WE ORDER:

1. Bring in the joint order of the acting minister of science and education of the Republic of Kazakhstan of December 31, 2015 No. 719 and the acting minister of national economy of the Republic of Kazakhstan of December 31, 2015 No. 843 "About approval of criteria for evaluation of risk degree and checking sheets on checks behind education system" (it is registered in the Register of state registration of regulatory legal acts at No. 12777, it is published in the Information system of law of Ad_let on February 3, 2016) the following changes:

state Item 1 in the following edition:

"1. Approve:

1) criteria for evaluation of risk degree behind education system according to appendix 1 to this joint order;

2) checking leaf in the field of the state control of education system concerning the organizations of education realizing general education training programs of preschool education and training according to appendix 2 to this joint order;

3) checking leaf in the field of the state control of education system concerning the organizations of education realizing general education training programs of primary education according to appendix 3 to this joint order;

4) checking leaf in the field of the state control of education system concerning the organizations of education realizing general education training programs of the main secondary education according to appendix 4 to this joint order;

5) checking leaf in the field of the state control of education system concerning the organizations of education realizing general education training programs of general secondary education according to appendix 5 to this joint order;

6) checking leaf in the field of the state control of education system concerning the organizations of education realizing educational programs of technical and professional, postsecondary education according to appendix 6 to this joint order;

7) checking leaf in the field of the state control of education system concerning the organizations of education realizing educational programs of the organizations of additional education for children according to appendix 7 to this joint order;

8) checking leaf in the field of the state control of education system concerning the organizations of education realizing educational programs of the higher and postgraduate education according to appendix 8 to this joint order;

9) checking leaf in the field of the state control of education system concerning governing bodies of education according to appendix 9 to this joint order.";

in the Criteria for evaluation of risk degree behind education system approved by the specified joint order:

state Item 2 in the following edition:

"2. In these Criteria the following concepts are used:

1) assessment period - certain time period for which it is carried out risks assessments by subjective criteria based on reporting yielded, results of monitoring of the automated information systems;

2) insignificant violations - violations of the requirements established by regulatory legal acts in the field of education regarding the organization of teaching and educational process;

3) considerable violations - violations of the requirements established by regulatory legal acts in the field of education, regarding creation of conditions for conducting educational process;

4) gross violations - the violations of the requirements established by regulatory legal acts in the field of education, attracting or confirming decline in quality of educational process; on compliance of high-quality list of teachers;

5) risk - probability of decline in quality of the provided educational services and damnification to legitimate interests of physical persons and legal entities, the states as a result of activities of controlled subject (object);

6) system of risks assessment - the complex of actions held by control facility and supervision for the purpose of appointment and conducting checks;

7) criteria for evaluation of risk degree - set of the quantitative and qualitative indexes connected with direct activities of the checked subject (object), the features of industry development and factors influencing this development, the checked subjects allowing to carry to different risk degrees;

8) objective criteria for evaluation of risk degree (further - objective criteria) - the criteria for evaluation of risk degree used for selection of the checked subjects (objects) depending on risk degree in certain field of activity and which are not depending directly on the separate checked subject (object);

9) subjective criteria for evaluation of risk degree (further - subjective criteria) - the criteria for evaluation of risk degree used for selection of the checked subjects (objects) depending on results of activities of the specific checked subject (object);

10) the checked objects - the property which is on the property right or other legal cause at the checked subject, subject to control;

11) the checked subjects - physical persons, legal entities, including state bodies behind which activities control is exercised.";

state item 4 in the following edition:

"4. The checked subjects (objects) are distributed on risk degrees (high and not carried to high degree) taking into account one of the following objective criteria:

1) the checked subjects (objects) which educational activities are conducted according to state standards of education concern to group with high risk.

The following checked subjects concern to them:

the organizations of education realizing general education training programs of preschool education and training;

the organizations of education realizing general education training programs of primary education;

the organizations of education realizing general education training programs of the main secondary education;

the organizations of education realizing general education training programs of general secondary education;

the organizations of education realizing educational programs of technical and professional, postsecondary education;

the organizations of education realizing educational programs of the higher and postgraduate education.

Selective, unscheduled inspections and other forms of control are applied to the checked subjects (objects) carried to high risk;

2) the checked subjects (objects) conducting additional educational activities or exercising control of education concern to the group which is not carried to high risk.

Unscheduled inspections and other forms of control are applied to the checked subjects (objects) which are not carried to high risk.";

state Item 6 in the following edition:

"6. Results of monitoring of the reporting and the data represented by the checked subject including by means of the automated information systems are applied to determination of subjective criteria as source of information.";

state Item 10 in the following edition:

"10. Depending on possible risk and the importance of problem, singularity or systemacity of violation subjective criteria which correspond to extent of violation - rough, considerable and not considerable are determined.

At the same time extent of violation (rough, considerable, insignificant) is appropriated according to the established determinations of gross, considerable, insignificant violations.

Calculation of general exponent of risk is made by subjective criteria on scale from 0 to 100.";

state Items 15 and 16 in the following edition:

"15. For the organizations performing activities, assessment period used in Criteria - one academic year.

16. Lists of selective checks affirm the first head of authorized body as the field of education and go to authorized body on legal statistics and special accounting not later than fifteen calendar days prior to the beginning of the corresponding accounting period in time.";

to state appendix to Criteria for evaluation of risk degree behind education system in edition according to appendix 1 to this joint order;

2, of 3, of 4, of 5, of 6, of 7, of 8, 9 to the specified joint order to state appendices in edition according to appendices 2, of 3, of 4, of 5, of 6, of 7, of 8, 9 to this joint order;

to exclude appendix 10 to the specified joint order.

2. To committee on control in the field of science and education of the Ministry of Education and Science of the Republic of Kazakhstan (Eshenkulov T. I.) in the procedure established by the legislation to provide:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this joint order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this joint order the direction it the copy on official publication in periodic printing editions;

4) placement of this joint order on Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this joint order submission to Department of legal service and international cooperation of the Ministry of Education and Science of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this joint order on the supervising vice-Minister of Education and Science of the Republic of Kazakhstan.

4. This joint order becomes effective after ten calendar days after day of its first official publication.
