About renewal of agreements on fixing of shares of quotas of production (catch) of water biological resources according to part 8 of article 60 of the Federal law "About Fishery and Preserving Water Biological Resources" and introduction of amendments to some acts of the Government of the Russian Federation

1. Approve enclosed:

Rules of renewal of agreements on fixing of shares of quotas of production (catch) of the water biological resources specified regarding 1 article 60 of the Federal law "About Fishery and Preserving Water Biological Resources" which effective period expires after December 31, 2018;

approximate form of the agreement on fixing of share of quota of production (catch) of water biological resources in internal sea waters of the Russian Federation, in the territorial sea of the Russian Federation, on the continental shelf of the Russian Federation, in exclusive economic zone of the Russian Federation, the Caspian Sea for implementation of industrial fishery and (or) inshore fishing;

approximate form of the agreement on fixing of share of quota of the production (catch) of water biological resources provided to the Russian Federation in areas of action of international treaties of the Russian Federation in the field of fishery and preserving water biological resources for implementation of industrial fishery and (or) inshore fishing;

approximate form of the agreement on fixing of share of quota of production (catch) of water biological resources in internal waters of the Russian Federation, except for internal sea waters of the Russian Federation, for implementation of industrial fishery;

changes which are made to acts of the Government of the Russian Federation.

2. This resolution becomes effective since April 1, 2018.

Rules of renewal of agreements on fixing of shares of quotas of production (catch) of the water biological resources specified regarding 1 article 60 of the Federal law "About Fishery and Preserving Water Biological Resources" which effective period expires after December 31, 2018.

1. These rules establish procedure for renewal of agreements on fixing of shares of quotas of production (catch) of water biological resources for implementation of industrial fishery on the continental shelf of the Russian Federation and in exclusive economic zone of the Russian Federation (further - quotas of production (catch) for implementation of industrial fishery), agreements on fixing of shares of quotas of production (catch) of water biological resources for implementation of industrial fishery in fresh-water water objects (in internal waters of the Russian Federation, except for internal sea waters of the Russian Federation) (further - quotas of production (catch) in fresh-water water objects), agreements on fixing of shares of quotas of production (catch) of water biological resources for implementation of inshore fishing in internal sea waters of the Russian Federation, in the territorial sea of the Russian Federation, on the continental shelf of the Russian Federation, in exclusive economic zone of the Russian Federation, the Caspian Sea (further - quotas of production (catch) for implementation of inshore fishing), agreements on fixing of shares of quotas of production (catch) of water biological resources for the Russian Federation in areas of action of international treaties of the Russian Federation in the field of fishery and preserving water biological resources (further respectively - the international agreements, quotas of production (catch) in areas of action of international treaties) which effective period expires after December 31, 2018.

2. Renewal of the agreements specified in Item 1 of these rules is performed by their termination and the conclusion with persons with whom such agreements are terminated of the agreements specified in Item 21 of these rules.

3. Renewal of the agreements specified in Item 1 of these rules is performed by the following authorized bodies:

a) Federal Agency for Fishery - concerning agreements on fixing of shares of quotas of production (catch) for implementation of industrial fishery, agreements on fixing of shares of quotas of production (catch) in fresh-water water objects concerning anadromous and catadromous species of fish, agreements on fixing of shares of quotas of production (catch) for implementation of inshore fishing and agreements on fixing of shares of quotas of production (catch) in areas of action of international treaties;

b) executive body of the subject of the Russian Federation - concerning agreements on fixing of shares of quotas of production (catch) in fresh-water water objects (except for the agreements concerning fixing of shares of quotas of production (catch) of anadromous and catadromous species of fish).

4. For renewal of the agreements specified in Item 1 of these rules, the legal entities and individual entrepreneurs intending to renew such agreements (further - applicants), submit from April 1 to May 10, 2018 the letter request directly or the mailing or in the form of the electronic document signed by the strengthened qualified digital signature or with use of the federal state information system "Single Portal of the State and Municipal Services (Functions)".

5. Applicants represent to the body specified in Item 3 of these rules (further - authorized body), separate requisitions by each type of water biological resources in the respective areas of production (catch) of such water biological resources in the following procedure:

a) in case of availability of several shares of quotas of production (catch) in fresh-water water objects of certain type of water biological resources in the respective area of their production (catch) assigned to the applicant the application is submitted concerning all current agreements about fixing of shares of quotas of production (catch) in the fresh-water water objects concluded with the applicant in which shares of such quota are fixed;

b) in case of availability of several shares of quotas of production (catch) assigned to the applicant for implementation of industrial fishery and (or) the application is submitted by share of quotas of production (catch) for implementation of inshore fishing of certain type of water biological resources in the respective area of their production (catch) concerning all current agreements about fixing of shares of quotas of production (catch) for implementation of industrial fishery and (or) the agreements on fixing of shares of quotas of production (catch) for implementation of inshore fishing signed with the applicant in which such shares of quotas of production (catch) for implementation of industrial fishery and (or) share of quotas of production (catch) for implementation of inshore fishing are fixed;

c) if the international treaty water biological resources around action of such international treaty are not recognized as joint inventory of the Russian Federation and foreign state (foreign states), the application is submitted concerning all current agreements about fixing of shares of quotas of production (catch) in areas of action of international treaties;

d) if the international treaty water biological resources around action of such international treaty are recognized as joint inventory of the Russian Federation and foreign state (foreign states), the application is submitted concerning all current agreements about fixing of shares of quotas of production (catch) in areas of action of international treaties, and (or) agreements on fixing of shares of quotas of production (catch) for implementation of industrial fishery, and (or) the agreements on fixing of shares of quotas of production (catch) for implementation of inshore fishing signed with the applicant by one type of water biological resources.
