In pursuance of article 44 of the Law of Ukraine "About telecommunications"

I ORDER:

1. Approve Licensed conditions of implementation of activities in the field of telecommunications for provision of services of the fixed international, long distance, local telephone communication with the right of maintenance and operation of telecommunication networks and provisions in use of channels of telecommunication (daleelitsenzionny conditions) which are applied.

2. (Zverev V. P.) in accordance with the established procedure to provide to management of coordination of activities of telecom operators and licensing of the State Committee on Communications of Ukraine provision of this order on state registration in the Ministry of Justice of Ukraine.

3. To the vice-chairman of the State committee of communication and informatization of Ukraine (Kolyadenko V. A.) provide the publication of the order on approval of Licensed conditions in mass media and placement on the Web page of the State Committee on Communications of Ukraine.

4. Consider invalid the order Gospredprinimatelstva and the State Committee on Communications of 13.02.2001 N33/16 "About Approval of Licensed Conditions of Implementation of Economic Activity on Provision of Services of Telephone Communication (except Departmental Objects)" registered in the Ministry of Justice of Ukraine on March 5, 2001 for N 194/5385.

5. To impose control of execution of this order on the First Deputy Chairman of the State Committee on Communications on bonds with the Verkhovna Rada of Ukraine of Prozhivalsky O. P.

Licensed conditions of implementation of activities in the field of telecommunications for provision of services of the fixed international, long distance, local telephone communication with the right of maintenance and operation of telecommunication networks and provisions in use of channels of telecommunication

1. General provisions

1.1. These Licensed conditions are developed according to the Laws of Ukraine "About telecommunications", "About radio-frequency resource of Ukraine", "About confirmation of conformity", the Economic code of Ukraine, other regulatory legal acts and industry regulating documents regulating implementation of activities in the field of telecommunications determine procedure for provision of services of the fixed telephone communication.

1.2. Licensed conditions contain exhaustive list of the organizational, qualification, production and other special requirements obligatory for accomplishment when implementing activities for provision of services of the fixed telephone communication which is subject to licensing.

1.3. These Licensed conditions extend to all subjects of housekeeping - residents of Ukraine which perform or intend to perform activities for provision of services of the fixed telephone communication.

1.4. Subjects of housekeeping which perform or intend to perform activities for provision of services of the fixed telephone communication, shall observe requirements of the Laws of Ukraine "About telecommunications", "About consumer protection", "About protection of the economic competition", "About radio-frequency resource of Ukraine", "About metrology and metrological activities", "About confirmation of conformity", the Economic code of Ukraine, other regulatory legal acts and industry regulating documents regulating activities in the field of telecommunications including determine the principles of creation and operation of networks, rules of interaction and mutually connection of telecommunication networks, procedure for stop and the termination of activities for provision of telecommunication services of operators and providers of telecommunications in the field of telecommunications, procedure for provision by operators in use on contractual bases of resources of the networks to the state system of government communication, national system of confidential communication, bodies for emergency situations, safety, defenses, internal affairs of Ukraine, procedure for consideration of appeals of operators about decision concerning dispute between the parties of mutually connection of networks, procedure for settlement between operators for the carried-out telephone conversations, rules of implementation of activities of operators of the long distance, international fixed telephone communication of telecommunication networks public (further - TSOP), procedure for routing of entrance and output telephone traffic, procedure for identification of not certified equipment, procedure for creation of system and the plan of numbering of TSOP, procedure for maintenance of telecommunication networks, technical regulations and parameters of channels of telecommunication and the equipment of telecommunications, regulations and indicators of quality of provision of telecommunication services, rules of provision and receipt of telecommunication services, the interstate standards (state standard specifications), state standards of Ukraine (DSTU), industry standards of Ukraine (GSTU) leading regulating documents (KND), and also Concepts of development of telecommunications of Ukraine which is developed according to the Law of Ukraine "About telecommunications", and so forth.

1.5. Subjects of housekeeping perform the activities in the field of telecommunications which are subject to licensing only in the presence of licenses.

1.6. Subjects of housekeeping can obtain licenses for provision of services of the fixed telephone communication with the right of maintenance and operation of telecommunication networks and provisions in use of channels of telecommunication:

international (the license is granted on all territory of Ukraine);

long-distance (the license is granted on the declared regions);

local (the license is granted on the declared regions):

with reservoir of network to 1000 numbers;

with reservoir of network to 10 000 numbers;

with reservoir of network more than 10 000 numbers;

with use of besprovodovy access (on the technologies DAMPS, CDMA, DECT and other technologies determined by TsOVZ);

in the rural zone;
