RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

of July 11, 2018 No. 554

About introduction of national management system and control over the implementation of joint operational Cross-Border Cooperation Programmes of the European tool of the neighbourhood 2014-2020

(as amended on 26-10-2021)

For the purpose of accomplishment of obligations of Ukraine which follow from provisions of agreements on financing of joint operational Cross-Border Cooperation Programmes of the European tool of the neighbourhood 2014-2020, and determination of the mechanism of their accomplishment the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for functioning of national management system and control over the implementation of joint operational Cross-Border Cooperation Programmes of the European tool of the neighbourhood 2014-2020, which is applied.

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. Authorize to perform functions:

National authority of management of joint operational Cross-Border Cooperation Programmes of the European tool of the neighbourhood 2014-2020 - the Secretariat of the Cabinet of Ministers of Ukraine;

National control and contact Item of joint operational Cross-Border Cooperation Programmes of the European tool of the neighbourhood 2014-2020 - the Ministry of Finance, including by involvement of the Public auditing service to check of legality and legitimacy of expenses of the main partners and/or partners (residents) in projects and accomplishment of separate tasks by Body of public supervision of auditor activities (under approval) and Auditor chamber (under approval);

the representative of Ukraine in Group of auditors of joint operational Cross-Border Cooperation Programmes of the European tool of the neighbourhood 2014-2020 - Audit Chamber (under approval).

4. To provide to the secretariat of the Cabinet of Ministers of Ukraine, the Ministry of Finance, the Public auditing service from the date of entry into force of this resolution functioning of structural divisions, actionees of joint operational Cross-Border Cooperation Programmes of the European tool of the neighbourhood 2014-2020 in a month.

Procedure for functioning of national management system and control over the implementation of joint operational Cross-Border Cooperation Programmes of the European tool of the neighbourhood 2014-2020

1. This Procedure determines the procedure of functioning of national management system and control over the implementation of joint operational Cross-Border Cooperation Programmes of the European tool of the neighbourhood 2014-2020 (further - joint operational Cross-Border Cooperation Programmes), distribution of functions and obligations between state bodies for execution of such programs, considering provisions of the Agreement on financing of the joint operational program of boundary cooperation "Ukraine - Poland - Belarus 2014-2020", Agreements on financing of the joint operational program of boundary cooperation "Ukraine - Hungary - Slovakia - Romania 2014-2020", Agreements on financing of the joint operational program of boundary cooperation "Ukraine - Romania 2014-2020" and Agreements on financing of the joint operational program of boundary cooperation "The basin of the Black Sea of 2014-2020".

2. Terms which are used in this Procedure have such value:

advance payment - part of grant which is transfered to account the main partner and/or the partner (partners) for project implementation of joint operational Cross-Border Cooperation Programmes according to the conditions determined by the grant contract;

the applicant - the legal entity (the resident or the nonresident) who submits the project proposal on tender;

The auditor body is body of the EU member state which is responsible for carrying out audit of management systems and control within accomplishment of joint operational Cross-Border Cooperation Programmes, provides carrying out financial audits of projects and the annual reporting under these programs;

the main partner (during state registration of the project - the contractor, in case of the conclusion of the grant contract - the beneficiary) - the legal entity (the resident or the nonresident) who is receiver of grant signs the grant contract, the partnership agreement and also target use of means bears responsibility for project implementation in general;

grant (grants) - means of the European Union which are provided on non-paid and irretrievable basis to the main partner and/or the partner (partners) for project implementation within the joint operational program of boundary cooperation;

the grant contract - the contract signed between the main partner and Governing body of the program for the purpose of project implementation;

The group of auditors is group which includes authorized representatives of each member country of joint operational Cross-Border Cooperation Programmes and is headed by the representative of Auditor body;

electronic monitoring system of the program - the information (automated) system with the communication portal for support of representation, approval of projects, control and the reporting under projects within joint operational Cross-Border Cooperation Programmes which administration is assigned to Governing body of the corresponding joint operational Cross-Border Cooperation Programme;

Implementation Regulations - Implementation Regulations of the European Commission of August 18, 2014 No. 897/2014;

final payment - part of grant which is transfered to account the main partner and/or the partner (partners) after project implementation completion;

local executive bodies of Ukraine within action of joint operational Cross-Border Cooperation Programmes - regional public administrations of Ukraine in the territory of which joint operational Cross-Border Cooperation Programmes are effective;

The national control and contact Item - the central executive body of Ukraine which coordinates work on accomplishment of the functions connected with the organization of conducting check of the expenses incurred by the main partners and/or partners (residents) within projects implementation in the territory of Ukraine according to agreements on financing of joint operational Cross-Border Cooperation Programmes and provides interaction with Gosauditsluzhboy, Body of public supervision of auditor activities, the Auditor chamber, Governing body of joint operational Cross-Border Cooperation Programmes and other bodies determined in this Procedure, for the purpose of accomplishment of the functions assigned to it;

National contact Item - the central executive body which performs functions of National contact Item on the organization of interaction with the European management concerning prevention of abuses and fraud (OLAF) and the European Court of Auditors (ECA) concerning accomplishment of the Section VI "Financial cooperation and provisions concerning fight against fraud" Agreements on association between Ukraine, on the one hand, and the European Union, European Atomic Energy Community and their state members, on the other hand, and appendices to it;

National authority of management - permanent body of Ukraine which is responsible for coordination and accomplishment of joint operational Cross-Border Cooperation Programmes at the national level, and also for creation and effective functioning of national management system and control over the implementation of joint operational Cross-Border Cooperation Programmes;

the independent auditor - the subject of auditor activities selected under the terms of tender included in the corresponding List of the independent auditors who are previously selected by National control and contact Item according to the established criteria and which performs verification of expenses on projects;

unacceptable expenses - expenses under grant contracts which the independent auditor and/or governing bodies and control of joint operational Cross-Border Cooperation Programmes do not consider acceptable according to Article 49 of Regulations of the European Commission of August 18, 2014 No. 897/2014;

The governing body is the authority of the EU member state authorized by the European Commission to provide effective implementation of joint operational Cross-Border Cooperation Programmes according to the principles of the best international practice of financial management;

the partner (during state registration of the project - the recipient) - the legal entity (the resident or the nonresident) who participates in project implementation, the conclusion and agreement performance about partnership;

return in an inadequate way of the used means is return of grant funds based on request of Governing body which were transferred by the main partners and partners and are recognized as Governing body such that were spent not to destination or with violation of procedures which are used for accomplishment of joint operational Cross-Border Cooperation Programmes, and cannot be calculated from the following payments for the account of grant;

return of unused part of grant is return of grant funds based on the statement of Governing body which were transferred by the main partners and partners for project implementation, however were not used during project deadline and which use is not confirmed with project reports;

violation is non-compliance with requirements of the national legal system, provisions of the grant contract or relevant agreement on financing of the joint operational program of boundary cooperation, through actions or omissions of the companies, organizations or organizations involved in accomplishment of joint operational programs which influence or can influence the general budget of the EU and/or the Government budget of Ukraine and entail illegal expenses of means;

The representative of Ukraine in Group of auditors - Audit Chamber which is member Gruppy of auditors and takes part in assessment of national part of management system and control, and also in carrying out selective audits of project costs and annual accounts according to the corresponding joint operational Cross-Border Cooperation Programme;

acceptable expenses - the expenses which are actually suffered by the beneficiary also correspond to the criteria specified in Article 48 of Regulations of the European Commission of August 18, 2014 to No. 897/2014;

program documents - the documents on preparation, realization and control of use of means within projects approved by Governing body, the decision of Joint monitoring committee, Joint technical secretariat;

intermediate payment - part of grant which is transfered to account the main partner and/or the partner (partners) during project deadline;

the project - the complex of actions (processes) which is drawn up documentary in which actions of project participants (the main partners, partners), and also the resources necessary for goal achievement of the project during the terms established by the grant contract are determined;

The joint monitoring committee is working body of joint operational Cross-Border Cooperation Programmes which is responsible for implementation of monitoring of execution of the specified programs, decision making of national management system and control over the implementation of joint operational Cross-Border Cooperation Programmes and which part representatives of all member countries which have the equal rights and obligations are;

The general estimative committee is working body of joint operational Cross-Border Cooperation Programmes which carries out assessment and selection of project offers;

The joint technical secretariat is the working body of joint operational Cross-Border Cooperation Programmes created for the help to Governing body, Joint monitoring committee and in case of need to Auditor body in accomplishment of their functions;

the partnership agreement - the agreement signed between the main partner and the partner (partners) about joint project implementation.

3. The main objectives of National authority of management are:

creation and ensuring effective functioning of management system and control at the national level;

coordination of bodies of management system and control over the implementation of joint operational Cross-Border Cooperation Programmes at the national level;

coordination of accomplishment of joint operational Cross-Border Cooperation Programmes and projects in their framework in the territory of Ukraine;

coordination of cooperation with Governing body on accomplishment of joint operational Cross-Border Cooperation Programmes in Ukraine;

appointment of members from the Ukrainian Side in structure of Joint monitoring committee, General estimative committee and other working bodies which can be created within joint operational Cross-Border Cooperation Programmes;

representation of the Ukrainian Side in Joint monitoring committee and General estimative committee;

cooperation with Governing body and National control and contact Item by attraction of Gosauditsluzhby to carrying out joint with representatives Organa of management / Joint technical secretariat of checks concerning legality and legitimacy of expenses of the main partners and/or partners (residents) and in case of the facts of abuse and suspicion of fraud elicited violations, in particular, informing Governing body, Auditor body, National control and contact Item and the representative of Ukraine in Group of auditors on such violations;

the paragraph the ninth is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 17.06.2020 No. 502;

informing Governing body, National control and contact Item, the European Commission, Auditor body, Group of auditors and National contact Item on suspicion of fraud and the revealed cases of violations and fraud within projects implementation of joint operational Cross-Border Cooperation Programmes;

assistance in conducting check of compliance of applicants of projects to criteria of joint operational Cross-Border Cooperation Programmes;

implementation of actions concerning prevention, identifications and corrections of the violations arising during projects implementation and informing on it Governing body;

implementation within the powers of actions for the purpose of provision of explanations on requests of Governing body concerning application of the national legal system in the field of public purchases by attraction to accomplishment of such functions of Ministry of Economics;

support to Governing body and Joint technical secretariat during the conclusion of contracts on projects with the financing duplication avoidance purpose;

assistance to Governing body in implementation of its functions, including provision of statistical data and financial information about condition of accomplishment of joint operational Cross-Border Cooperation Programmes in Ukraine and achievements of the expected purposes and results;

assistance to Governing body in identification of risks for accomplishment of joint operational Cross-Border Cooperation Programmes in the territory of Ukraine;

support of Governing body in return of incorrectly spent means and unused part of grant by the main partners and/or partners (residents) of projects - budgetary institutions.

ensuring communication with Governing body, Joint technical secretariat, state bodies of the power of Ukraine which take part in accomplishment of functions according to this Procedure, for consideration of the questions concerning accomplishment of joint operational Cross-Border Cooperation Programmes in Ukraine.

4. The main objectives of National control and contact Item are:

the organization of conducting check of legality and legitimacy of the costs incured by the main partners and/or partners (residents) within projects implementation of joint operational Cross-Border Cooperation Programmes, in particular, by attraction to accomplishment of such function of Gosauditsluzhby;

cooperation with National authority of management concerning forming and effective functioning of management system and control at the national level;

forming and promulgation of criteria, the joint operational Cross-Border Cooperation Programmes installed in methodical recommendations to independent auditors who can be chosen as the main partner and/or the partner for conducting check of expenses in drafts of joint operational Cross-Border Cooperation Programmes according to international standards of audit and Implementation Regulations (in cooperation with Auditor chamber);

providing on the basis of certain criteria of competitive selection of independent auditors of forming of the open List of independent auditors who can be chosen as the main partner and/or the partner for conducting check of expenses in drafts of joint operational Cross-Border Cooperation Programmes, and also modification of the specified List, by attraction to accomplishment of such functions of Auditor chamber (under approval);

assistance to Joint technical secretariat, Governing body in carrying out the corresponding doctrines and trainings of the independent auditors selected by the main partner and/or the partner including concerning joint operational Cross-Border Cooperation Programmes, rules of project implementation, the reporting, national rules of check of the expenses declared by the main partner and/or the partner, rules and procedures of confirmation of expenses for projects within joint operational Cross-Border Cooperation Programmes;

ensuring verification of information on the subject of auditor activities with which the main partner and/or the partner (resident) signed the agreement on rendering auditor services in check of expenses on projects within joint operational programs in the List of independent auditors who underwent the procedure of selection and can be involved in check of expenses on projects within joint operational programs if conducting such check is provided by program documents;

ensuring provision of access to the independent auditor to electronic monitoring system of the corresponding joint operational Cross-Border Cooperation Programme by its registration for conducting check of project costs within joint operational programs if access is provided by program documents;

ensuring verification of information concerning procurement procedure the main partners and/or partners (residents) of auditor services on compliance to the national legal system or the rules of implementation of purchases approved by Body managements/decisions of Joint monitoring committee if it is provided by program documents, way of attraction to accomplishment of this function of National authority of management (in case of need);

implementation of actions concerning provision of explanations on requests of Governing body and other bodies within joint operational programs of boundary cooperation concerning application of the national legal system in spheres of the taxation, financial accounting and audit, compensation and in other spheres;

attraction according to request of Governing body of representatives of Gosauditsluzhby for conducting checks of projects implementation, joint with representatives of Governing body, on places;

the paragraph the ninth is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 17.06.2020 No. 502

assistance to Governing body in return of incorrectly spent means and unused part of grant by the main partners and/or partners (residents) of projects - budgetary institutions;

ensuring implementation of consideration of addresses (statements, claims, etc.) upon the demand of Body of management / Joint technical secretariat in case of reasonable suspicions of rather improper execution by independent auditors of professional obligations and the organization of conducting checks for quality control of auditor services according to the procedure, determined by the Law of Ukraine "About financial records audit and auditor activities", by attraction to accomplishment of such functions of Body of public supervision of auditor activities (under approval) or Auditor chamber (under approval);

informing Governing body, National authority of management and the representative of Ukraine in Group of auditors on the sanctions applied to the independent auditor in case of identification of the facts of improper execution by the independent auditor of the obligations, exceptions of the independent auditor of the List of independent auditors;

development in cooperation with Governing body, Joint technical secretariat, Gosauditsluzhboy and Body of public supervision of auditor activities (from consent) documents for conducting checks of expenses on projects.

5. Powers of the representative of Ukraine in Group of auditors:

provision of the candidate for the authorized representative from Ukraine in structure of Group of auditors, independent of other state bodies participating in accomplishment of the program and also from independent auditors who book audit of expenses on projects;

participation in development of procedures for Group of auditors and the strategy of audit specified in Article 28 of Implementation Regulations;

participation in regular meetings of Group of auditors under the direction of Auditor body;

participation in annual review and in case of need modification of the specified strategy of audit which shall determine methodology of carrying out audit of the annual reporting under projects, selection methods which are applied during project audits, and also to contain the plan of carrying out audits for the current year and for two next years;

support to Auditor body in carrying out audits within joint operational Cross-Border Cooperation Programmes, in particular system audit, selective audits of expenses on projects, and also the annual financial reporting according to programs on the basis of the approved Group of auditors of strategy of audit;

evaluating national management systems and control, in particular regarding their compliance to general operational Cross-Border Cooperation Programmes and requirements of the legislation of Ukraine and the EU;

participation in preparation and approval of annual audit reports by Group of auditors which contain final information on all audits booked within year, including the analysis of the revealed mistakes and violations, both at the program level, and at the level of projects, and also about the taken or planned measures for elimination of violations and mistakes;

informing National authority of management and Governing body on the revealed violations in the procedure established by Implementation Regulations.

6. Power of National contact Item is the direct cooperation with the European management concerning prevention of abuses and fraud for the purpose of assistance of its operational activity in the territory of Ukraine according to agreements on financing of joint operational Cross-Border Cooperation Programmes.

7. The main objectives of local executive bodies of Ukraine within action of joint operational Cross-Border Cooperation Programmes are:

participation in work of Joint monitoring committee, General estimative committee and other working bodies which can be created within joint operational Cross-Border Cooperation Programmes;

cooperation with National authority of management and National control and contact Item concerning ensuring implementation of proper supervision of target and effective use of grant funds for the territories of Ukraine;

informing National authority of management, Auditor body, Group of auditors, National control and contact Item and National contact Item on suspicion of fraud and the revealed cases of violations and fraud within projects implementation of joint operational Cross-Border Cooperation Programmes;

assistance according to request of Governing body and/or National control and contact Item to their representatives in conducting joint checks of projects implementation on places;

assistance of management to National authority in:

- to preparation of statistical data and financial information about condition of accomplishment of joint operational Cross-Border Cooperation Programmes in Ukraine and achievements of the expected purposes and results;

- in identification of risks for accomplishment of joint operational Cross-Border Cooperation Programmes in the territory of Ukraine;

- assistance of joint financing to the organization for projects;

- carrying out monitoring of projects implementation;

assistance of management to National authority and Item National control contactly in return of incorrectly spent means and unused part of grant the main partners and/or partners (residents) of projects - budgetary institutions.

8. The main partner and the partner after signing of the grant contract and the partnership agreement choose independent auditors according to certain general operational Cross-Border Cooperation Programmes procedures from the List of independent auditors.

9. The main partner and the partner provide according to the terms determined in the grant contract and the partnership agreement, preparation of reports on the project progress.

10. The independent auditor performs reports and expenses and signs the document (report) on results of check with determination of the amount of the acceptable expenses performed by the main partner or the partner and unacceptable expenses (in case of availability).

11. For receipt of intermediate and final payments partners send reports to the main partner which consist of the report of the partner on the project progress, the document on results of check of expenses by the independent auditor and request for transfer of intermediate or final payment. The main partner prepares the generalized report to which documents of partners are attached. The generalized report is provided to Joint technical secretariat.

12. For receipt of advance payment the main partner sends request for payment transfer in Joint technical secretariat according to the terms determined in the grant contract.

13. The joint technical secretariat after approval of the generalized report transfers request for transfer of grant means to Governing body which performs their recalculation to the main partner.

14. The main partner according to the partnership agreement transfers to account the partner (partners) the part of grant means which is due to it (it).

15. The joint technical secretariat together with National control and contact Item by involvement of representatives of Gosauditsluzhby can perform projects implementation on places with visit of the main partner and/or partner, and also objects which are part of projects, for assessment of progress in their realization. Projects on places are performed according to the annual plan of control which is created by Joint technical secretariat on analysis results of risks of identification of unacceptable costs.

16. National control and contact Item by attraction of Gosauditsluzhby Organa managements / Joint technical secretariat provides check of legality and legitimacy of the costs incured by the main partners and/or partners (residents) based on selection of the projects included Body of management / Joint technical secretariat in the annual plan of control or according to request.

National control and contact Item according to request Organa of management / Joint technical secretariat about need of conducting checks on quality control of auditor services provides Organa of public supervision of auditor activities (on consent) or Auditor chamber (in consent) offers on inclusion of independent auditors in annual scheduled plans of conducting checks on quality control of auditor services.

17. The national control and contact Item in case of confirmation in actions of the independent auditor of signs of professional offense by results of consideration of addresses (statements, claims, etc.) and/or checks on quality control of auditor services and, in case of detection of mistakes during conducting check of the expenses incurred by the main partner and/or the partner can exclude the independent auditor from the List of independent auditors.

18. The national control and contact Item has the right to receive from independent auditors any documents concerning confirmation of the acceptability of the expenses incurred by the main partner or the partner and also the copy of other documents received by the independent auditor during check.

19. The main partner and the partner shall provide creation of conditions for conducting checks on places and access to documents on the project to the independent auditor and all bodies specified in this Procedure.

20. Quality control of work of independent auditors and quality of projects implementation is performed during the term of accomplishment of joint operational Cross-Border Cooperation Programmes.

21. The main partners and partners shall provide return of incorrectly spent means and unused part of grant on request of Governing body.

22. The main partners and partners who did not provide return of incorrectly spent means and unused part of grant or those which allowed fraud cases during execution of joint operational Cross-Border Cooperation Programmes cannot take part in competitive selection of projects within future Cross-Border Cooperation Programmes after 2020.

23. The main partners and partners not later than within a month after the beginning of project implementation submit to National authority of management all relevant documents for state registration of the project in the procedure established by the legislation.

24. Monitoring and control of projects is exercised by National authority of management together with National control and contact Item, the main partner and the partner, central and local executive bodies, Joint technical secretariat (under approval) and Governing body (under approval) during project implementation and at the final stage of realization.

25. The main partners and partners (residents) provide representation to the independent auditor in the terms provided by the grant contract, the status report of project implementation. The reports checked by the independent auditor move to Joint technical secretariat.

25-1. The main partners and partners (residents) provide representation to local executive bodies till July 10 of accounting year and till January 10 of the year following for reporting, the report on project implementation on form according to appendix 1 to this Procedure.

25-2. Upon the demand of local executive bodies the main partners and partners (residents) represent copies of the documents necessary for carrying out the analysis of the submitted status reports of project implementation.

26. Local executive bodies on analysis results of the submitted reports are prepared and given till July 30 of accounting year and till January 30 of the year following for reporting, to National authority of management summarized information on project implementation condition which takes root in the territory of the respective area, in form according to appendix 3 to this Procedure, and about probable risks which can negatively influence further implementation of such projects, in form according to appendix 2 to this Procedure.

27. The national authority of management generalizes provided information and on request of Governing body provides it for inclusion in the risk register within joint operational Cross-Border Cooperation Programmes.

28. The main partners, partners, National authority of management and other bodies of joint operational Cross-Border Cooperation Programmes ensure safety of the documents (archiving of the data) connected with accomplishment of joint operational Cross-Border Cooperation Programmes and separate projects which are available for them according to Article 70 of Implementation Regulations.

29. Return of incorrectly spent means and unused part of grant by the main partners and/or partners (residents) of projects - budgetary institutions is performed according to the procedure developed by National control and contact Item together with National authority of management.

2. Item 4 of the Regulations on the Ministry of Finance of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 375 (Official Bulletin of Ukraine, 2014, No. 69, Art. 1936), to add with subitems 67-1-the 67-5-following content:

"67-1) performs coordination of work on accomplishment of functions of National control and contact Item of joint operational Cross-Border Cooperation Programmes of the European tool of the neighbourhood 2014-2020 in the territory of Ukraine;

67-2) performs coordination of the organization of carrying out audit and control of accomplishment in Ukraine of joint operational Cross-Border Cooperation Programmes;

67-3) performs coordination of creation and maintaining the open list of independent auditors within joint operational Cross-Border Cooperation Programmes;
