About modification and amendments in some Laws of the Republic of Belarus

Article 1. Bring in the Law of the Republic of Belarus of November 3, 1992 "About defense" in edition of the Law of the Republic of Belarus of July 17, 2002 (Vyarkho¸naga Savet's Vedamasts_ of Respubl_k_ Belarus, 1992, No. 28, Art. 493; National register of legal acts of the Republic of Belarus, 2002, No. 84, 2/878; 2009, No. 16, 2/1560; 2010, No. 15, 2/1666; 2012, No. 2, 2/1880; National legal Internet portal of the Republic of Belarus, 11.01. 2015, 2/2231) following changes and amendments:

1. To exclude from preamble of the word "and organization".

2. In Article 1:

in the paragraph the second the word of "state" shall be replaced with words Republic of Belarus;

the third and fourth to exclude paragraphs;

the fifth or eleventh to consider paragraphs respectively paragraphs the third or ninth;

word in paragraph three of "other national interests with use of forces and instruments of war" shall be replaced with words "the constitutional system of the Republic of Belarus using the military force (instruments of war)";

in paragraph four of the word "and territorial integrity" shall be replaced with words ", territorial integrity and the constitutional system";

to exclude the paragraph of the eighth;

the ninth to consider the paragraph the paragraph the eighth;

to state the paragraph of the eighth in the following edition:

3. Add Article 2 with part five of the following content:

6. In Article 6 part two:

in the paragraph the second:

after words of "military policy" to add the paragraph with the words "Republic of Belarus";

in paragraph seven the word of "state" shall be replaced with words Republic of Belarus.

7. In Article 8:

in part two:

the fourteenth to state the paragraph in the following edition:

8. State Articles 9 and 10 in the following edition:

"Article 9. Powers of the Ministry of Defence of the Republic of Belarus in the field of defense

The Ministry of Defence of the Republic of Belarus is the republican state body pursuing within the competence state policy in the field of defense, performing management of Armed Forces, their preparation for accomplishment of tasks on ensuring military safety and the armed protection of the Republic of Belarus, its sovereignty, independence, territorial integrity and the constitutional system.

Ministry of Defence of the Republic of Belarus:

prepares offers on defense, to forming of state policy in the field of defense, including military policy and the Military doctrine of the Republic of Belarus, participates in their realization;

accepts (publishes) regulatory legal acts of the Republic of Belarus within the competence and competence of the General Staff of Armed Forces, exercises control of their execution;

participates in development and implementation of concepts and programs of military construction, develops and realizes programs and construction plans and developments of Armed Forces, types of Armed Forces, types of military forces, special troops and systems of providing, and also transport troops of the Republic of Belarus;

participates in the organization of mobilization preparation of economy of the Republic of Belarus, exercises control of preparation of the organizations for accomplishment of the mobilization tasks established by it;

directs development of military science and carrying out scientific research for the benefit of Armed Forces;

will organize supply of Armed Forces with arms and military equipment, all types of appliances and allowance;

provides territorial troops with arms, the military and special equipment according to nomenclatures of Armed Forces;

develops and introduces in Council of Ministers of the Republic of Belarus offers on the nomenclature, amounts, regulations and procedure for supply, storage, transportation, content and use of material values of the state and mobilization material reserves for ensuring needs of the state during mobilization and in wartime;

participates in implementation of military and military and technical cooperation of the Republic of Belarus with foreign states and the international organizations, signs in accordance with the established procedure interdepartmental international agreements;

provides social protection of the military personnel, civil personnel of Armed Forces, persons discharged from military service and members of their families;

directs development of system of preparation of military personnel for Armed Forces, other troops and military forming according to the procedure, established by the legislation of the Republic of Belarus;

performs other powers, the stipulated by the legislation Republic of Belarus in the field of defense.

Article 10. Powers of the General Staff of Armed Forces in the field of defense

The General Staff of Armed Forces (further - the General Staff) is the central body of military management intended for realization of operational functions on management of Armed Forces, ensuring their high fighting capacity, the organization of interaction and coordination of activities of structural components of military organization of the state for accomplishment of tasks in the field of defense both in peace and in wartime.

General Staff:

performs in interaction with bodies of military management of other troops and military forming the analysis of military-political and strategic situation, estimates nature and level of military threats to the Republic of Belarus;

maintains fighting capacity and combat readiness of Armed Forces;
