About additional measures for enhancement of the mechanism of delivery of coal products to the population and state-financed organizations of the Republic

For the purpose of providing regular supply of the population and state-financed organizations of the republic with coal and coal briquettes of proper quality, increase in responsibility of the organizations performing delivery and distribution of coal products, the Cabinet of Ministers decides:

1. Take into consideration that determination of need for coal and coal briquettes (further - coal products), their delivery and realization to state-financed organizations and the population are performed according to the procedure, the provided Regulations on procedure for realization, delivery, transportation, acceptance and storage of coal and the coal briquettes which are purchased by the state-financed organizations at the expense of budgetary funds, and Regulations on procedure for providing the republic with coal products of the population approved by the resolution of the Cabinet of Ministers of July 2, 2015 No. 177.

2. Approve:

the consolidating plan and the actions plan on providing with coal products the population and state-financed organizations during the autumn and winter period of 2016-2017 by the republic territories according to appendices No. 1 and 2;

the list of branches of the territorial distributor centers of JSC Uzbekugol which are subject to construction and reconstruction in 2017 according to appendix No. 3;

the list of the territorial distributor centers of JSC Uzbekugol which are subject to equipment by the equipment on production of coal briquettes in 2017 according to appendix No. 4.

3. For coordination and implementation of actions on providing with coal products the population and state-financed organizations of the republic to form working group in structure according to appendix No. 5.

4. Determine the main objectives of working group on coordination and implementation of actions by providing with coal products the population and state-financed organizations of the republic:

ensuring timely and complete delivery of the amounts of coal products approved by this resolution to the population and state-financed organizations during the autumn and winter period;

ensuring safety of coal products at all stages of its delivery;

the organization of effective control behind pricing level on coal products for state-financed organizations, and also behind respect for retail prices on the coal realized to the population;

timely implementation of actions on construction and equipment of coal warehouses of management "Temiryulyonilgitajmin" of JSC Uzbekiston temir yullari.

5. Establish procedure according to which:

Uzbekugol Unitary Enterprise provides shipment of coal to coal warehouses of management "Temiryulyonilgitajmin" of JSC Uzbekiston temir yullari and bears responsibility for quality and amounts of the shipped coal;

management "Temiryulyonilgitajmin" of JSC Uzbekiston temir yullari provides high-quality storage and realization of coal products only to the population and state-financed organizations;

JSC Uzbekiston temir yullari provides transportation of coal from the Uglesborochnaya station Uzbekugol Unitary Enterprise to the relevant stations of JSC Uzbekiston temir yullari and bears responsibility for timeliness of giving of cars and delivery of coal;

law-enforcement bodies enable implementation of actions on ensuring protection of coal products, since its production before distribution to the population and state-financed organizations;

in each makhalla chairmen of descents of citizens together with law-enforcement bodies and the state tax authorities provide distribution and realization of coal products to the population in accordance with the established procedure;

the coal products delivered within balance of resources and distribution of the coal which is annually approved by the Ministry of Economics of the Republic of Uzbekistan are included in the freight list, subject to protection and maintenance by job specifications of the militarized protection of JSC Uzbekiston temir yullari;

heads Uzbekugol Unitary Enterprise and coal warehouses of management "Temiryulyonilgitajmin" of JSC Uzbekiston temir yullari, the Chairman of the board of Ministers of the Republic of Karakalpakstan, hokima of areas, cities and areas bear the personal responsibility for stock forming of coal products, their address distribution and uninterrupted delivery to the population and state-financed organizations.

6. According to the procedure of exception to provide to JSC Uzbekiston temir yullari JSC Uzbekugol for up to March 1, 2017 discount in the amount of 50 percent from rates of the existing price list for transportation of coal products for needs of the population.

7. Establish from acceptance date of this resolution till March 1, 2017 retail price on the coal realized to the population in the amount of 126 400 bags for ton.

8. To the state committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition together with the Ministry of Finance and the State Tax Committee of the Republic of Uzbekistan to establish strict control for:

pricing level on coal products for state-financed organizations and to take measures for prevention and suppression of their unreasonable growth;

respect for retail prices on the coal realized to the population and also to accept, according to the legislation, effective measures to guilty persons for violations of established procedure.

9. To the Ministry of Finance of the Republic of Uzbekistan annually when forming the expense forecast of budgetary funds to provide in estimates of state-financed organizations implementation of uniform financing till October 1 of the next year for acquired coal products.

10. Determine that the special allowance in addition to wholesale selling price on the coal realized by the companies of coal industry established by the resolution of the Cabinet of Ministers of March 31, 2015 No. 75 "About change of the size of the special allowance to wholesale selling price on coal" is not subject to inclusion in taxable basis.

11. Uzbekugol Unitary Enterprise provide the direction of the funds released at the expense of exception of taxable basis of the special allowance to wholesale selling price on coal for implementation of investment projects, repayment of the credits and implementation of extra overburden works.

12. Provide to JSC Almalyksky MMC production and transfer of JSC Uzbekugol of 70 units of installations on production of coal briquettes with a productivity of 30 tons per day on account of dividends on the state share fraction in authorized capital of JSC Almalyksky MMC in the terms provided by appendix No. 4.

13. "Navoiy" to provide to GP with MMC production and transfer of JSC Uzbekugol of 14 units of installations on production of coal briquettes with a productivity of 150 tons per day at the expense of own means in the terms provided by appendix No. 4.

14. Determine source of financing of construction, reconstruction and equipment of coal warehouses of the territorial distributor centers of JSC Uzbekugol in 2017 the credit of commercial bank JSB Uzpromstroybank provided at the expense of loan resources of People's Bank from means of the Funded pension system, for a period of 3 years, including grace period of 6 months, with interest rate of 7,5 of annual interest rate, including margin of the refinancing bank in the amount of annual interest rate 0,5.

15. To Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, cities and areas:

establish permanent monitoring of schedule performance of monthly delivery of coal products to the population;

provide, according to requests of JSC Uzbekugol, provision of the parcels of land for construction and reconstruction of branches of the territorial distributor centers according to appendix No. 3.

16. Permit, according to the procedure of exception, to JSC Uzbekugol and contract organizations determined in accordance with the established procedure by Council of Ministers of the Republic of Karakalpakstan and khokimiyats of areas, to perform construction and reconstruction of branches of the territorial distributor centers with simultaneous development of the design estimates till July 1, 2017.

17. To provide to the state committee of the Republic of Uzbekistan on architecture and construction expert maintenance of development of the design estimates and to establish the state architectural and construction supervision of quality of accomplishment of installation and construction works.

18. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to to appendix No. 6.

19. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzbekiston temir yullari A. Zh. Ramatov and the deputy prime minister of the Republic of Uzbekistan G. I. Ibragimov.

* Supply rates of coal products are determined by appendix No. 5 to the Resolution of the President of the Republic of Uzbekistan of June 10, 2015 No. PP-2545 "About measures for ensuring complex preparation of industries of economy and the social sphere of the republic to steady work during the autumn and winter period of 2016/2017":

a) to the population - 847 thousand tons;

b) to state-financed organizations - 328,5 of one thousand tons.
