About introduction of amendments to some acts of the Government of the Russian Federation in connection with prolongation of features of functioning wholesale and the retail markets in the territories of separate parts of price zones of the wholesale market

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation in connection with prolongation of features of functioning wholesale and the retail markets in the territories of separate parts of price zones of the wholesale market.

2. To executive bodies of subjects of the Russian Federation in the field of state regulation of the rates specified in appendix No. 3 to the Rules of the wholesale market of electrical energy and capacity approved by the order of the Government of the Russian Federation of December 27, 2010 No. 1172 "About approval of Rules of the wholesale market of electrical energy and capacity and about introduction of amendments to some acts of the Government of the Russian Federation concerning the organization of functioning of the wholesale market of electrical energy and capacity" (further - Rules of the wholesale market of electrical energy and capacity), except for executive bodies of subjects of the Russian Federation in the field of state regulation of rates of the Republic of Buryatia and Republic of Karelia, in coordination with Federal Antimonopoly Service till June 25, 2018 in case of the appeal of the territorial network organization:

extend the validity of the long-term period of regulation till December 31, 2027 taking into account provisions of Item 38.1 of Bases of pricing in the field of state regulation of the prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry" (further - pricing Bases);

review long-term parameters of regulation of activities of the territorial network organizations regarding basic level of under control expenses, the wastage rate of electrical energy by its transfer on power networks of the territorial network organizations which regulation of activities is performed by method of long-term indexation of necessary gross revenue taking into account provisions of Item 38.1 of Bases of pricing;

review long-term parameters of regulation of activities of the territorial network organizations regarding basic level of operating expenses, rates of return of the invested capital, the wastage rate of electrical energy by its transfer on power networks of the territorial network organizations which regulation of activities is performed by income method of the invested capital taking into account provisions of Item 38.1 of Bases of pricing.

3. Approval of prolongation and the reviews specified in Item 2 of this resolution is performed on the basis of investing programs of the territorial network organizations approved in the procedure established by the legislation of the Russian Federation on power industry. If the period of realization of the approved investing program of the territorial network organization does not correspond to the prolongable long-term period of regulation, for the years following after year of the end of realization of the approved investing program of the network organization, the amounts of financing at the expense of tariff sources are accepted at the level of the amount of financing at the expense of tariff sources provided by the specified investing program in the last year of the period of its realization.

4. To executive bodies of subjects of the Russian Federation in the field of state regulation of the rates specified in appendix No. 3 to Rules of the wholesale market of electrical energy and capacity, except for executive bodies of subjects of the Russian Federation in the field of state regulation of rates of the Republic of Buryatia and Republic of Karelia till June 30, 2018 to make decisions on establishment (review) since July 1, 2018 taking into account Item 5 of this resolution and Item 38.1 of Bases of pricing:

a) single (boiler) tariffs for services in transfer of electrical energy for the consumers who are not belonging to the population and the categories of consumers equated to it;

b) the individual prices (rates) for services in transfer of electrical energy for settlement between two network organizations for the services in transfer of electrical energy rendered each other;

c) sales allowances of the guaranteeing suppliers.

5. To Federal Antimonopoly Service till June 25, 2018 according to the changes approved by this resolution to review:

the composite balance estimation of production and deliveries of electrical energy (capacity) within Power pool system of Russia on subjects of the Russian Federation;

limits of rates for the services in transfer of electrical energy rendered to the consumers who are not belonging to the population and the categories of consumers equated to it in the territories of price zones of the wholesale market for which features of functioning of the wholesale and retail markets specified in appendix No. 3 to Rules of the wholesale market of electrical energy and capacity, except for the territories of the Republic of Buryatia and Republic of Karelia are established.

6. Determine that:

for the period from July 1, 2018 before date, stipulated in Item 6th article 36 of the Federal law "About Power Industry", in the territories of price zones of the wholesale market for which features of functioning of the wholesale and retail markets specified in appendix No. 3 to Rules of the wholesale market of electrical energy and capacity are established rate on content of power networks and rate on payment of losses of electrical energy of single (boiler) tariffs for services in transfer of electrical energy and their limits are established on the first half of the year of the corresponding period of regulation at the level not below the corresponding rates and their limits operating as of December 31 of preceding period of regulation.

7. Determine that:

The Ministry of Energy of the Russian Federation, Federal Antimonopoly Service, and also the Ministry of Economic Development of the Russian Federation (concerning the subjects of the Russian Federation which are part of the North Caucasian Federal District) are the federal executive bodies authorized by the Government of the Russian Federation on the conclusion of the agreements specified in the subitem "an" of Item 72.1 of Rules of the wholesale market of electrical energy and capacity;
