and can be used by persons specified in Item 3 of these rules for the purpose of training of candidates for receipt of certificates of specialists of aviation personnel of civil aviation or receipt of qualification marks by them.
