About approval of the Regulations on the organization of programs of vocational training in the form of dual education

Based on part (5) article 59 of the Code about formation of the Republic of Moldova No. 152 of July 17, 2014. (The official monitor of the Republic of Moldova, 2014, Art. No. 319-324, 634), with subsequent changes and amendments, DECIDES: the Government

1. Approve Regulations on the organization of programs of vocational training in the form of dual education it (is applied).

2. Monitoring and coordination of the organization of programs of vocational training in the form of dual education to assign to the Ministry of Public Education, cultures and researches.

3. To bodies of the central public management and Chamber of Commerce and Industry in 2-month time after publication of this resolution:

a) bring own regulating documents into accord with provisions of this resolution;

b) accept the regulating documents necessary for accomplishment of this resolution.

Regulations on the organization of programs of vocational training in the form of dual education

Chapter I. General provisions

1. The regulations on the organization of programs of vocational training in the form of dual education (further – the Provision) determine procedure for the organization and functioning of programs of vocational training in the form of dual education.

2. Dual education represents alternative form of the organization of vocational training which assumes training in organization of vocational training and in business entity with use of their means for the purpose of the knowledge acquisition, skills and competences corresponding to professional qualification of level 3, 4 and 5 MSKO according to the National frame of qualifications of the Republic of Moldova.

3. Programs of vocational training in the form of dual education include 3 components:

1) the general education, which purpose – development of the competences providing successful/successful professional activity in all its manifestations;

2) profile education (theoretical and practical) – represents accumulating of knowledge and forming of the basic abilities integrated into professional competences;

3) optional education – provides expansion of knowledge and development of certain abilities of pupils in the area of professional training chosen by them or in other adjacent areas.

4. Dual education has the following specific characteristics:

1) the organization for initiative of the interested business entity as potential employers or organization of vocational training;

2) ensuring profile training, under responsibility of business entity, in the conditions of real labor activity with monthly payment of student's salary;

3) ensuring participation of business entity in the course of assessment and certification of competences of the pupil.

5. For the purposes of this provision the stated below determinations and expressions are used in the following value:

business entity – the company - physical person or legal entity, irrespective of type of property and form of business, founded and registered according to the current legislation which confirmed the interest in implementation of the program of professional training for system of dual education;

public body – any organizational structure or body founded by the law or the administrative regulation, which are functioning in the government mode for the purpose of realization of public interest and made the decision on implementation of the program of professional training in the form of dual education;

the pupil in system of dual education – the pupil who was enlisted on training within the authorized and accredited programs of professional training in the form of dual education also signed the student's contract for receipt of dual education with business entity;

the agreement on cooperation – the legal document regulating the legal relations between organization of vocational training and business entity for the purpose of providing pupils with conditions for training at business entity within the program for professional training in the form of dual education, constituted according to appendix No. 1 to this Provision;

the agreement on passing of apprenticeship in system of dual education (further – the student's agreement) – the legal act which consists in writing between business entity and the pupil for the certain term constituted according to appendix No. 2 to this Provision;

student's salary – remuneration or the earnings in terms of money paid by business entity to the pupil based on the student's agreement;
