About modification of the Procedure for maintaining databank about the orphan children, children deprived of parent guardianship and families of potential adoptive parents, guardians, custodians, adoptive parents, parents tutors

According to part three of article 11 of the Law of Ukraine "About providing the rights and freedoms of internally displaced persons", to Articles 13, 14 Laws of Ukraine "About providing organization-legal conditions of social protection of the orphan children and children deprived of parent guardianship" for the purpose of settlement and enhancement of conducting single electronic accounting of orphan children, the children deprived of parent guardianship, the children who appeared in difficult vital circumstances, order:

1. Approve Changes in the Procedure for maintaining databank about the orphan children, children deprived of parent guardianship, and families of potential adoptive parents, guardians, custodians, adoptive parents, parents tutors, No. approved by the order of the Ministry of social policy of Ukraine of December 28, 2015 1256, registered in the Ministry of Justice of Ukraine on March 12, 2016 for No. 380/28510, which are applied.

2. And adoptions (P.C. Sausage) to provide to department of protection of the rights of children submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication.

4. To impose control of execution of this order on the deputy minister concerning the European integration Churkina A. I.

Changes in the Procedure for maintaining databank about the orphan children, children deprived of parent guardianship and families of potential adoptive parents, guardians, custodians, adoptive parents, parents tutors

1. In the Section I:

1) in Item 5:

the fifth to state the paragraph in the following edition:

"At the local level - the specialist of service for children of district, district public administration, executive body in the cities of Kiev and Sevastopol of city, district council in the city, the integrated territorial community (in case of education);";

the ninth to state the paragraph in the following edition:

"Local level - service for children of district, district public administration, executive body in the cities of Kiev and Sevastopol of city, district council in the city, the integrated territorial community (in case of education);";

Item 6 to state 2) in the following edition:

"6. The owner of bases of personal data about the orphan children and children deprived of parent guardianship, and families of potential adoptive parents, guardians, custodians, adoptive parents, parents tutors is the Ministry.";

To add 3) with new Item 7 of the following content:

"7. Manager of bases of personal data about the orphan children and children deprived of parent guardianship, and families of potential adoptive parents, guardians, custodians, adoptive parents, parents tutors is the state company "Data Processing Center of the Ministry of Social Policy of Ukraine.

2. In the Section III:

1) in Item 1:

add with the new subitem of 1 following content:

"1) before creation of new electronic accounting and statistical card of the child the user checks availability of electronic accounting and statistical card of the child in the Databank;".

With respect thereto to consider subitems 1-5 respectively subitems 2-6;

add with subitems 7, 8 following contents:

"7) if necessary from electronic accounting and statistical card of the child the statement in the form established in appendix to this Procedure for confirmation of the status of the orphan child, the child deprived of parent guardianship in the form established according to this order is created;

8) the statement is created by service for children in the place primary or in the place of regional accounting of the orphan child, the child deprived of parent guardianship, or the Ministry based on the written address of the orphan child, the child deprived of parent guardianship, his legal representative or person from among orphan children, children deprived of parent guardianship, on condition of production of documents, confirming the personality.";

2) in Item 2:

State subitem 4 in the following edition:

"4) the information about the child whose parents agreed to adoption and not having the status of the child deprived of parent guardianship is introduced in the Databank based on the statement of parents for provision of their written consent to adoption of the child assured by the notary. In day of capture of the child on local accounting the service for children constitutes electronic accounting and statistical card of the child in the Databank;";

State subitem 9 in the following edition:

"9) in case of stay of the child on local accounting around conducting anti-terrorist operation and impossibility of the direction of the questionnaire in service for children of the regional level for statement on regional accounting (about what the relevant statement is drawn up), such service for children prints three copies of the questionnaire from the Databank and in the absence of the bases specified in Item 12 of the Procedure of activities for adoption and implementation of the supervision of observance of the rights of the adopted children approved by the resolution of the Cabinet of Ministers of Ukraine of October 8, 2008 No. 905, sends the questionnaire to the Ministry;";

state subitem 12 in the following edition:

"12) the user of the Databank enters information on issue of the direction for acquaintance to the child only in case of the termination of effective period of earlier issued direction for acquaintance to the child. The message on issue to candidates for adoptive parents of the direction for acquaintance to the child goes through the Single Children information and analytical system within a day to service for children at the place of residence (stay) of the child and service for children in the place of its accounting. In case of the termination of functioning of the Databank the service for children or the Ministry informs on issue of the direction service for children in the place of stay of the child on local, regional and centralized accounting;";

15, 16 to state subitems in the following edition:

"15) if in the Databank at the regional level there is no information on the orphan child, the child deprived of parent guardianship, staying on the registry on adoption which satisfies the candidate's request, the service for children recommends to it orally, in writing or the e-mail to address to the Ministry;

16) in case of the termination of functioning of the Databank the direction for acquaintance to the child is printed in the form given in appendix 7 to the Procedure of activities for the adoption and implementation of supervision of the adopted children approved by the resolution of the Cabinet of Ministers of Ukraine of October 08, 2008 No. 905. In day of recovery of functioning of the Databank the user enters in him information on issue of the direction for acquaintance to the child;".

3. In the Section V:

Item 6 to add 1) with the paragraph of the following content:

"If the Databank does not function also service for children in the place of accounting of candidates for adoptive parents, guardians, custodians, adoptive parents, parents tutors has no opportunity to enter information on the candidate for the Databank, the service for children in the place of accounting of the candidate issues to such candidate the reference with explanation of the reason of not entering of information on him into the Databank with reference to the message specified in Item 3 of the Section II of this Procedure. In day of recovery of functioning of the Databank the user of local level enters the relevant information in the Databank what he notifies orally or on demand in writing candidates for adoptive parents, guardians, custodians, adoptive parents, parents tutors on.";

Item 7 to state 2) in the following edition:

"7. The service for children shall inform of confidential information on the orphan children, children deprived of parent guardianship who can be adopted and are on local, regional accounting in service for children, only those candidates for adoptive parents, information on whom is entered in databank or to which the reference specified in Item 6 of these rules is issued.";

Item 9 to state 3) in the following edition:

"9. Confidential information on children who can be adopted is provided by service for children in the place of accounting of candidates according to the procedure of their priority. During direction effective period for acquaintance to the child the candidates for adoptive parents following in queue cannot study information on the child.";

Item 10 to add 4) with the new paragraph of the following content:

"In case of the termination of functioning of the Databank candidates for adoptive parents get acquainted with information on the child provided on papers taking into account the specified information obtained by the Ministry of Education and Science, youth and sport of the Autonomous Republic of Crimea, service for children of the regional, Kiev and Sevastopol city public administrations or the Ministry. In day of recovery of functioning of the Databank the user of local level enters in it the relevant information on issue of the direction and results of acquaintance with the child.".

4. To add Item 1 of the Section VI after paragraph one with the new paragraph the second the following content:

"Adoptions of the child;".

With respect thereto to consider paragraphs of the second or sixth respectively paragraphs the third or seventh.

5. Add the Procedure with new appendix of the following content:

"Appendix

to the Procedure for maintaining databank about the orphan children, children deprived of parent guardianship and families of potential adoptive parents, guardians, custodians, adoptive parents, parents tutors (subitem 7 of Item 1 of the Section III)
