About introduction of amendments to some orders of the Minister of Agriculture of the Republic of Kazakhstan

I ORDER:

1. Bring the following changes in some orders of the Minister of Agriculture of the Republic of Kazakhstan:

1) in the order of the Minister of Agriculture of the Republic of Kazakhstan of November 26, 2014 No. 3-2/615 "About approval of Rules of subsidizing of costs of processing enterprises for purchase of agricultural products for production of products of its deep conversion" (it is registered in the Register of state registration of regulatory legal acts No. 10087, it is published on January 26, 2015 in information system of law of Ad_let):

The rules of subsidizing of costs of processing enterprises for purchase of agricultural products for production of products of its deep conversion approved by the specified order to be reworded as follows according to appendix 1 to this order;

2) in the order of the Minister of Agriculture of the Republic of Kazakhstan of April 28, 2015 No. 3-2/378 "About approval of standards of the state services in the field of livestock production" (it is registered in the Register of state registration of regulatory legal acts No. 11284, it is published on June 24, 2015 in information system of law of Ad_let):

to be reworded as follows the standard of the state service "Subsidizing of Costs of Processing Enterprises for Purchase of Agricultural Products for Production of Products of Its Deep Conversion" approved by the specified order according to appendix 2 to this order.

2. To provide to department of conversion and markets of agricultural products of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Agriculture of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after day of its first official publication.

Rules of subsidizing of costs of processing enterprises for purchase of agricultural products for production of products of its deep conversion

Chapter 1. General provisions

1. These rules of subsidizing of costs of processing enterprises for purchase of agricultural products (further - Rules) are developed for production of products of its deep conversion according to the subitem 10) of Item 1 of article 6 of the Law of the Republic of Kazakhstan of July 8, 2005 "About state regulation of development of agro-industrial complex and the rural territories" and determine procedure for subsidizing of costs of processing enterprises for purchase of agricultural products for production of products of its deep conversion (further - subsidies) for the account and within the means provided in the local budget for the corresponding financial year.

2. In these rules the following basic concepts are used:

1) The Government for Citizens State corporation (further - the State corporation) - the legal entity created according to the decision of the Government of the Republic of Kazakhstan for rendering the state services according to the legislation of the Republic of Kazakhstan, the organization of work on reception of applications on rendering the state services and issue of their results to uslugopoluchatel by the principle of "one window", and also ensuring rendering the state services electronically;

2) the guaranteed purchase price - the price at which the purchase of agricultural products at agricultural producers is performed, established taking into account cost and profitability;

3) purchase price - the price which processing enterprises can offer for agricultural products for production of competitive products.

Chapter 2. Procedure for subsidizing of costs of processing enterprises for purchase of agricultural products for production of products of its deep conversion

3. Subsidies are paid to the processing enterprises which incurred purchase costs of agricultural products at agricultural producers, agricultural cooperatives and procurement organizations and individual entrepreneurs.

4. Costs of processing enterprises for purchase of agricultural products for production of products of its deep conversion, according to the list of agricultural products according to which are established the guaranteed purchase price and purchase price, to No. 486 approved by the order of the Government of the Republic of Kazakhstan of May 13, 2014 (further - the list of products) are subject to subsidizing.

5. Subsidizing of costs of processing enterprises for purchase of agricultural products for production of products of its deep conversion assumes compensation of difference between the guaranteed purchase price and purchase price.

6. Subsidies are paid to processing enterprises for unit of the made products, according to the list of products, taking into account conversion factors of end product in initial, according to appendix 1 to these rules and standard rates of subsidies per unit of the purchased agricultural products in the directions, according to the list of products (further - the standard rate of subsidies), the approved resolution of akimat of area, the cities of Astana and Almaty.

7. Standard rates of subsidies are in duplicate provided for consideration in the Ministry of Agriculture of the Republic of Kazakhstan (further - the Ministry) by the cover letter signed by the akim of area, the cities of Astana and Almaty, in case of its absence person fulfilling its duties after approval of standard rates of subsidies of the scientific organizations of agrarian profile having accreditation in the field of scientific or scientific and technical activities of appendix of reasons according to each standard rate of subsidies.

The term of consideration by the Ministry of standard rates of subsidies constitutes seven working days from the date of receipt of the letter.

In case of positive result the Ministry returns the corresponding cover letter one copy of standard rates of subsidies.

In case of negative result the Ministry returns both copies of standard rates of subsidies the letter with motivated refusal in consideration. At the same time modifed standard rates of subsidies for de novo review go to the Ministry within seven working days.

Standard rates of subsidies affirm the resolution of akimat of area, the cities of Astana and Almaty.

Modification and (or) amendments in standard rates of subsidies is performed according to the procedure, provided by parts one, the second, the third, fourth and fifth this Item.
