1. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of December 28, 2015 No. 1057 "About approval of Rules of obligatory periodic certification of production facilities under the terms of work" (it is registered in the Register of state registration of regulatory legal acts at No. 12743, it is published in information system of law of Ad_let on January 26, 2016), the following change:

The rules of obligatory periodic certification of production facilities under the terms of work approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to department of work and social partnership of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in one copy of its copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication of inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Nurymbetov B. B.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of obligatory periodic certification of production facilities under the terms of work

Chapter 1. General provisions

1. These rules of obligatory periodic certification of production facilities under the terms of work (further - Rules) are developed according to the subitem 29) of Article 16 and Item 3 of Article 183 of the Labor code of the Republic of Kazakhstan of November 23, 2015 (further - the Labor code) and determine procedure for carrying out obligatory periodic certification of production facilities under the terms of work.

2. In these rules the following concepts are used:

1) safe working conditions - working conditions under which levels of impact of production factors on working do not exceed the established standard rates;

2) labor safety - the condition of security of workers provided with complex of the actions excluding impact of harmful and (or) dangerous production factors on workers in the course of labor activity;

3) occupational health - complex of sanitary and epidemiologic measures and means on preserving health of workers, prevention of adverse effects of the production circle and labor process;

4) standard rates in the field of safety and labor protection - the ergonomic, sanitary and epidemiologic, psychophysiological and other requirements providing normal and safe working conditions;

5) labor protection - the system of safety of life and health of workers in the course of labor activity including legal, social and economic, organizational and technical, sanitary and epidemiologic, treatment-and-prophylactic, rehabilitation and other actions and means;

6) employee representatives - bodies of labor unions, their associations, and in case of their absence elective representatives, the elite and representatives on general meeting (conference) of workers by a majority vote participants, in case of presence on it at least two thirds of workers (delegates of conference);

7) workplace - the place of permanent or temporary finding of the worker in case of accomplishment of labor obligations by it in the course of labor activity;

8) individual protection equipment (further - SIZ) - the means intended for protection of the worker against impact of harmful and (or) dangerous production factors including special clothes;

9) harmful working conditions - working conditions which are characterized by availability of harmful production factors;

10) safety regulations - the qualitative and quantitative indices characterizing conditions of production, production and labor process from the point of view of ensuring the organizational, technical, sanitary and hygienic, biological and other regulations, rules, procedures and criteria directed to preserving life and health of workers in the course of their labor activity;

11) production facilities - workshops, sites and other separately located production divisions of the organizations which are engaged in release and production of products, development, production and conversion of minerals, construction and other types of productive activity;

12) the specialized organizations for carrying out certification of production facilities - the organizations which are performing activities for carrying out certification of production facilities under the terms of work, having qualified personnel and incorporating the test laboratories accredited according to the legislation of the Republic of Kazakhstan;

13) certification of production facilities under the terms of work (further - certification) - activities for assessment of production facilities (workshops, sites, workplaces, and also other, separate divisions of the organizations performing productive activity) for the purpose of determination of security status, harm, weight, intensity of the works performed on them, occupational health and determination of compliance of conditions of the production circle to standard rates in the field of safety and labor protection;

14) means of collective protection - the technical means intended for simultaneous protection of two and more working from impact harmful and (or) dangerous production factors.

Chapter 2. Procedure for carrying out certification

3. Certification is carried out by the specialized organizations for carrying out certification of production facilities accredited according to the legislation of the Republic of Kazakhstan, periodically, at least once in 5 years.

4. Certifications are subject all production facilities of the organizations operating in the territory of the Republic of Kazakhstan.

Certification reconstructed (replacement, implementation, installation of new processing equipment, processes) production facilities is carried out not later than in 90 calendar days after their input to operation.

5. Authorized state body on work information on the specialized organizations for carrying out certification of production facilities (the name, legal address, contact telephone number, types of activity, the information about qualified personnel) is placed on Internet resource.
