According to the Presidential decree of Ukraine of April 21, 1998 of N335 "Questions of the National Commission of Regulation of Power Industry of Ukraine" (with changes and amendments), the resolution of the Cabinet of Ministers of Ukraine of April 29, 1999 N 753 "About procedure for issue of licenses by the National commission of regulation of power industry for implementation of separate types of business activity", for the purpose of restriction of risks of implementation of transactions in the markets of electrical energy and natural gas the National commission of regulation of power industry of Ukraine DECIDES:
1. Approve Standard rates of sufficiency of own assets of subjects of business activity (further - Standard rates) which obtain in NKRE licenses for supply of electrical energy and/or natural gas on unregulated rate (are applied).
2. Determine that the indicators of standard rates of sufficiency of own assets calculated for each subject of business activity shall answer these Standard rates. If the company does not follow requirements at least of one of the standard rates approved by this resolution, then it shall provide to the Commission additional guarantees in the form of the bank guarantee or the copy of the contract for opening of credit line that confirms compliance to the approved standard rates.
