About approval of form of the centralized register of receivers of compensation and rules of its representation

According to the subitem 1) of article 5 of the Law of the Republic of Kazakhstan "About Fund to compensation by the victim", the subitem 261) of Item 15 of the order of the Government of April 24, 2008 No. 387 "About some questions of the Ministry of Finance of the Republic of Kazakhstan", I ORDER:

1. Approve:

1) form of the centralized register of receivers of compensation according to appendix 1 to this order;

2) rules of submission of the centralized register of receivers of compensation according to appendix 2 to this order.

2. To department of the budget legislation of the Ministry of Finance of the Republic of Kazakhstan (Ernazarova Z. A.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective since July 1, 2020 and is subject to official publication.

Rules of submission of the centralized register of receivers of compensation

Chapter 1. General provisions

1. These rules of submission of the centralized register of receivers of compensation (further - Rules) compensations by the victim" (further - the Law), the subitem 261) of Item 15 of the order of the Government of April 24, 2008 No. 387 "About some questions of the Ministry of Finance of the Republic of Kazakhstan" are developed according to the subitem 1) of article 5 of the Law of the Republic of Kazakhstan "About Fund and determine procedure for submission of the centralized register of receivers of compensation (further - the register).

Chapter 2. Procedure for submission of the centralized register

2. The register is kept by the state bodies performing functions of criminal prosecution in form, according to appendix 1 to this order, according to the decision on compensation payment.

3. The register contains the following data of receivers of compensation:

1) the Surname, name, middle name (in case of its availability);

2) individual identification number of the receiver;

3) bank details of the receiver (business and identification number, individual identification code, in the presence of the current/personal bank account of the receiver, specifying of account number);

4) compensation amount.

4. Receipts (further - Fund) are enlisted in Fund of compensation by the victim into the control account of cash opened in the central authorized body on budget implementation. Use of fund is performed only on the purposes provided by the Law.

5. The register is submitted the state bodies performing functions of criminal prosecution, in authorized body on budget implementation monthly to the fifteenth, following decision about purpose of compensation.

6. The authorized body on budget implementation based on the register creates the payment order.

Payments of compensation are performed from Fund on the bank account of receivers of compensation.

7. Payments by authorized body for budget implementation are made based on the register in the presence of means on the control account of cash of Fund no later than ten calendar days following date of submission of the register by state bodies, the performing functions of criminal prosecution.

8. In cases of absence or insufficiency of money of Fund, payment of compensation is performed by authorized body on budget implementation in process of replenishment of fund according to the procedure of priority of receipt of registers.

9. In case of excessively (mistakenly) paid amounts according to the register from the control account of cash of Fund the state bodies performing functions of criminal prosecution take necessary measures for their return.

10. The authorized body on budget implementation notifies the state bodies performing functions of criminal prosecution on execution of the register by the direction of the Notification on the registered payments according to centralized registers of receivers of compensation in form according to appendix to these rules.

11. In case of return of payments in connection with incorrect specifying in the register of these receivers of compensation, the authorized body on budget implementation notifies the state bodies performing functions of criminal prosecution on return reasons.

The state bodies performing functions of criminal prosecution correct incorrectly specified data and include receivers of compensations on which return of payments, in the following Register is made.
