About approval of Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production

According to the subitem 41) of Item 1 of article 6 of the Law of the Republic of Kazakhstan of July 8, 2005 "About state regulation of development of agro-industrial complex and the rural territories", and also the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan of March 19, 2010 "About the state statistics" I ORDER:

1. Approve Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production, according to appendix 1 to this order.

2. Recognize invalid some orders of the Minister of Agriculture of the Republic of Kazakhstan, according to appendix 2 to this order.

3. To provide to department of production and conversion of livestock products of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Agriculture of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after day of its first official publication.

Appendix 1

Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production

Chapter 1. General provisions

1. These rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production (further - Rules) determine procedure for provision of budget subsidies (further - subsidies) for the account and within the means and actions provided in the local budget for the corresponding financial year to domestic agricultural producers, physical persons and legal entities (further - producers) on development of breeding livestock production, increase in productivity and product quality of livestock production.

2. In these rules the following basic concepts are used:

1) uterine livestock - livestock of female individuals of the animals who reached polovozrely age (on cattle breeding: breeding animals - of 13 months, commodity animals - of 18 months, on sheep breeding - of 12 months, on maralovodstvo (reindeer breeding) - of 24 months, on pig-breeding - of 8 months), used for reproduction of herd;

2) the special account - the account of producer at financial institute / bank of the second level on which the amount of subsidies for providing terms of the contract is credited;

3) economy on growing of bull-calves - the economy performing purchase of the bull-calves received as a result of pedigree transformation, their growing and implementing bull-calves on feedlots with a capacity at least 1000 heads one-timely for final fattening;

4) the operator in meat cattle breeding - the feedlot with a capacity at least 1000 heads one-timely performing transfer to lease of breeding manufacturing bulls to commodity and public herds, and also performing purchase of bull-calves for further fattening;

5) public herd - the herd of cattle created from livestock of personal subsidiary farms;

6) the operator in sheep breeding - economy with livestock of ewes from 3000 heads, performing transfer to lease of breeding manufacturing rams to commodity flocks, and also performing purchase of cowslip for further fattening;

7) services in fattening of the cattle - the paid service in fattening of the cattle provided by the feedlot to the legal entities having in property of bull-calves for fattening;

8) target use of the acquired breeding and thoroughbred animals - use of the acquired and pro-subsidized animals for the purpose of reproduction on conditions and in the terms specified in these rules;

9) commodity herd / flock - the herd of the large horned cattle / flock of sheep created from livestock of the economy or agricultural cooperative performing conducting selection and breeding work with uterine livestock of the large horned cattle / sheep;

10) pedigree transformation - improvement of pedigree and productive qualities of uterine livestock by use in reproduction of breeding producers;

11) sluchny season - the period of reproduction of farm animals;

12) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

3. The directions which are subject to subsidizing:

1) on development of breeding livestock production:

reduction in cost of costs for conducting selection and breeding work with uterine number of cattle, sheep, pigs, marals (deer), and also bee colonies;

reduction in cost of acquisition value of breeding or thoroughbred uterine number of cattle, breeding manufacturing bulls of meat breeds, breeding manufacturing rams, breeding manufacturing stallions of the productive direction, breeding manufacturing camels, breeding and thoroughbred uterine livestock of pigs, breeding uterine livestock of goats at domestic and foreign farms;

reduction in cost of purchase costs of breeding daily young growth parent / прародительской forms of the meat direction of birds at domestic and foreign farms;

reduction in cost of purchase costs of breeding daily young growth of the final form of the egg direction of birds received in the poultry farm registered in republican chamber;

reduction in cost of costs of the operator for content of breeding manufacturing bulls of meat breeds / the breeding manufacturing rams used for reproduction of commodity herd / flock;

reduction in cost of costs of physical persons and legal entities for content of breeding manufacturing bulls of the meat, milk and milk and meat breeds used for reproduction of public herd;

reduction in cost of cost of the acquired same-sex and bisexual seed of breeding bull of milk and milk and meat breeds;

subsidizing of services of the breeding and distribyyuterny centers for artificial insemination of uterine number of cattle seed of breeding manufacturing bulls of milk and milk and meat breeds, and also uterine livestock of sheep in peasant farms and agricultural cooperatives;

subsidizing of services in transplantation of embryos;

2) on increase in productivity and product quality of livestock production:

reduction in cost of cost of the bull-calves implemented on fattening to feedlots with a capacity at least 1000 heads one-timely;

reduction in cost of costs of fattening of bull-calves for feedlots with a capacity at least 1000 heads one-timely

reduction in cost of cost of procurement of beef by the meat-processing companies, engaged in face and primary conversion of meat of cattle;

reduction in cost of cost of the realized eanlings;

reduction in cost of manufacturing cost of fowl (meat of broiler bird, meat of turkey, waterfowl), food egg (egg), milk (cow, mare's, camel), fine-fleece and semi-fine-fleece wool;

reduction in cost of cost of costs for forages to uterine livestock of the milk direction.

4. Standard rates of subsidies in the directions of subsidizing are specified in appendix 1 to these rules.

5. The draft of the resolution of akimat of area, the cities of Astana and Almaty with amounts of subsidies in the directions of subsidizing, are numbered, proshnurovyvatsya, sealed and are in duplicate provided by Deraptments of Agriculture of area (further - Management of area), the cities of Astana and Almaty (further - City department) on approval in the Ministry of Agriculture of the Republic of Kazakhstan (further - the Ministry) the cover letter signed by the akim of area, the cities of Astana and Almaty, in case of its absence person fulfilling its duties no later than January 20 of the corresponding year.

Amounts of subsidies are determined by the directions of subsidizing according to priority tasks of the state and government programs.

The ministry within five working days considers the provided subsidizing amounts on compliance to the purposes and indicators of the state and government programs.

In case of the positive decision the Ministry returns the corresponding cover letter one copy of amounts of subsidizing no later than January 25 of the corresponding year.

In case of the negative decision the Ministry the letter with motivated reasons sends to completion both copies of amounts of subsidizing no later than January 25 of the corresponding year.

Modifed amounts of subsidizing it is in duplicate provided by the cover letter signed by the akim of area, the city of republican value, the capital, in case of its absence person fulfilling its duties on repeated approval in the Ministry no later than January 30 of the corresponding year.

The ministry returns the corresponding cover letter one copy of the approved subsidizing amounts no later than February 5 of the corresponding year.

Amounts of subsidies within a month after maintaining in action of these rules and in subsequent annually, no later than February 5 affirm the resolution of akimat of area, the cities of Astana and Almaty.

After approval of the resolution, the akimat of area, the cities of Astana and Almaty within two working days places it on the official Internet resource.

After placement of the resolution on Internet resource, the Ministry verifies amounts of subsidies regarding compliance to their earlier approved option. In case of detection of discrepancy, the Ministry notifies akimat of area, the cities of Astana and Almaty on need of reduction in compliance with the approved option of amounts of subsidizing.

6. Are not subject to subsidizing:

1) acquisition of the breeding or thoroughbred animals, breeding products (material) which are earlier pro-subsidized on reduction in cost of cost in case of acquisition, acquired on barter on account of settlement or used not for the reproduction purposes;

2) the acquired domestic breeding animals whose actual cost does not exceed the approved standard rate minimum twice;

3) selection and breeding work with the animals and bee colonies pro-subsidized in the current year in the direction of subsidizing for conducting selection and breeding work during the season passing sluchny;

4) breeding manufacturing bulls of meat, milk and milk and meat breeds / the breeding manufacturing rams used for reproduction in herds/flocks, the contents of breeding bulls producers pro-subsidized in the current year in the direction / breeding manufacturing rams;

5) breeding manufacturing rams, on reduction in cost of cost in case of acquisition, in case of provision by operators in lease for reproduction of commodity flock;

6) seed of breeding manufacturing bulls of the milk and milk and meat breeds on reduction in cost of acquisition value used when rendering services in artificial insemination of uterine number of cattle by the breeding and distribyyuterny centers;

7) bull-calves, on reduction in cost of costs when fattening, received not as a result of pedigree transformation (except for the bull-calves implemented by milk and commodity farms);

8) the livestock production products acquired by producers at other physical persons and legal entities for its further resale and (or) conversion, except for the meat-processing companies which are engaged in face and primary conversion of meat of cattle;

9) the livestock production products sold by producers on barter, on account of settlement or earlier pro-subsidized, the products of livestock production which are purchased by the meat-processing companies except for earlier pro-subsidized, engaged in face and primary conversion of meat of cattle;

10) livestock products of household face, and also not undergone primary conversion in lethal workshops (Items) and the meat-processing companies;

11) the livestock production products received by producers as a result of forced sanitary face of animals and also products and livestock of farm animals during implementation of karantinirovaniye on especially dangerous and infectious diseases by certain type of animals;

12) collateral products of meat poultry farming - pad, the heads, internals;

13) the food egg realized and (or) passed for production of egg powder;

14) the processed milk realized unpacked;

15) bull-calves, on reduction in cost of cost in case of realization on the feedlots received from breeding uterine livestock of meat breeds.

7. Annually the Department of agricultural industry of the respective area, city of regional value (further - Department) in time no later than five calendar days prior to order taking for receipt of subsidies (further - the request) places on Internet resource of akimat of the area, city of regional value the announcement of the beginning of order taking for subsidizing. Order taking begins since January 20 of the current year.

8. Necessary condition of receipt of subsidies producers, physical persons and legal entities are compliance to the criteria specified in appendices 2 and 3 to these rules at the time of application.

9. Subsidies are paid:

1) for each uterine number of cattle, sheep, pigs and marals (deer), involved in selection and breeding work; for the head of breeding manufacturing bull meat, milk and milk and meat breeds / the breeding manufacturing ram used for reproduction of herd/flock - for sluchny season;

2) for the bee colony involved in selection and breeding work - during the season;

3) for the head of the acquired breeding and thoroughbred animal, breeding daily young growth parent / прародительской forms of the meat direction of birds, breeding daily young growth of final form of the egg direction of birds - upon acquisition (except for transfers of subsidies for the special account in case of acquisition of cattle);

4) for the head of artificially inseminated uterine number of cattle and sheep - upon insemination;

5) for dose of same-sex and bisexual seed at the rate of expense two doses on uterine livestock, but requirement no more than an amount on general uterine livestock of economy - upon acquisition;

6) for the head of the calf received as a result of successful transplantation of embryo - by results of genetic certification;

7) for kilogram of live weight of the bull-calf implemented on the feedlot with a capacity at least 1000 heads one-timely; for kilogram of additional weight of the fattened bull-calf who is initially processed at the meat-processing companies and (or) lethal workshops (Items), the having accounting numbers or sent in live type (the priority is given to subjects which products are oriented to realization out of country limits); for the head of the eanling realized to the specialized meat-processing enterprises on slaughter and cutting of lamb, or sent in live type (the priority is given to subjects which products are oriented to realization out of country limits); for kilogram of the beef received on the meat-processing plants which are engaged in face and primary conversion of meat of cattle; for kilogram of fowl, milk, the thin and semi-thin wool realized or processed at the companies (workshops) of conversion having accounting numbers; for unit of the realized food egg - upon realization;

8) for the head of uterine livestock of the milk direction - upon procurement of hay, haylage/silo and procurement/acquisition of the concentrated forages.

10. In case of shortage of means for satisfaction of requests in one of the subsidized directions in full, including earlier approved, but not financed or partially financed requests, Management of area, City department redistributes missing funds from the directions, in the presence of undeveloped means in this directions.

The unpaid remaining balance of subsidies which is due to producer will be paid to it in priority procedure from means of the next month in case of their availability within the amounts approved by the resolution of akimat of area, the cities of Astana and Almaty in the direction of subsidizing.

11. In case of change of the amounts between the directions of subsidizing corresponding changes and (or) amendments according to the procedure, stipulated in Item 5 these rules are made to the resolution of akimat of area, the cities of Astana and Almaty. At the same time reducing amounts of subsidies in the priority directions according to the purposes and indicators of the state and government programs is not allowed.

12. The management of area, City department monthly publishes information on results of consideration of requests of physical persons and legal entities for receipt of subsidies on the special Section of Internet resource of akimat of area, the cities of Astana and Almaty.

Management of area, City department directs the report on development of budgetary funds monthly till the fifth following for reporting in form 1, according to appendix 4 to these rules and annually till January 10 of the following after accounting year in form 2, according to appendix 4 to these rules in the Ministry.

13. The ministry performs monitoring of realization by akimats of areas, cities of Astana and Almaty of subsidizing on development of breeding livestock production, increase in productivity and product quality of livestock production. Following the results of monitoring by the Ministry the offer addressed to the akim of area, the cities of Astana and Almaty is made.

Chapter 2. Procedure for receipt of subsidies in the direction of development of breeding livestock production

14. In the directions of subsidizing of development of breeding livestock production producers submit applications from the moment of emergence of the bases for its giving and compliance of producer to criteria, according to appendix 2 to these rules, on the following terms:

1) reduction in cost of costs for conducting selection and breeding work with uterine number of cattle, covered by pedigree transformation, and also bee colonies, content of the breeding manufacturing bulls used for reproduction of herd - from April 15 to October 1 the current year;

2) reduction in cost of costs for conducting selection and breeding work with uterine livestock of sheep, marals (deer), content of the breeding manufacturing rams used for reproduction of commodity flock - from September 1 to December 1 the current year;

3) subsidizing of services of the breeding and distribyyuterny centers for artificial insemination of uterine number of cattle of the milk and milk and meat direction, and also sheep of peasant farms and agricultural cooperatives, subsidizing of services in transplantation of embryos - from May 1 to December 1 the current year;

4) reduction in cost of acquisition value of breeding or thoroughbred animals at domestic and foreign farms, reduction in cost of purchase costs of breeding daily young growth parent / прародительской forms of the meat direction and acquisition of breeding daily young growth of final form of the egg direction of birds at domestic and foreign farms, reduction in cost of the cost acquired same-sex and bisexual seed of breeding manufacturing bull of milk and milk and meat breeds from the moment of emergence of the bases for application took place no more than six months - from January 25 to December 20 the current year;

5) conducting selection and breeding work with uterine livestock of breeding cattle, pigs - from January 25 to December 20 the current year.

Producers provide compliance to the criteria specified in appendix 2 to these rules in time:

1) conducting selection and breeding work with uterine number of cattle, covered by pedigree transformation - till October 1 of the current year;

2) conducting selection and breeding work with uterine livestock of sheep, pigs and marals (deer) - till December 1 of the current year;

3) content of the breeding manufacturing bulls used for reproduction of herd - till July 1 of the current year;

4) content of the breeding manufacturing rams used for reproduction of commodity flock - till December 1 of the current year.

15. Producers in the direction of development of breeding livestock production in process of emergence of the corresponding bases direct requests in form, according to appendix 5 to these rules:

1) in paper form through The Government for Citizens State corporation (further - the State corporation);

2) in electronic form by means of the web portal of "the electronic government" www.egov.kz (further - the portal) integrated with information base of selection and breeding work (further - IAS).

Requests are created in IAS, by results of processing of the entered data in IAS taking into account the criteria specified in Appendix 2 to these rules. IAS verifies availability of data, specified by producer in the request.

In case of discrepancy of data of producer to the criteria specified in appendix 2 to these rules of IAS does not create the request.

The state corporation within one working day sends the request to Department.

The electronic request signed by the EDS of producer goes for processing to Department automatically.

The producer confirms reliability of the provided information in the request and bears responsibility for submission of false information according to the legislation of the Republic of Kazakhstan.

16. In case of compliance of the request of producer to criteria, according to appendix 2 to these rules, the Department within one working day sends the request by means of IAS to Management of area, City department.

Management of area, City department within one working day after receipt of the request sends to producer the notification in form, according to appendix 7 to these rules about approval of the request by means of IAS.

By provision of documents through the State corporation, Management of area, City department in the specified terms sends to Department the notification on approval of the request for the further direction in the State corporation.

In case of the address producer the State corporation, day of documents acceptance does not include rendering the state service in time, at the same time the result of rendering the state service by Department is provided in the State corporation a day before the termination of term of rendering the state service.

17. Management of area, City department, in case of availability of means on month and the direction of subsidizing, within one working day from the moment of approval of the request taking into account chronology of receipt of requests creates the summary act on the area, the city according to appendix 8 to these rules, and directs to payment.

18. Transfer of receivable budget subsidies in the directions for development of breeding livestock production on bank accounts of producers is performed by Management of area, City department by provision in territorial subdivision of treasury of the account register for payment in duplicate and accounts for payment within one working day, in case of availability of means on month and registration of producer in information system of Treasury.

19. Data on the received subsidies in the directions of development of breeding livestock production are entered by Management of area, City department in IAS within five working days from the date of payment of subsidies to producers.

20. Producers before provision of the request in form, according to appendix 5 to these rules, in the specified directions of subsidizing place in IAS:

the electronic copy of the reference of bank of the second level or the National operator of mail about availability of the current account (once is provided or when changing the bank account);

the act of insemination of uterine livestock of sheep in form 1, according to appendix 9 to these rules and the act of insemination and inspections on stylishness of the inseminated uterine number of cattle in form 2, according to appendix 9 to these rules - in case of artificial insemination of uterine livestock seed of breeding manufacturing bulls of milk and milk and meat breeds / sheep in peasant farms and agricultural cooperatives.

The department according to the data specified in the protocol of descent of inhabitants of the settlement on fixing and use of breeding manufacturing bulls according to appendix 10 to these rules, creates public herd with registration of uterine livestock in IAS, and also with fixing of breeding bulls of producers till July 1 of the current year.

21. In case of acquisition the producer of breeding or thoroughbred cattle with payment deferral (with partial payment), on credit or in leasing, allows transfer of budgetary funds for the account of the seller, the creditor or the lessor who is specified in the request.

In case of import of breeding or thoroughbred cattle, transfer of subsidies for the special account for payment for the cattle, on condition of availability of the positive decision of credit committee of financial institution, the credit agreement / agreement of leasing is allowed.

For receipt of subsidies for the special account, financial institution provides in Management of the copy of the positive decision of credit committee of financial institution, credit agreement / agreement of leasing, certified by financial institution. The management within three working days transfers funds into the special account.

The financial institution within two working days from the date of receipt of funds for the special account, transfers means to account, specified in the credit agreement and provides the document on money transfer in Management.

The producer within ninety calendar days from the moment of transfer of subsidies by Management, shall provide supporting documents upon import of breeding or thoroughbred cattle to Management, with registration of the cattle in IAS.

Chapter 3. Procedure for receipt of subsidies in the direction of increase in productivity and product quality of livestock production

22. Producers in the direction of increase in productivity and product quality of livestock production submit applications in case of compliance of producer to criteria, according to appendix 3 to these rules and within a month from the moment of sales of products and receipt of payment for goods sold, to terms of 20 January till December 20 of the current year.

Producers in the direction of increase in productivity and product quality of livestock production, submits the application in form, according to appendix 5 to these rules:

1) in paper form through the State corporation;

2) in electronic form by means of the portal, integrated with IAS.

Requests are created in IAS, by results of processing of the entered data in IAS taking into account the criteria specified in Appendix 3 to these rules.
