About organizational measures for further enhancement of activities of the Ministry of Justice of the Republic of Uzbekistan

According to the Presidential decree of the Republic of Uzbekistan of April 13, 2018 No. UP-5415 "About Measures for Radical Enhancement of Activities of Bodies and Organizations of Justice in Realization of the State Legal Policy":

1. Determine the main objectives of the Ministry of Justice of the Republic of Uzbekistan:

carrying out single state policy in the field of law-making;

coordination of activities for assessment of regulatory impact, and also to conducting anti-corruption examination of regulatory legal acts and their projects;

distribution of legal information and ensuring access to it;

implementation of legal promotion, and also coordination of work of state bodies and organizations in the field of legal promotion;

implementation of measures for ensuring consecutive and uniform law-enforcement practice in activities of republican executive bodies and their territorial subdivisions, public authorities on places, and also rendering the methodical help to these state bodies and self-government institutions of citizens in forming of single law-enforcement practice;

implementation of measures for legal protection of the rights, freedoms and legitimate interests of citizens;

carrying out studying by industries, regions and departments and conducting monitoring of the state of affairs on places on ensuring timely, complete and high-quality execution of acts of the legislation and orders, and also decisions of the Government;

implementation of the analysis and monitoring of system effectiveness of public administration on the basis of the best foreign practices and current trends of development;

coordination, control and methodical assistance of activities of legal services of state bodies and organizations, and also ensuring rendering legal services to the state bodies and organizations determined in acts of the legislation;

ensuring effective functioning of system of notariate, the legal profession and other structures performing legal servicing of physical persons and legal entities;

participation in development and implementation of measures for counteraction of legalization of income gained from criminal activities, financing of terrorism and financing of distribution of weapons of mass destruction;

carrying out state policy in the field of development of activities of non-state non-profit organizations, assistance in the organization of their interaction with state bodies and the organizations;

carrying out single state policy in the field of ministerial procedures;

carrying out single state policy in the field of rendering the state services to physical persons and legal entities;

enhancement of procedure for rendering the state services due to elimination of excessive ministerial procedures, and also development of interdepartmental electronic interaction;

control and efficiency evaluation of activities of state bodies and other organizations in the field of rendering the state services, including in implementation of the corresponding information systems, resources and databases;

development of single state policy in the field of intellectual property, and also protection of the rights to inventions, trademarks, copyright and the rights to other intellectual property items;

legal protection of inventions, useful models, industrial designs, trademarks and other intellectual property items;

the organization of preparation, retraining and advanced training of legal personnel, ensuring carrying out basic and applied researches in the field of law;

development of the priority directions of development of judicial and expert activities, coordination of work on preparation and advanced training of court experts;

carrying out the analysis of indicators of the Republic of Uzbekistan in the international ratings and indexes in the political and legal sphere;

adjustment and strengthening of international legal cooperation, conducting legal examination of international treaties;

providing legal protection of interests of the Republic of Uzbekistan in the international and foreign organizations;

coordination of the activities of state bodies and organizations connected with maintaining the Unified electronic register of mandatory requirements in the field of entrepreneurship;

carrying out single state policy in the field of archiving and clerical work, and also coordination of work of state bodies and organizations in this sphere;

carrying out single state policy in the field of personal data, and also control and coordination of activities of state bodies and organizations in the field of personal data.

2. Form:

a) ceased to be valid according to the Presidential decree of the Republic of Uzbekistan of 17.03.2022 No. UP-89

b) based on the Center of legal informatization and Adolat publishing house under the Ministry of Justice of the Republic of Uzbekistan:

The center of development of information and communication technologies in bodies and organizations of justice (further - TsRIKT) in the form of the state unitary enterprise;

National legal information center "Adolat" (further - the Adolat center) in the form of public institution.

Determine that activities of TsRIKT and the Adolat center are financed for the income account, received from sales of goods (works, services), means of off-budget fund of development of bodies and organizations of justice, other extrabudgetary funds of the Ministry of Justice of the Republic of Uzbekistan, and also other sources which are not prohibited by the legislation.

Permit bodies and organizations of justice to conclude with TsRIKT and the Adolat center service provision agreements (performance of works) without carrying out the tender (competitive) biddings.

3. Approve:

Regulations on the Ministry of Justice of the Republic of Uzbekistan according to appendix No. 1;

organizational structure of system of the Ministry of Justice of the Republic of Uzbekistan according to appendix No. 2.

4. Enter since May 1, 2018 procedure according to which:

drafts of the regulatory legal acts having important economic and social and political value as a rule are subject to placement of projects by the organizations developers on the Portal of discussion of drafts of regulatory legal acts (regulation.gov.uz) for carrying out public discussion;

drafts of regulatory legal acts are introduced to the Cabinet of Ministers, Administration of the President of the Republic of Uzbekistan only in the presence of the conclusion of the Ministry of Justice of the Republic of Uzbekistan about feasibility of their acceptance following the results of legal examination;

the compulsory provision of acceptance by public authorities on places of regulatory legal acts is availability of the positive conclusion of territorial authorities of justice following the results of legal examination;

legal examination of drafts of regulatory legal acts is performed by the Ministry of Justice of the Republic of Uzbekistan after their approval of the interested organizations, and also repeatedly - in case of change of their conceptual provisions in structural divisions of the Cabinet of Ministers and Administration of the President of the Republic of Uzbekistan;

the ministries and departments can adopt departmental regulatory legal acts if the laws, by decrees and resolutions of the President of the Republic of Uzbekistan, resolutions of the Cabinet of Ministers of the Republic of Uzbekistan to them confer powers on adoption of the relevant act or legal regulation of the specific public relations.

5. Determine what since January 1, 2019 in the territory of the Republic of Uzbekistan is terminated the departmental obligatory acts adopted till June 17, 1993 and unregistered in the Ministry of Justice of the Republic of Uzbekistan, including departmental acts of the former USSR.

To the Ministry of Justice of the Republic of Uzbekistan together with the interested ministries and departments in two-month time to introduce to the Cabinet of Ministers the draft of the actions plan on development of new regulatory legal acts, instead of stopping the action according to this Item.

6. Create the Public council under the Ministry of Justice of the Republic of Uzbekistan functioning as advisory advisory body on a voluntary basis which activities are aimed at the development of open dialogue with citizens, non-state non-profit organizations, other institutes of civil society.

To the Ministry of Justice of the Republic of Uzbekistan to approve structure of Public council and "road map" on implementation of actions, directed to effective implementation of the tasks assigned to it in a month.

7. Approve offers of the Ministry of Justice, the Ministry of the higher and secondary vocational education, the Ministry of Economics and the Prosecutor General's Office of the Republic of Uzbekistan about:

a) transformation of professional colleges and the academic lyceum according to appendix No. 9 in legal technical schools of the Ministry of Justice of the Republic of Uzbekistan (further - legal technical schools) with establishment of procedure, according to which:

coordination of educational and methodical process in legal technical schools, rendering practical and information and resource assistance to them are performed by the Tashkent state legal university (further - TGYuU), and management and control of their activities and strengthening of organizational and personnel base - territorial authorities of justice;

direct legal technical schools of the Republic of Karakalpakstan, areas and the city of Tashkent the director, with implementation by him of compensation and material stimulation at the expense of the Government budget and means of legal technical schools;

expenses on equipping of legal technical schools are performed by the necessary educational and sports equipment, the computer equipment and information and resource fund at the expense of the budgetary funds allocated for education and also extrabudgetary funds of the Ministry of Justice;

acceptance in legal technical schools is performed on the basis of the tests which are carried out by the Agency according to knowledge and qualifications under the Ministry of the higher education, science and innovations of the Republic of Uzbekistan, of quotas, specialties and to the professions determined by the Ministry of Justice of the Republic of Uzbekistan taking into account needs of each region for personnel of secondary vocational, professional education by the law direction;

since 2021/2022 academic years graduates of legal technical schools have the right to arrive in TGYuU in the directions of territorial authorities of justice without introductory tests by individual interview with training in the special three-year program of training of bachelors and adoption of obligations about continuous work within three years after the end of training according to distribution;

training of pupils of 3 rates of the transformed professional colleges and the academic lyceum comes to the end in these educational institutions with their inclusion in school enrollment of nearby professional colleges and the academic lyceum with the similar directions of training;

b) establishment of TGYuU of parameters of enrollment of students in TGYuU magistracy on paid and contractual basis, determination of specialties of magistracy taking into account the scientific and pedagogical capacity and opportunities of material and technical resources of university in coordination with the Ministry of Justice;

c) ceased to be valid according to the Presidential decree of the Republic of Uzbekistan of 29.04.2020 No. UP-5987

d) increase twice the size of the monthly allowances established at the expense of Special fund for material stimulation of managerial, professorial, scientific, educational and auxiliary, technical and service personnel of TGYuU;

e) ceased to be valid according to the Presidential decree of the Republic of Uzbekistan of 24.05.2024 No. UP-80
