About approval of Rules of implementation by officials of bodies of state revenues of transport control at automobile check points through customs border of the Eurasian Economic Union

According to Item 9 of article 402 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan" we ORDER:

1. Approve the enclosed Rules of implementation by officials of bodies of state revenues of transport control at automobile check points through customs border of the Eurasian Economic Union.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the established legislation procedure to provide:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this joint order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this joint order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of implementation by officials of bodies of state revenues of transport control at automobile check points through customs border of the Eurasian Economic Union

Chapter 1. General provisions

1. These rules of implementation by officials of bodies of state revenues of transport control at automobile check points through customs border of the Eurasian Economic Union (further - Rules) are developed according to Item 9 of article 402 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan" and determine procedure officials of bodies of state revenues of transport control at automobile check points through customs border of the Eurasian Economic Union (further - check points).

2. Transport control of motor transportations on the territory of the Republic of Kazakhstan is exercised according to regulatory legal acts of the Republic of Kazakhstan, and also the international treaties ratified by the Republic of Kazakhstan.

Chapter 2. Procedure officials of bodies of state revenues of transport control at automobile check points through customs border of the Eurasian Economic Union

Paragraph 1. Actions of officials of bodies of state revenues when carrying out transport control

3. In case of journey of vehicles (further - automatic telephone exchange) through customs border of the Eurasian Economic Union (further - EEU) the official of bodies of state revenues (further - the official):

1) is carried out by control of execution of requirements of authorization system under the organization of the international motor transportations in the territory of the Republic of Kazakhstan according to the international treaties ratified by the Republic of Kazakhstan by verification of presence:

the car driver license on the right of the vehicle control or the temporary certificate issued instead of the car driver license with the identity document of the driver;

certificates on state registration of the vehicle or document testimonial of the property right to the vehicle;

the document on the taken load (commodity-transport delivery note) and other documents established by the legislation of the Republic of Kazakhstan on the vehicle;

allowing documents for driving of vehicles through the territory of the Republic of Kazakhstan;

special permission to journey of heavyweight and (or) large-size vehicles;

special authority for the move of dangerous goods of classes 1, 6 and 7;

2) performs on compliance of route of the vehicle established for the international message;

3) is carried out by control of observance by domestic and foreign carriers of the admissible dimensional and weight parameters of vehicles set to the territories of the Republic of Kazakhstan;

4) exercises the state control over the implementation by owners of vehicles of obligation according to the conclusion of the agreement of compulsory liability insurance of owners of vehicles;

5) exercises the state control over the implementation of obligation by carriers according to the conclusion of the agreement of compulsory liability insurance of carriers before passengers;

6) exercises the control of observance by carriers of Rules of transportations of the passengers and baggage by road transport approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of March 26, 2015 года№349 (registered in the Register of state registration of regulatory legal acts at No. 11550) and also non-admission of transportation of goods in insides of buses;

7) exercises control of observance by carriers of requirements to the railway vehicles which are carrying out perishable traffics in the international message;

4. Journey of the foreign vehicle following transit across the territory of the Republic of Kazakhstan without registration and distinctive mark of the state is performed based on the permission to transit issued according to the Rules of application of authorization system of motor transportations in the Republic of Kazakhstan in the international message approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of March 27, 2015 No. 353 (registered in the Register of state registration of regulatory legal acts at No. 11704).

The issued permissions to transit are registered in the Magazine of issue of domestic permissions to trip of "KZ" in form according to appendix 1 to these rules.

5. The official by results of the carried-out transport control performs actions for entering of data on automatic telephone exchange into the Register of vehicles in form according to appendix 2 to these rules, and also in information and analytical system of the transport database of Committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan.

Paragraph 2. Actions of officials when implementing check of the actual weight and dimensional parameters of automatic telephone exchange

6. Check of the actual weight and dimensional parameters of automatic telephone exchange is performed by officials with use of the certified automated system of determination of weight and dimensional parameters of vehicles and video surveillances, the automatic telephone exchange used for control of measurement of weight and dimensional parameters (further - the measuring equipment), results of weight and dimensional parameters of automatic telephone exchange remains in the database of the measuring equipment.

7. In case of journey of automatic telephone exchange via the measuring equipment the following is performed:

1) number of automatic telephone exchange, number of trail car is automatically determined;

2) measurement of dimensional parameters of automatic telephone exchange;

3) determination of weight parameters of automatic telephone exchange.

8. In case of defect (breakdown) of the measuring equipment the head of the check point reports on it the service record in the division of territorial authority responsible for operation of technical means of customs control, and also in Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan.

In such cases for determination of weight and dimensional parameters of automatic telephone exchange the reserve certified figurative podkladny scales and hand measuring tools are used.

At the same time the decision on measurement of weight and dimensional parameters of automatic telephone exchange without use of the measuring equipment is accepted by the head of the respective check point.

The official draws up the Statement of manual measurement in duplicate in form according to appendix 3 to these rules confirming reliability of results of manual measurement of weight and dimensional parameters which is signed and certified by personal number seal of the specified person.

One copy of the Act of manual measurement is issued to carrier or the driver of automatic telephone exchange, the second copy remains in body of state revenues (further - OGD), data from which are entered in the Register of Acts of manual measurement of weight and dimensional parameters of vehicles in form according to appendix 4 to these rules.

Results of measurement of weight and dimensional parameters of the automatic telephone exchange which are carried out on the reserve equipment are brought in the database of the measuring equipment in the manual mode.

9. In case of identification of the facts of exceeding of admissible weight and dimensional parameters of automatic telephone exchange in case of entrance on the territory of the Republic of Kazakhstan, measures are taken:

on involvement of carrier to the administrative responsibility according to article 571 of the Code of the Republic of Kazakhstan about administrative offenses;

on issue of special permission, according to the Rules of the organization and implementation of transportations of bulky and heavy loads in the territory of the Republic of Kazakhstan approved by the order of the Minister of investments and development of the Republic of Kazakhstan of February 27, 2015 No. 206 (registered in the Register of state registration of regulatory legal acts at No. 11395).

The special permissions issued by the official to OGD are registered in the Magazine of issue of forms of special permissions in form according to appendix 5 to these rules.

In case of refusal of carrier of receipt of special permission, the official of the check point according to the appeal of carrier allows carrying out unloading of automatic telephone exchange for reduction of compliance to the weight and dimensional parameters established in the territory of the Republic of Kazakhstan.

After reduction in compliance of weight and dimensional parameters of automatic telephone exchange repeated measurement of automatic telephone exchange with use of the measuring equipment is taken.

10. In case of identification of the facts of exceeding of admissible weight and/or dimensional parameters of automatic telephone exchange in case of departure of automatic telephone exchange out of limits of the territory of the Republic of Kazakhstan, measures are taken:

on involvement of carrier to the administrative responsibility according to article 571 of the Code of the Republic of Kazakhstan about administrative offenses;

on establishment of traffic route of automatic telephone exchange and determination of the amount of collection for the passable way on the territory of the Republic of Kazakhstan;

on calculation and collection of charges in the way passed by automatic telephone exchange on the territory of the Republic of Kazakhstan, at the rates, stipulated in Clause 554 Tax codes of the Republic of Kazakhstan.

11. In the presence the carrier of the international certificate has weighings of the cargo vehicle (further - the certificate of weighing) which is drawn up in accordance with the established procedure according to Rules of application in the territory of the Republic of Kazakhstan of the international certificate of weighing of the cargo vehicles approved by the order of the Minister of Transport and Communications of the Republic of Kazakhstan of February 23, 2011 No. 87 (registered in the Register of state registration of regulatory legal acts at No. 6817) (further - Rules of application of the certificate of weighing), repeated weighing of automatic telephone exchange at the check point is not made.

In case of submission of the certificate of weighing the measuring equipment is used for the purpose of accounting of data on automatic telephone exchange journey.

12. Obligatory repeated weighing of automatic telephone exchange on which the certificate of weighing is provided is made in cases, stipulated in Item 7 Rules of application of the certificate of weighing.

Paragraph 3. Actions of officials when carrying out transport control concerning the automatic telephone exchanges driving to the Republic of Kazakhstan and following in other state members of EEU or transit across the territory of other state members of EEU

13. Officials of the check point when carrying out transport control concerning the automatic telephone exchanges driving to the Republic of Kazakhstan and following in other state members of EEU or transit across the territory of other state members of EEU perform actions according to the Procedure of transport (automobile) control on external border of the Eurasian Economic Union, according to appendix 1 to the Protocol on the coordinated (approved) transport policy according to appendix No. 24 to the Agreement on the Eurasian Economic Union, ratified by the Republic of Kazakhstan of October 14, 2014.

Chapter 3. Final provisions

14. The questions of implementation of transport control which are not settled by these rules are regulated by other regulatory legal acts of the Republic of Kazakhstan.
