About approval of Rules of rendering services of local telephone communication

Taking into account requirements of today, broader development of the market relations by National communication agency of the Kyrgyz Republic corresponding changes and additions are made to Instructions for use by services of city and rural telephone communication I order:

1. Approve Rules of rendering services of local telephone communication and enact them from the moment of signing of this order.

2. Consider invalid:

- The order of Department of communication of the Ministry of Transport and Communications of the Kyrgyz Republic No. 89 of 1.04.97. "About approval of Instructions for use city and rural telephone communication" and the Rules approved by this order;

- The order of National communication agency of the Kyrgyz Republic No. 61-pr of 26.07.99. "About modification and amendments in the existing Instructions for use city and rural telephone communication".

3. To the head of department of technical policy and state supervision (Eremenko V. S.):

- inform the Ministry of Transport and Communications of the Kyrgyz Republic on introduction of these rules of rendering services of local telephone communication;

- bring this order to JSC Kyrgyztelekom for management and execution.

4. To impose control of execution of this order on department of technical policy and the state supervision.

Rules of rendering services of local telephone communication

I. General provisions

1. Rules of rendering services of local telephone communication (city and rural) are developed according to the laws of the Kyrgyz Republic "About electric and mail service", "About consumer protection", other legal acts, contain the provisions obligatory for subscribers and the companies rendering services of local telephone communication in the territory of the Kyrgyz Republic (further in the text - the KR), and govern the relations between them.

2. These rules determine procedure for rendering services of telephone communication by the communication networks the public, departmental communication networks having exit to communication networks public, and allocated with communication networks of non-productive appointment.

Action of these rules does not extend to rendering services of telephone communication by the networks of mobile radiotelephone communication allocated with the communication networks for needs of management, defense, safety and protection of law and order created according to regulatory legal acts of the KR, and also the communication networks of intra production and technological appointment which do not have exit to telephone network public.

3. For the purposes of these rules the following main terms are applied:

"subscriber" - physical person or legal entity with which the service provision agreement of telecommunication is signed with allocation of subscriber number;

"subscriber number" - number selected to the subscriber in case of the conclusion of the service provision agreement of telecommunication according to which connection to telephone network the terminal (subscriber) device is identified in case of connection with it of other terminal (subscriber) devices;

"automatic system of servicing" - method of telephone connection without the assistance of the operator. The user independently dials number necessary for connection with the called subscriber device;

"custom system of servicing" - establishment of telephone connection with the help of the operator;

"the order for connection" (order) - the user requirement to establish telephone connection;

"the action area of svyazi operator - the territory in which the telecom operator is authorized to render communication services according to the license;

"the action area of telephone exchange" - the territory in which the cable (air) lines of the high-level, distribution network included in this telephone exchange or substation are placed;

"long distance telephone communication" - telephone connection between the users who are in different administrative and territorial units of the KR (except urban areas);

"the international telephone communication" - telephone connection between the user who is in the territory of the KR and the user who is in the territory of other state;

"local telephone communication" - telephone connection between the users who are in limits of one settlement or administrative area;

"the terminal equipment" (the subscriber device) - directly or not directly the technical means or devices connected through subscriber lines or with use of wire, fiber-optic and electromagnetic devices to network of telecommunication by means of which the user can transfer, transform or accept messages;

"the operator of telecommunication" - any legal entity or physical person operating network of telecommunication;

"time payment system of services of telephone communication" - payment system in case of which the payment amount of the subscriber for certain (settlement) period of time depends on time during which lines and constructions of telephone network for information transfer and receipt of other services of telephone communication were used;

"user" - the physical person or legal entity using services of telephone communication based on the agreement on their provision (subscriber), and also using one-time services;
