I ORDER:
1. Bring in the order of the Minister of Education and Science of the Republic of Kazakhstan of January 27, 2016 No. 83 "About approval of Rules and conditions of carrying out certification of the pedagogical workers and persons equated to them holding positions in the organizations of education realizing general education training programs of preschool, initial, main average, general average, educational programs of technical and professional, postsecondary education and other civil servants in the field of science and education" (it is registered in the Register of state registration of regulatory legal acts at No. 13317, it is published in the Information system of law of Ad_let on March 11, 2016) the following changes:
to state heading of the order in the following edition:
"About the approval of Rules and conditions of carrying out certification of the pedagogical workers and persons equated to them holding positions in the organizations of education, realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary, additional education both special training programs, and other civil servants in the fields of education and sciences";
state Item 1 in the following edition:
"1. Approve the enclosed Rules and conditions of carrying out certification of the pedagogical workers and persons equated to them holding positions in the organizations of education, realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary, additional education both special training programs, and other civil servants in the fields of education and sciences.";
Rules and conditions of carrying out certification of the pedagogical workers and persons equated to them holding positions in the organizations of education realizing general education training programs of preschool, initial, main average, general average, educational programs of technical and professional, postsecondary education and other civil servants in the field of science and education approved by the specified order to state in edition according to appendix to this order.
2. To department of preschool and secondary education of the Ministry of Education and Science of the Republic of Kazakhstan (Karinova Sh. T.) in the procedure established by the legislation of the Republic of Kazakhstan to provide:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) placement of this order on Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan after its official publication;
4) within ten working days after state registration of this order submission to Department of legal service and international cooperation of the Ministry of Education and Science of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.
3. To impose control of execution of this order on the vice-Minister of Education and Science of the Republic of Kazakhstan Aymagambetov A. K.
4. This order becomes effective from the date of its first official publication.

1. These rules and conditions of carrying out certification of the pedagogical workers and persons equated to them holding positions in the organizations of education, realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary, additional education both special training programs, and other civil servants in the fields of education and sciences (further - Rules) are developed according to Item 7 of Article 139 of the Labor code of the Republic of Kazakhstan of November 23, 2015, the Law of the Republic of Kazakhstan of July 27, 2007 "About education" (further - the Law) and determine procedure and conditions of carrying out certification of the pedagogical workers and persons equated to them holding positions in the organizations of education realizing general education training programs of preschool education and training, initial the main secondary and general secondary education, educational programs of technical and professional, postsecondary, additional education both special training programs, and other civil servants in the fields of education and sciences.
In these rules the following main terms and determinations are applied:
1) the republican commission on consideration of appeals (further - the republican appeal commission) and the appeal commission in Item of conducting testing - the commissions created by authorized body of education and local executive body of formation of area which make the decision according to matters of argument in case of disagreement of pedagogical workers and persons equated to them with results of national qualification testing;
2) the certification period - the period between certifications;
3) certifying commission - collegiate organ, authorized to carry out the procedure of certification;
4) qualification category - the level of professional competence of pedagogical workers and persons equated to them conforming to the qualification requirements determined by these rules;
5) qualification testing - the procedure directed to determination of level of professional competence of the pedagogical workers and persons equated to them holding positions in the organizations of education realizing general education training programs of preschool education and training, educational programs of technical and professional, postsecondary, additional education, for the tests developed by authorized body in the field of education;
Qualification testing of pedagogical workers will be organized and carried out by the organization determined by authorized body in the field of education.
6) the next certification - periodically performed procedure for assignment (confirmation) of qualification category of pedagogical workers and persons equated to them after each five years;
7) complex analytical generalization of results of activities - system, consecutive and objective studying of professional competence of pedagogical workers and persons equated to them on the basis of the following indicators: quality of knowledge, skills, achievements of studying (pupils), quality of teaching (education and training) and professional achievements for the certification period;
8) early certification - the procedure which is carried out based on the statement of the pedagogical worker or person equated to it applying for assignment of qualification category before the term of the next certification;
9) the subject Olympic Games, creative, professional tenders, scientific, sports competitions - the actions entering the list approved by authorized body in the field of education.
10) pedagogical workers and persons equated to them are persons holding the positions specified in the list of positions of pedagogical workers and persons equated to them, No. 77 approved by the order of the Government of the Republic of Kazakhstan of January 30, 2008 "About approval of Standard states of employees of the state organizations of education and the list of positions of pedagogical workers and persons equated to them";
11) certification of pedagogical workers and persons equated to them - the procedure for consecutive actions for assignment (confirmation) of qualification category determining the professional competences of pedagogical workers and persons equated to them necessary for accomplishment of professional activity;
12) advanced training of pedagogical workers and persons equated to them - the training allowing to acquire new, and also to support, expand, deepen and enhance earlier acquired professional knowledge, abilities, skills and competences for improvement of quality of teaching and training according to the procedure, the determined authorized body in the field of education;
13) portfolio of the pedagogical worker and person equated to it - materials of complex analytical generalization of results of activities;
14) advisory council - the working body which carries out and prepares the conclusion on complex analytical generalization of results of activities of pedagogical workers and persons equated to them for consideration of certifying commission;
15) CEFR (Common European Frameworkof Reference, the all-European competences of foreign language skills) (Kommon Europian Freymvork Of Referens) - the international standard used for the description of level of knowledge of language;
16) national qualification testing - the procedure directed to determination of level of professional competence of the pedagogical workers and persons equated to them holding positions in the organizations of education realizing general education training programs of primary, main secondary and general secondary education and training programs of vocational education for the tests developed by the organization determined by authorized body in the field of education.
National qualification testing of pedagogical workers will be organized and carried out by the organization determined by authorized body in the field of education.
2. For carrying out certification of pedagogical workers and persons equated to them certifying commissions of appropriate levels are created: in the organizations of education, district (city) departments of education, departments of education of areas, cities of Astana and Almaty, in authorized body in the field of education (for the republican subordinated organizations), in authorized bodies of the corresponding industry.
The structure of certifying commission affirms the order of the head of the organization of education, city/district formation of departments, departments of education, state body.
3. The certifying commission consists of the odd number of members. The chairman, the vice-chairman of certifying commission are elected from among members of the commission. The secretary is not member of certifying commission.
4. Experienced teachers, methodologists, representatives of scientific and pedagogical councils, educational and methodical associations, institutes of advanced training, public and non-governmental organizations, labor unions, specialists of governing bodies of education, personnel services, representatives of production associations, National chamber of entrepreneurs of the Republic of Kazakhstan of Atameken are part of certifying commission (further - NPP RK "Atameken) (for technical and professional, postsecondary education).
Certification of pedagogical workers and persons of the organizations of formation of industry state bodies equated to them is performed by certifying commissions of the organizations of education and the relevant state bodies.
In the absence of qualified specialists in relevant organs the head of the organization of education addresses with the petition for certification of pedagogical workers and persons equated to them to governing body of education.
5. Certification of the pedagogical workers and persons equated to them holding positions in the organizations of education and realizing general education training programs of preschool education and training, educational programs of technical and professional, postsecondary, additional education (further - certified) is subdivided on next or early.
6. Pedagogical workers and persons equated to them undergo certification according to the subitem 6) of Item 3 of article 51 of the Law at least once in five years.
7. The certifications certified for passing (next and early) next academic year submit the application to certifying commission of the organization of education in form according to appendix 1 to these rules till May 25 of the current year.
8. The payroll of certified affirms the decision of collegiate organ of the organization of education annually till June 10 and it is represented in district (city) departments of education, department of education of areas, cities of Astana and Almaty, authorized body in the field of education (for the republican subordinated organizations).
9. The next certification of the qualification categories certified on assignment (confirmation) is performed in one stage by complex analytical generalization of results of activities of the pedagogical worker.
10. Early certification for the purpose of increase in the qualification categories certified is carried out according to the subitem 7) of Item 2 of article 51 of the Law based on the statement:
1) on the second qualification category:
persons which ended average professional (technical and professional, postaverage), higher educational institution with "difference" and having years of service of pedagogical activities at least one year;
