About approval of Administrative regulations of rendering the state services in registration of key of the digital signature and issue of the certificate of key of the digital signature through the centers of the state services or official information resources online (remotely)

According to the Presidential decree of the Republic of Uzbekistan of December 12, 2017 No. UP-5278 "About Measures for Radical Reforming of National System of Rendering the State Services to the Population" and the resolution of the President of the Republic of Uzbekistan of April 11, 2018 No. PP-3662 "About additional measures for the accelerated development of system of rendering the state services", and also for the purpose of further enhancement of system of rendering the state services in issue to physical persons and legal entities of the certificate of the digital signature providing open entry to all types of service rendered by bodies of the public and economic board, public authorities on places and commercial banks the Cabinet of Ministers decides:

1. Approve administrative regulations of rendering the state services in registration of key of the digital signature and issue of the certificate of key of the digital signature through the centers of the state services or official information resources online (remotely).

2. To provide to the Ministry of Justice of the Republic of Uzbekistan and the State Tax Committee of the Republic of Uzbekistan together with Chamber of Commerce and Industry of the Republic of Uzbekistan system training of the workers in the procedures provided by the Administrative regulations approved by this resolution.

3. To the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

4. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan - the Minister of Finance of the Republic of Uzbekistan D. A. Kuchkarov, the Minister of Justice of the Republic of Uzbekistan R. K. Davletov and the chairman of the State Tax Committee of the Republic of Uzbekistan B. R. Parpiyev.

Administrative regulations of rendering the state services in registration of key of the digital signature and issue of the certificate of key of the digital signature through the centers of the state services or official information resources online (remotely)

Chapter 1. General provisions

1. These Administrative regulations determine procedure for rendering the state services in issue of the certificate of the digital signature providing open entry to all types of service rendered by bodies of the public and economic board, public authorities on places and commercial banks (further - the EDS) through the centers of the state services or official information resources online (remotely).

2. Registration of the EDS and issue of certificates of keys of the EDS through the centers of the state services or official information resources online (remotely) appears as the state service "Issue of the Certificate of the Digital Signature Providing Open Entry to All Types of Service Rendered by Bodies of the Public and Economic Board, Public Authorities on Places and Commercial Banks".

This state service is provided by Scientific information center of new technologies under the State Tax Committee of the Republic of Uzbekistan (further - authorized body) through the centers of the state services or official information resources online (remotely).

3. In these Administrative regulations the following basic concepts are applied:

The EDS - the signature in the electronic document received as a result of special transformations of information of the furnished electronic document with use of the closed clue of the EDS and allowing the EDS to establish by means of open key lack of misstatement of information in the electronic document and to identify the owner of the closed key of the digital signature;

the closed EDS key - the sequence of symbols received with use of means of the digital signature known only to the signing person and the EDS intended for creation in the electronic document;

open key of the EDS - the sequence of symbols received with use of means of the digital signature, corresponding to the closed EDS key available to any user of information system and the EDS intended for confirmation of authenticity in the electronic document;

the certificate of key of the EDS - the electronic document confirming compliance of open key of the EDS to the closed EDS key;

the password of the closed EDS key - the sequence of symbols intended for protection of use of the closed EDS key against illegal use from the third parties;

the owner of the closed EDS key - the physical person who created the EDS (signing the electronic document) and addressed to which the authorized body issues the certificate of key of the EDS;

management of the certificate of key of the EDS - suspension or renewal, or cancellation of action of the certificate of key of the EDS;

Official information resource is the official site of authorized body providing to physical persons and heads of legal entities opportunity to create and store the closed EDS key by the COMPUTER for registration of keys of the EDS and receipt of certificates of keys of the EDS.

4. Actions between centers of the state services and authorized body are performed by means of interdepartmental electronic interaction with use of the EDS.

5. For issue of the certificate of key of the EDS from legal entities and subjects of entrepreneurship without formation of legal entity collection in the amount of 10 percent, and is levied from physical persons in the amount of 7 percent from basic settlement size, except as specified, of the EDSs providing free issue of the certificate of key.

In case of issue of the certificate of key of the EDS to persons registered in the information system "Unified Register of Social Protection" and also to persons with disability of I and II groups, it is applied monastery in the amount of 50 percent from the amount specified in paragraph one of this Item.

Payment by legal entities of charges for issue of certificates of keys of the EDS can be performed as transfer from bank accounts, and by means of bank cards through operators of payment system in non-cash form. In this case receipt of each payment made through operators of payment system is checked and considered by the attached employees of the centers of the state services.

6. The amount of collection is distributed in the following procedure:

a) in case of the appeal to the Centers of the state services in attendance procedure or through official information resource:

20 percent are enlisted in Fund of development of the state services of the Ministry of Justice of the Republic of Uzbekistan;

the remained means completely are enlisted into the special account of authorized body;

b) in case of the address through EPIGU:

10 percent are enlisted in Fund of development of the state services of the Ministry of Justice of the Republic of Uzbekistan;

11, % - into the special account of Fund of development of information and communication technologies on financing of interdepartmental projects of the electronic government and digital economy;

the remained means completely are enlisted into the special account of authorized body.

7. Effective period of the certificate of key of the EDS shall not exceed 24 months from the moment of registration of the EDS.

At the same time the validity of the certificate of key of the EDS can be extended for the term of no more than two times.

Chapter 2. Procedure for issue of the certificate of key of the EDS

8. For registration of keys of the EDS and receipt of certificates of keys of the EDS physical persons and legal entities (further - applicants) address to the centers of the state services directly or in electronic form through the Single interactive portal of the state services of the Republic of Uzbekistan (further - the Single portal) or official information resource.

At the same time to address for registration of keys of the EDS and receipt of certificates of keys of the EDS through the Single portal or official information resource only heads of legal entities can. Other representatives of legal entities for receipt of keys of the EDS and their certificates have the right to address directly to the centers of the state services.

Receipt of the certificate of key of the EDS through the centers of the state services, the Single portal or official information resource is performed according to schemes according to appendices No. 1 and 1a to these Administrative regulations.

9. In case of the address in attendance procedure the employee of the Center of the state services fills in the questionnaire on behalf of the applicant.

In case of the appeal to the Centers of the state services in attendance procedure the questionnaire is confirmed by the applicant by means of dactyloscopy.

In case of the address through the Single portal or official information resource the applicant independently fills in the request for use of the state services in electronic form in form according to appendix No. 2 to these Administrative regulations and attaches the copy of the homepage of the passport (ID card) of the applicant with the copy of selfie photo. At the same time in the enclosed photo the image of face of the applicant shall be accurate, and all details of the homepage of the passport (ID card) readable.

The applicant pays the fee for receipt of the certificate of key of the EDS. In case of the address for receipt of the certificate of key of the EDS through the Single portal collection is levied in the amount of 90 percent from the amount specified in Item 5 of these Administrative regulations. Issue of certificates of keys of the EDS to pupils of the academic lyceums and professional colleges to pupils of graduation classes of comprehensive schools, and also the citizens staying on the registry in "Temir дафтар" "Ayollar of daftara" and "Yoshlar of daftara" is performed free of charge.

Confirmation of the carried-out payment of the certificate of key of the EDS is performed by means of information and communication systems.

If the owner of the closed key of the EDS is the representative of the legal entity (except for the head of the legal entity), in the questionnaire data on surname, name, middle name and post of the owner of the closed key and to the questionnaire are entered the letter (power of attorney) of the legal entity on issue of the certificate of key of the EDS is attached.

It is strictly forbidden demand from applicants of provision of the data and other documents which are not specified in this Item.

10. The center of the state services within twenty minutes after receipt of request for the certificate of key of the EDS sends the information containing in it confirmed to the EDS of the employee of the Center of the state services to information system of authorized body by means of electronic interdepartmental interaction.

In case of receipt of request for the certificate of key of the EDS through the Single portal or official information resource within one working day information confirmed to the EDS of the employee of the Center of the state services goes to information system of authorized body by means of electronic interdepartmental interaction.

At the same time the employee of the Center of the state services for identification of the applicant before sending request to authorized body:

checks accessory of the subscriber mobile number of the applicant specified in the request through system of interdepartmental data exchange;

verifies authenticity of the passport (ID card) according to the copy of the homepage of the passport (ID card) of the applicant and selfie photo through system of interdepartmental data exchange;

by means of INN of the applicant compares data of information system of authorized body with data in the statement through system of interdepartmental data exchange.

11. The information system of authorized body after consideration of data, the state services provided by the centers, draws up certificates of keys of the EDS in real time or the reasonable refusal in receipt of the certificate of key of the EDS is issued.

12. Following the results of consideration of the questionnaire in information system of authorized body the certificate of key of the EDS in electronic form goes to the applicant through the Single portal or official information resource and to the centers of the state services by means of electronic interdepartmental interaction.

13. The password of the closed key of the EDS goes authorized body to number of the mobile phone of the applicant specified in the questionnaire in the form of the SMS message. In case of the attendance appeal of the applicant to the centers of the state services number of the mobile phone specified in the questionnaire can be changed, and the password sent to the specified number can be resent.

14. For receipt of the certificate of key of the EDS the applicant provides to the employee of the Center of the state services the removable carrier of data for record and storage of the certificate of key of the EDS in electronic form.

In case of receipt of the certificate of key of the EDS through the Single portal or official information resource the owner of the closed key of the EDS loads the certificate of key of the EDS and its copy in the form of the approved electronic document in the Single portal or system of official information resources.

15. The employee of the Center of the state services in case of issue to the owner of key of the EDS of the certificate of key of the EDS or the closed key of the EDS performs the following actions:

proves the applicant's identity based on the supporting document (the passport, the military ID, the car driver license or other identity document) provided to them;

records the file of the registered key of the EDS and the certificate of key of the EDS in electronic form with the removable carrier of data provided by the applicant and checks record of the file;

in case of the requirement of applicants of provision of the certificate of key of the EDS in paper form, the certificate is printed out in duplicate, each of which is signed by the employee of the Center of the state services, and one copy is issued to the owner of the closed EDS key.

16. In case of issue of the certificate of key of the EDS to the owner of the closed EDS key to the employee of the Center of the state services it is forbidden to make changes, to copy, delete, keep to itself data from the removable carrier of data.

17. The bases for refusal in issue of the certificate of key of the EDS from authorized body are:

a) in case of the attendance appeal to the centers of the state services:

availability in the questionnaire provided by the applicant, the doubtful or distorted data;

failure to pay collection for issue of the certificate of key of the EDS, except as specified, providing free procedure for acquisition of certificates of keys of the EDS;

representation by the applicant of the documents which are not meeting the qualifying standards;

b) in case of giving in electronic form through the Single portal or official information resource:

in case of not confirmation of the identity of the applicant;

availability in the questionnaire provided by the applicant, the doubtful or distorted data (including not accessory to the applicant of the mobile subscriber number specified in the questionnaire);

failure to pay collection for issue of the certificate of key of the EDS;

representation by the applicant of the documents which are not meeting the qualifying standards.

The refusal in issue of the certificate of key of the EDS on other bases, including based on inexpediency, is not allowed.

18. The authorized body sends the notification with indication of the specific bases of refusal in issue of the certificate of key of the EDS to the Center of the state services. If the questionnaire of the applicant arrived in authorized body through EPIGU or official information resource, that notification on refusal in issue of the certificate of key of the EDS goes to the applicant by means of EPIGU or official information resource automatically.

19. The center of the state services within twenty minutes notifies the applicant on receipt of the notification on refusal in issue of the certificate of key of the EDS from authorized body.

20. In case of elimination by the applicant of the reasons which formed the basis for refusal in issue of the certificate of key of the EDS, de novo review of the questionnaire about issue of the certificate of key of the EDS through the centers of the state services is performed according to the procedure, provided by Items 10 - the 15th these Administrative regulations.

In case of de novo review of the questionnaire about issue of the certificate of key of the EDS reduction from the representative is not allowed body of the causes of failure which are earlier not stated in the notification on refusal. For the repeated address collection is not levied.

In case of the address through the Single portal or official information resource, in case of elimination by the applicant of causes of failure in issue of the certificate of key of the EDS, de novo review of the request is performed by the direct appeal to the Center of the state services according to Items 10 - the 15th these Administrative regulations.

21. The applicant has the right to appeal the notification on refusal in issue of the certificate of key of the EDS or action (failure to act) of the official of authorized body according to the procedure, stipulated by the legislation.

Chapter 3. Management of the certificate of key of the EDS

22. For the purpose of implementation of management of the certificate of key of the EDS in case of the attendance appeal to the Center of the state services in electronic form the questionnaire in form according to appendix No. 2 to these Administrative regulations is filled in.

Control of the certificate of key of the EDS is exercised free of charge.

23. If the owner of the closed key of the EDS is the representative of the legal entity, together with the questionnaire about management of the certificate of key of the EDS the letter (power of attorney) of the legal entity on management of the certificate of key of the EDS, with indication of surname is provided, to name, middle name and post of the owner of the closed EDS key.

If the applicant is the owner of the closed EDS key, for management of the certificate of key of the EDS the letter (power of attorney) of the legal entity is not required.

24. In case of adoption of the questionnaire about management of the certificate of key of the EDS the employee of the Center of the state services proves the identity of the owner of the closed EDS key based on the provided identity documents (the passport, the military ID, the car driver license or other identity document).

If for management of the certificate of key of the EDS the power of attorney, that identification of the owner of the closed key of the EDS is provided it is not required.

25. The center of the state services within twenty minutes after receipt of the questionnaire about management of the certificate of key of the EDS sends it to authorized body.

26. The authorized body considers the questionnaire about management of the certificate of key of the EDS in real time and performs the actions specified in the questionnaire with the certificate of key of the EDS.

27. By results of consideration of the questionnaire about management of the certificate of key of the EDS the authorized body sends to the Center of the state services of the data on the actions made with the certificate of key the EDS in electronic form.

28. The center of the state services within twenty minutes from the moment of receipt of data on the actions made with the certificate of key of the EDS notifies on it the applicant.

Chapter 4. Registration and issue of certificates, and also management of the issued certificates of keys of the EDS by employees of the centers of the state services.

29. The authorized body based on letters of the Ministry of Justice of the Republic of Karakalpakstan, justice departments of areas and the city of Tashkent carries out registration of keys of the EDS of employees of territorial administrations, issues it certificates and manages the issued certificates free of charge.

30. The Ministry of Justice of the Republic of Karakalpakstan, justice department of areas and city of Tashkent by means of the EDS keys registered by authorized body for the purpose of implementation of the actions provided by these Administrative regulations carry out registration of keys of the EDS, issue certificates and manage the issued certificates of keys of the EDS of employees of the centers of the state services.

Chapter 5. Final provisions

31. In case of issue of certificates of keys of the EDS in paper form, the authorized body quarterly to the 25th following reporting performs acceptance at the centers of the state services of certificates of keys of the EDS for storage electronically according to the register according to appendix No. 3 to these Administrative regulations.

32. Persons guilty of violation of requirements of these Administrative regulations bear responsibility in the procedure established by the legislation.
