RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

About measures for the organization of activities of the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan

In pursuance of the Presidential decree of the Republic of Uzbekistan of December 12, 2017 No. UP-5278 "About Measures for Radical Reforming of National System of Rendering the State Services to the Population" and resolutions of the President of the Republic of Uzbekistan of December 12, 2017 No. PP-3430 "About the organization of activities of the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan" the Cabinet of Ministers decides:

1. Approve:

Regulations on the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan according to appendix No. 1;

The actions plan on implementation of the List step by step of the state services implemented in 2018 - 2020 rendered by the principle "one window" it is exclusive through the Centers of the state services, No. UP-5278, approved by the Presidential decree of the Republic of Uzbekistan of December 12, 2017 according to appendix No. 2.

2. Determine that:

The agency of the state services under the Ministry of Justice of the Republic of Uzbekistan (further - the Agency) is the authorized body of public administration performing activities in the field of rendering the state services to physical persons and legal entities;

The agency in the activities irrespective of other bodies of the public and economic board, public authorities on places and is accountable to the Ministry of Justice of the Republic of Uzbekistan;

all amount of the state fee arriving for state registration of subjects of entrepreneurship, means in the amount of 20 percent from the amount of the paid state fees, charges and all payment types for the state services rendered through the Centers and their branches, 10 percent from the amount of the paid state fees, charges and all payment types for the state services rendered based on addresses of the applicants who are independently directed through the Single portal of interactive state services of the Republic of Uzbekistan, 16 percent from the amount of the state fees collected by bodies the REGISTRY OFFICE and 85 percent from the amount of the stamp tax levied for issue of stamp certificates, the amounts of the administrative penalties applied for violation by officials of procedure for rendering the state services are enlisted in accordance with the established procedure on off-budget fund of the Agency;

funds of off-budget fund of the Agency are allocated for content, forming and strengthening of its material and technical resources, compensation, material stimulation and social protection of employees of the Agency, its territorial administrations, centers of the state services and their branches, bodies of civil registration, and also other purposes according to the legislation, based on expense budgets and staff lists approved by the Agency and its territorial administrations and registered in the relevant financial bodies.

3. To the Ministry of Justice of the Republic of Uzbekistan:

in coordination with the Ministry of Finance of the Republic of Uzbekistan to approve Regulations on procedure for use of means of off-budget fund of the Agency in a month;

in week time together with the Ministry of Finance of the Republic of Uzbekistan to provide opening of the corresponding treasurer personal accounts according to the income for separate accounting of receipt of funds specified in Item 2 of this resolution;

in week time to allocate from specially opened personal account of the Ministry of Justice of the Republic of Uzbekistan for financing of activities of the centers "one window" of funds for forming of material and technical resources of the Agency and its territorial administrations, equipment with their computer and multiplying equipment, means of communication, software, office furniture necessary for the organization of effective work, and also for acquisition and content of office vehicles;

provide transfer to personal account of off-budget fund of the Agency of remaining balance of the means intended for financing of activities of the single centers for rendering the state services to subjects of entrepreneurship by the principle "one window" including the means placed on deposits of commercial banks;

provide in accordance with the established procedure transfer on a grant basis to territorial administrations of the Agency of buildings and constructions of the single centers for rendering the state services to subjects of entrepreneurship by the principle "one window", and also the vehicles belonging to them, the equipment, stock, documentation and other property.

4. To state bodies and the organizations which services are rendered through the centers of the state services, timely to provide information on details of bank and treasurer accounts for transfer of appropriate means, including data on changes of these accounts.

5. Determine that:

the annual limits of run of office road transport and standard rates of servicing by passenger vehicles of state-financed organizations on duty established by the resolution of the Cabinet of Ministers of April 2, 1999 No. 154 do not extend to the vehicles used for rendering mobile (exit) state services;

in case of introduction of positions of the driver of office motor transport standard rates and conditions of the introduction servicing and technicians of bodies of the public and economic board do not extend to the Agency and its territorial administrations.

6. To the Ministry of Finance of the Republic of Uzbekistan to provide to the Agency limit on content of vehicles in number of 3 units for central office of the Agency and 42 units for territorial administrations of the Agency.

7. To the ministry of development of information technologies and communications of the Republic of Uzbekistan:

together with the Ministry of Finance of the Republic of Uzbekistan to take necessary measures for development of the mechanism of timely money transfer in the amount of 20 percent from the amount of the paid state fees and all types of charges for the state services rendered through the Single portal of interactive state services of the Republic of Uzbekistan on personal accounts of off-budget fund of the Agency;

provide in accordance with the established procedure the Agency with necessary telephone communication, including government communication.

8. Place the Tashkent municipal government of the Agency of the address: the city of Tashkent, Prospekt Amir Temur, the house 14 on the right of free use.

9. Permit, according to the procedure of exception to khokimiyat of Tashkent to determine the contract and project organizations for implementation of repair of the building of the Tashkent municipal government of the Agency, at the address: Tashkent, Prospekt Amir Temur, the house 14, by selection of the best offers, without carrying out the competitive biddings.

10. To provide to JSC Uzavtosanoat according to requests of the Agency allocation of vehicles.

11. To the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

12. To impose control of execution of this resolution on the deputy prime minister - the Minister of Finance of the Republic of Uzbekistan D. A. Kuchkarov and the Minister of Justice of the Republic of Uzbekistan R. K. Davletov.

Regulations on the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan

Chapter 1. General provisions

1. This Provision determines the status, the main objectives, functions, the rights, responsibility and procedure for the organization of activities of the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan (further - the Agency), and also functional obligations and responsibility of his heads.

2. The agency is the authorized body of public administration performing activities in the field of rendering the state services to physical persons and legal entities.

3. The agency is structural division of the Ministry of Justice of the Republic of Uzbekistan (further - the Ministry) and enters its system.

The common directorship and control of activities of the Agency, strengthening of material and technical resources and the organization of advanced training of employees of the Agency are performed by the Ministry.

4. Coordination of activities of the Agency is performed by divisions of the adviser to the President of the Republic of Uzbekistan concerning protection of the rights of citizens and work with addresses.

5. The agency performs the activities according to the Presidential decree of the Republic of Uzbekistan of December 12, 2017 No. UP-5278 "About Measures for Radical Reforming of National System of Rendering the State Services to the Population" and the resolution of the President of the Republic of Uzbekistan of December 12, 2017 No. PP-3430 "About the organization of activities of the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan".

6. The agency in the activities is guided by the Constitution and the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers, this Provision, other acts of the legislation, and also decisions of the Ministry.

7. The decisions of the Agency made within its powers are obligatory for execution of the public and economic board by bodies, executive bodies on places, other organizations and their officials.

8. The agency and its managements to the Republics of Karakalpakstan, areas, Tashkent (further - territorial administrations) are legal entities, have seal and forms with the image of the State Emblem of the Republic of Uzbekistan and the name in state language, separate balance, treasurer personal accounts in Treasury of the Ministry of Finance of the Republic of Uzbekistan, bank accounts, including in foreign currency.

9. The centers of the state services are not legal entities‚ have no the isolated property in property‚ economic maintaining or operational management.

The centers of the state services have seal and forms with the image of the State Emblem of the Republic of Uzbekistan.

9-1. Departments of civil registration of areas (cities) and house of wedding (further - departments the REGISTRY OFFICE), and also the REGISTRY OFFICES territorial archives (further - bodies the REGISTRY OFFICE) are not legal entities, have no the isolated property in property‚ economic maintaining or operational management.

Bodies the REGISTRY OFFICE have seal and forms with the image of the State Emblem of the Republic of Uzbekistan.

9-2. Branches of the Centers of the state services (further - branches) are not legal entities, have no the isolated property in property‚ economic maintaining or operational management.

10. Official name of the Agency:

1) in state language:

complete - Ўзбекистон Respublikasi Adliya of huzuridaga vazirliga Davlat of agentliga hizmatlara, reduced - Davkhizmat of agentliga;

2) in Russian:

complete - the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan reduced - the Agency of state services;

3) in English:

complete - Public services agency under the Ministry of Justice of the Republic of Uzbekistan reduced - Public services agency.

Chapter 2. System of the Agency

11. The Agencies log in:

Chapter 3. Tasks and functions of the Agency and its territorial administrations

§ 1. Tasks and functions of the Agency

12. The main objectives of the Agency are:

1) realization of single state policy in the field of rendering the state services to physical persons and legal entities;

2) enhancement of procedure for rendering the state services due to elimination of excessive ministerial procedures, and also development of interdepartmental electronic interaction;

3) forming of the Unified register of the state services, implementation of coordination of activities of state bodies and other organizations in this sphere;

4) participation in development of single design approaches, development, to implementation and integration of the information systems, resources and databases used when rendering the state services;

5) control and efficiency evaluations of activities of state bodies and other organizations in the field of rendering the state services, including in implementation of the corresponding information systems, resources and databases;

6) the organization of implementation of innovative forms and methods of rendering the state services, development of suggestions for improvement of the legislation and law-enforcement practice in this sphere.

13. The agency according to the tasks assigned to it performs the following functions:

1) in the field of realization of single state policy in the field of rendering the state services to physical persons and legal entities:

the REGISTRY OFFICE in questions of rendering the state services coordinates and performs methodical management of activities of state bodies and other organizations including bodies;

develops offers on the priority directions of enhancement and also in the field of the REGISTRY OFFICE of rendering the state services, provides their realization;

develops according to orders of the President of the Republic of Uzbekistan, the Cabinet of Ministers of the Republic of Uzbekistan, the Ministry and on own initiative drafts of the laws and other regulatory legal acts concerning enhancement of the sphere of rendering the state services;

informs the public on condition of rendering the state services;

the REGISTRY OFFICE performs the common directorship of activities of the Centers of the state services, branches and bodies;

promotes expansion and increase in efficiency of international backgrounds in the field of rendering the state services, also the cooperation with the foreign and international organizations for rendering the state services establishes connection;

will organize implementation of state registration of legal entities, and also physical persons as subjects of entrepreneurship;

provides respecting the rule of law in case of liquidation of the organizations which are not performing financial and economic activities exercises control of activities of authorized bodies and the organizations in case of liquidation of the organizations;

2) in the field of enhancement of procedure for rendering the state services due to elimination of excessive ministerial procedures, and also development of interdepartmental electronic interaction:

establishes close interaction with state bodies and other organizations for the purpose of non-admission of bureaucratic barriers and obstacles when rendering the state services;

provides efficiency, efficiency and transparency of activities of state bodies and other organizations, strengthening of their responsibility and performing discipline, creation of additional mechanisms of providing feedback with the population and subjects of entrepreneurship;

implements and enhances procedure for electronic document management between state bodies and other organizations with use of infrastructure of interdepartmental information exchange;

coordinates and helps the organization of activities for information exchange between state bodies, other organizations and the Single portal of interactive state services of the Republic of Uzbekistan;

takes necessary measures for reducing the documents and data demanded from citizens when rendering the state services;

conducts systematic surveys among the population and subjects of entrepreneurship for the purpose of improvement of quality of the rendered state services;

3) in the field of forming of the Unified register of the state services, implementation of coordination of activities of state bodies and other organizations in this sphere:

creates the Unified register of the state services, and also provides its proper (urgent) condition;

coordinates activities of state bodies and other organizations in the field of forming of the Unified register of the state services;

makes offers on inclusion and (or) exception of the state services of the Unified register of the state services;

4) in the field of participation in development of single design approaches, development, to implementation and integration of the information systems, resources and databases used when rendering the state services:

promotes creation of necessary organizational and technical and financial and economic conditions for expansion of interaction of state bodies, other organizations and the centers of the state services directed to improvement of quality and efficiency of provision of the state services;

together with state bodies and other organizations develops single design approaches, to development, implementation and integration of the information systems, resources and databases used when rendering the state services;

provides creation of conditions for the physical persons and legal entities addressing to the centers of the state services, for acquisition of the digital signatures used when rendering the state services by them;

takes necessary measures for ensuring complete transition to electronic form of rendering the state services by refusal of paperwork and bureaucracy;

performs coordination, assessment and control of activities of state bodies and other organizations for implementation and integration of the information systems, resources and databases used when rendering the state services;

5) in the field of control and efficiency evaluation of activities of state bodies and other organizations in the field of rendering the state services, including in implementation of the corresponding information systems, resources and databases:

controls work of state bodies and other organizations for accomplishment of established procedure of rendering the state services by them;

performs the analysis of activities of state bodies and other organizations in the field of implementation of ministerial procedures, including rendering the state services;

performs checks of activities of the state bodies and other organizations rendering the state services regarding observance of requirements of the legislation and administrative regulations;

in writing announces to officials of caution inadmissibility of violation of the law in the field of rendering the state services;

brings to heads of state bodies and other organizations, including bodies of economic board, the organizations of housing-and-municipal and operational servicing rendering the state services obligatory for consideration of idea of elimination of the revealed violations, the reasons and conditions promoting them;

applies to officials of state bodies and other organizations, including bodies of economic board, the organizations of housing-and-municipal and operational servicing administrative punishments for violations of the law in the field of rendering the state services;

two times a year prepare for submission to Administration of the President of the Republic of Uzbekistan and the Cabinet of Ministers of the Republic of Uzbekistan the detailed information on condition of activities of state bodies and other organizations for rendering the state services containing data on violations of the law in this sphere, perpetrators and the arising problems, and also offers on elimination of the specified shortcomings;

6) in the field of the organization of implementation of innovative forms and methods of rendering the state services, developments of suggestions for improvement of the legislation and law-enforcement practice in this sphere:

prepares suggestions for improvement of the legislation and law-enforcement practice in the field of ministerial procedures, including rendering the state services, taking into account modern achievements of research and innovative activities;

will organize implementation of the innovative forms of public administration providing optimization and simplification of procedures of rendering the state services, increase in efficiency of activities of state bodies and other organizations;

will organize active implementation of the advanced information and communication technologies to the sphere of rendering the state services, including by broad application of digital signatures and the Internet;

realizes measures for ensuring contactless interaction of applicants with the state bodies and other organizations rendering the state services;

provides the qualified information and advisory help to physical persons and legal entities when rendering the state services;

exercises supervision of completeness of disclosure and availability of information on the state services.

14. The agency can perform also other functions according to the legislation.

§ 2. Tasks and functions of central office of the Agency

15. The main objectives of central office of the Agency are:

1) providing together with territorial administrations, the centers of the state services, branches and bodies the REGISTRY OFFICE of effective implementation of the tasks and functions assigned to the Agency;

2) the organization of enhancement of system of rendering the state services and monitoring of quality of their rendering on the basis of studying of experience of the developed foreign states;

3) implementation of information and communication technologies in activities of the Agency, including territorial administrations, centers of the state services, branches and bodies the REGISTRY OFFICE;

3-1) technical supply and functioning of information system "REGISTRY OFFICE single electronic archive;

4) coordination of staffing in territorial administrations, the centers of the state services, branches and bodies the REGISTRY OFFICE;

5) development assistance of the centers of the state services, determination of the concept and perspective of development of system of rendering the state services;

In writing to announce 6) to officials of caution inadmissibility of violation of the law in the field of rendering the state services;

To apply 7) to officials of state bodies and other organizations administrative punishments for violation of the law in the field of rendering the state services.

16. The central office of the Agency according to the main objectives assigned to it performs the following functions:

1) systematic control over the implementation by territorial administrations, centers of the state services, branches and bodies provides the REGISTRY OFFICE of the laws of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, decisions of the Government of the Republic of Uzbekistan;

2) is performed by organizational and information and analytical support of activities of the Agency and its management;

3) will organize implementation of orders and orders of the director of the Agency (further - the Director) and his deputy within the powers;

4) monitoring of activities of territorial administrations, centers of the state services, branches and bodies will organize the REGISTRY OFFICE;

5) assists in carrying out research works for the purpose of development of the state services;

6) will be organized by legal support of activities of the Agency, including in the field of rule-making;

7) is performed by collection, generalization and information analysis for management of the Agency about tendencies of rendering the state services for the purpose of acceptance of management decisions;

8) renders to physical persons and legal entities information and advisory support concerning rendering the state services;

9) is engaged in solutions of the operational, organizational, personnel, financial, production and economic and other issues which are within the competence of the Agency;

10) also the analysis of activities of territorial administrations, centers of the state services, branches and bodies the REGISTRY OFFICE exercises control;

11) effective implementation of the tasks assigned to it provides together with territorial administrations, the centers of the state services, branches and bodies the REGISTRY OFFICE;

12) is performed by interaction with state bodies and other organizations, and also physical persons and legal entities concerning enhancement of system of rendering the state services;

13) is performed by monitoring of quality of rendering the state services;

14) prepares offers on extension of the list of the state services rendered by the centers of the state services;

15) will be organized by financing, financial accounting and the reporting in the territorial administrations financed from the budget of the Republic of Karakalpakstan, local budgets of areas, Tashkent and extrabudgetary funds of bodies and organizations of justice, and also means of off-budget fund of the Agency;

16) material logistics of territorial administrations, centers of the state services, branches and bodies will organize the REGISTRY OFFICE;

17) will organize work with appeals of physical persons and legal entities;

18) is performed by international cooperation in the field of rendering the state services.

§ 3. Tasks and functions of territorial administrations

17. The main objectives of territorial administrations are:

1) participation in ensuring effective implementation of the tasks and functions assigned to the Agency;
