About approval of Licensed conditions of implementation of economic activity on cultivation and use of the plants containing drugs for the industrial purposes

According to article 7 of the Law of Ukraine "About introduction of amendments to the Law of Ukraine "About the address in Ukraine of drugs, psychotropic substances, their analogs and precursors"" of 08.07.1999 N863 and article 8 of the Law of Ukraine "About licensing of certain types of economic activity" of 01.06.2000 N1775 and in pursuance of the resolution of the Cabinet of Ministers of Ukraine of 14.11.2000 N1698 "About Approval of the List of Bodies of Licensing"

WE ORDER:

1. Approve Licensed conditions of implementation of economic activity on cultivation and use of the plants containing drugs for the industrial purposes (further - Licensed conditions) which are applied.

2. To management of licensing of Head department of registration and licensing Gospredprinimatelstva of Ukraine (Ivanchenko O. B.), to Department of the markets of products of crop production and development of seed farming of Minagropolitiki of Ukraine (Forty V. I.) in accordance with the established procedure to provide provision of this order on state registration in the Ministry of Justice of Ukraine.

3. To impose control of execution of the order on the vice-chairman Gospredprinimatelstva of Ukraine Tretyakov S. I. and deputy minister of agrarian policy of Ukraine Ryzhuk S. M.

Licensed CONDITIONS of implementation of economic activity on cultivation and use of the plants containing drugs for the industrial purposes

1. General provisions

1.1. These Licensed conditions N863 and "About licensing of certain types of economic activity" of 01.06.2000 N 1775, of resolutions of the Cabinet of Ministers of Ukraine of 06.05.2000 of N770 "About Approval of the List of Drugs, Psychotropic Substances and Precursors" and of 14.11.2000 N1698 "About Approval of the List of Bodies of Licensing", the subitem 15 of item 4 of the "Provision on the Ministry of agrarian policy" approved by the Presidential decree of 07.06.2000 of N772 are developed according to requirements of the Laws of Ukraine "About introduction of amendments to the Law of Ukraine "About the address in Ukraine of drugs, psychotropic substances, their analogs and precursors" of 08.07.99.

1.2. Licensed conditions establish the exhaustive list of the organizational, production, qualification and special requirements obligatory for accomplishment in case of cultivation and use of the plants containing drugs for the industrial purposes.

1.3. According to the list N 3 of table 1 of the List of drugs, psychotropic substances and precursors approved by the resolution of the Cabinet of Ministers of Ukraine of 06.05.2000 N 770 "About approval of the list of drugs, psychotropic substances and precursors" type plants "somnolent poppy" and plants of the sort "hemp" belong to the plants containing drugs and psychotropic substances which address is allowed for the industrial purposes.

1.4. Cultivation of plants of type "somnolent poppy" for production of seeds and plants of the sort "hemp" for production of seeds and fiber for the industrial purposes is allowed only on condition of use of the seeds collected from plant varieties in which dried-up straw respectively content of morphine and tetrahydrocannabinol does not exceed % 0,15.

1.5. Licensing of economic activity on cultivation and use of the plants containing drugs for the industrial purposes is performed by the Ministry of agrarian policy of Ukraine in coordination with the Ministry of Internal Affairs of Ukraine.

1.6. For receipt of the license for implementation of economic activity on cultivation and use of the plants containing drugs with the industrial purpose the company files in the Ministry of agrarian policy petition for licensing of the established sample (appendix 1).

1.7. Action of Licensed conditions extends to all companies registered in the procedure established by the legislation as the legal entities irrespective of pattern of ownership performing economic activity on cultivation and use of the plants containing drugs for the industrial purposes.

2. Organizational requirements for implementation of economic activity for cultivation and use of the plants containing drugs for the industrial purposes

2.1. It is forbidden to the companies to sow poppy seeds below the first reproduction and hemp below the second reproduction, the domestic and import seeds which are not entered in the Register of plant varieties of Ukraine.

2.2. For protection of crops of poppy, storage locations and conversion of plants the company signs the contract with division of the Ministry of Internal Affairs of Ukraine, and hemp - with division of the Ministry of Internal Affairs or the organization having the license for provision of services, connected with protection of the state-owned and other property.

3. Production requirements for implementation of economic activity on cultivation and use of the plants containing drugs for the industrial purposes

3.1. The company shall provide:

- seeding of the plants containing drugs on fields and located at distance is at least 1 km from roads of the state value and railway tracks of the message;

- obligatory carrying out high-quality weedings and approbation of seed-growing crops;

- use for commodity crops of seeds of poppy is not lower than the first, and hemp - not below the second reproduction;

- write-off of the sowed seeds execution of the act according to the scientifically based regulations of seeding established by grade originator, to amounts of acreage;

- annual provision to regional law-enforcement bodies of the documents confirming the place of seeding of the plants containing drugs, acreage and agreements on protection of crops, storage locations and conversion of plants, and the Ministry of agrarian policy of Ukraine - high-quality structure, origin of the sowed seeds, the conclusion of regional law-enforcement bodies about approval of the right of cultivation of the plants containing drugs for the industrial purposes and data on the collected area and gross collection;

- during harvesting of the plants containing drugs, method of combining of crushing and razbroska across the field of the threshed weight and its pripakhivaniye;

- when harvesting the plants containing drugs, manually obligatory weighing of the boxes of poppy arriving to places of completion and storage;

- carrying out thrashing, cleaning of the plants containing drugs in the closed territory the combines and by grain-cleaning machines equipped with devices for collection of lots;

- plowing under of remaining balance from thrashing and cleaning of the plants containing drugs;

- storage locations and conversions of the plants (thrashing, dosushivaniye, after-treatment) containing drugs (the closed storage facilities, the specially allotted platform for thrashing, after-treatment of products, destruction of remaining balance).

4. Qualification requirements for implementation of economic activity on cultivation and use of the plants containing drugs for the industrial purposes

4.1. Employees of the companies which activities are connected with cultivation and use of the plants containing drugs for the industrial purposes shall have professional and qualification training according to production requirements to cultivation and conversion of such plants.

4.2. The companies which economic activity is connected with cultivation and use of the plants containing drugs for the industrial purposes shall have the agronomist, the mechanical engineer on use of agricultural machinery.

4.3. Qualification of heads of the companies whose economic activity is connected with cultivation and use of the plants containing drugs for the industrial purposes shall provide accomplishment of all transactions according to technological conditions.

4.4. Persons allowed to cultivation of the plants containing drugs for the industrial purposes shall not have criminal records for drug-related crimes and to be on accounting in narcological dispensary.

5. Special requirements for implementation of economic activity for cultivation and use of the plants containing drugs for the industrial purposes

5.1 Obligatory carrying out approbation on seed-growing crops in phase of blossoming (maturing) of the plants containing drugs for carrying out expert research for the purpose of determination of content of alkaloids in them. In case of exceeding of admissible level of morphine or tetrahydrocannabinol (it is more % 0,15) to carry out rejection of such crops of plants from seed-growing, to draw up the relevant commission act.

5.2. Destruction of crops of the plants containing drugs, sowed by seeds of unknown origin or own commodity seeds, way of plowing up of the mown and crushed plants in the presence of the commission which part the director and the representative of territorial authority of internal affairs, and creation of the relevant act (appendix 2) shall be.
