1. 1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on the Internet - resource of the Ministry of Internal Affairs of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of the order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan and the Investigative department of the Ministry of Internal Affairs of the Republic of Kazakhstan (Amirov M. S.).

4. This order becomes effective after ten calendar days after day of its first official publication.

Instruction on the organization of activities of divisions of the investigation, inquiry and military and investigative divisions of law-enforcement bodies of the Republic of Kazakhstan

Chapter 1. General provisions

1. This Instruction on the organization of activities of divisions of the investigation, inquiry and military and investigative divisions on the criminal offenses carried to competence of law-enforcement bodies (further - Department of Internal Affairs) is developed according to the Criminal Code of Kazakhstan of July 3, 2014 (further - UK), the Code of penal procedure of the Republic of Kazakhstan of July 4, 2014 (further - the Code of Criminal Procedure), the Law of the Republic of Kazakhstan "About law-enforcement bodies of the Republic of Kazakhstan" of April 23, 2014 (further - the Law), other regulatory legal acts and disaggregates procedure for activities of divisions of the investigation, inquiry and military and investigative divisions of Department of Internal Affairs.

2. The system of divisions of the investigation, inquiry and military and investigative divisions is formed: Investigative department (further - SD) in central office of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - the Ministry of Internal Affairs) and territorial Department of Internal Affairs in which managements (regional governments), departments, departments, groups are formed.

3. Within competence of division of the investigation, inquiry and military and investigative divisions perform functions of criminal prosecution.

4. Exercises departmental control of investigation of criminal cases:

in central office and territorial Department of Internal Affairs - the deputy minister of internal affairs supervising the investigation, the chief of SD and its deputies, chiefs of managements of SD and their deputies;

in Departments of internal affairs of areas, cities of republican value of Astana, Almaty, and on transport (further - DVD(T), city and district managements (departments), linear Departments of Internal Affairs (further - gorraylinorgana) - the deputy chief of DVD(T) supervising the investigation, heads of department, department, departments and their deputies;

in divisions of own safety - the deputy chief of DVD(T) supervising the investigation;

in Regional military investigation departments (further - RVSU), in departments and groups (further - departments) - chiefs of RVSU and their deputies.

Chapter 2. Organization of activities of Investigative department

5. Activities of SD will be organized by the zone and subject principle on the basis of operating and strategic plans of work, in close interaction with other services of the Ministry of Internal Affairs.

6. SD is headed by the chief appointed to position and dismissed according to the procedure, established by the legislation of the Republic of Kazakhstan.

The chief of SD has the deputies appointed to positions and dismissed according to the legislation of the Republic of Kazakhstan.
