About approval of Rules of carrying out certification of persons applying for occupation activities of the patent agent, registration in the register of patent agents and entering of changes into it

According to Item 1 of article 22-4 of the Law of the Republic of Kazakhstan "About protection of selection achievements", Item 1 of article 36 of the Law of the Republic of Kazakhstan "The patent law of the Republic of Kazakhstan", Item 1 of article 46 of the Law of the Republic of Kazakhstan "About trademarks, service marks, geographical instructions and names of places of goods origin" and Item 1 of article 15 of the Law of the Republic of Kazakhstan "About legal protection of topology of integral chips" I ORDER:

1. Approve the enclosed Rules of carrying out certification of persons applying for occupation activities of the patent agent, registration in the register of patent agents and entering of changes into it.

2. To provide to department on intellectual property rights in the procedure established by the legislation:

1) state registration of this order;

2) within ten calendar days from the date of state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Justice of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising Vice-Minister of Justice of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of carrying out certification of persons applying for occupation activities of the patent agent, registration in the register of patent agents and entering of changes into it

Chapter 1. General provisions

1. Rules of carrying out certification of persons applying for occupation activities of the patent agent, registration in the register of patent agents and entering of changes into it (further – Rules) are developed according to the Law of the Republic of Kazakhstan "About protection of selection achievements", the Law of the Republic of Kazakhstan "The patent law of the Republic of Kazakhstan", the Law of the Republic of Kazakhstan "About trademarks, service marks, geographical instructions and names of places of goods origin", the Law of the Republic of Kazakhstan "About legal protection of topology of integral chips", the Law of the Republic of Kazakhstan "About the state services" and determine procedure for carrying out certification of persons applying for occupation activities of the patent agent, registration in the register of patent agents and entering of changes into it.

2. In these rules the following concepts and terms are used:

1) Certifying commission – Certifying commission of the Ministry of Justice of the Republic of Kazakhstan;

2) the candidate – person applying for the occupation right activities of the patent agent;

3) uslugopoluchatel – physical person, the candidate for patent agents;

4) the patent agent – the capable citizen of the Republic of Kazakhstan who is constantly living in its territory, having the higher education and the working life at least four years which underwent certification and registered in the register of patent agents;

5) Register – Register of patent agents of the Republic of Kazakhstan.

The state services "Certification of Persons Applying for Occupation Activities of the Patent Agent" and "Issue of the Certificate of the Patent Agent" it appears the Ministry of Justice of the Republic of Kazakhstan (further – the service provider);

In case of modification and (or) amendments to these rules the authorized body sends to the operator information and communication infrastructure of "the electronic government", to Single contact center, to the service provider information on such changes and (or) amendments within 10 (ten) working days after state registration in judicial authorities of the corresponding regulatory legal act.

Chapter 2. Procedure for carrying out certification of candidates for patent agents, registration in the register of patent agents and entering of changes into it

Paragraph 1. Documents acceptance

3. State service "Certification of Candidates for Patent Agents".

4. The persons having work experience in the field of protection and protection of intellectual property rights at least four years or which passed training in chamber of patent agents at least one year are allowed to certification.

Certification of persons applying for occupation activities of the patent agent is carried out in the form of testing for knowledge of the legislation of the Republic of Kazakhstan and the international treaties ratified by the Republic of Kazakhstan in the field of intellectual property.

5. For certification passing the uslugopoluchatel directs the following documents through the web portal of "the electronic government":

1) the statement for the admission to certification of persons applying for occupation activities of the patent agent certified the digital signature (further – the EDS) in the state or Russian languages, in form according to appendix 1 to these rules;

2) the electronic copy of the document confirming labor activity with length of service at least four years in the field of protection and protection of intellectual property rights or passed training in chamber of patent agents at least one year;

3) data for passing of certification of persons applying for occupation activities of the patent agent for form according to appendix 2 to these rules;

4) the document confirming payment of the state fee for certification of patent agents.

The service provider receives data on the identity document of uslugopoluchatel, information on payment of the state fee through payment gateway of "the electronic government" (further – PShEP) from the corresponding state information systems through lock of "the electronic government".

The bank details necessary for payment of the state fee are specified in appendix of 3 these rules.

The data specified in appendix of 2 these rules are verified with the originals of documents represented by uslugopoluchatel in case of appearance on testing certification.

6. The list of the main requirements to rendering the state service "Certification of Persons Applying for Occupation Activities of the Patent Agent" is provided according to appendix 4 to these rules.

7. When giving by uslugopoluchatel of all necessary documents, stipulated in Item 5 these rules, to uslugopoluchatel information on the status on acceptance of request for provision of the state service goes to "personal account".

The service provider checks completeness and compliance of the submitted documents, stipulated in Item 5 these rules. In case of inadequate registration by uslugopoluchatel or representations of incomplete document package according to Item 5 of these rules, the service provider sends to uslugopoluchatel the notification with indication of what requirements there does not correspond the document package and the term of its reduction in compliance.

Reduction term in compliance of the documents specified in the notification constitutes one working day if within one working day from the date of receipt of the notification the uslugopoluchatel did not bring it into accord with requirements, then the service provider within two working days directs motivated refusal in further review of the statement.

The service provider notifies uslugopoluchatel on the provisional solution, and also time and the place (method) of carrying out hearing for opportunity to express to uslugopoluchatel line item according to the provisional solution.

The term of adoption of the provisional solution by the service provider about refusal in rendering the state service one working day.

The notification on hearing goes at least in three working days prior to completion of term of rendering the state service. Hearing is carried out no later than two working days from the date of the notification.

By results of hearing the service provider notifies uslugopoluchatel according to Item 10 of these rules or motivated refusal in rendering the state service.

The refusal about the admission to certification is appealed judicially.

8. Are not allowed to certification of person:

1) which according to the laws of the Republic of Kazakhstan are forbidden to be engaged in business activity;

2) having the outstanding or not removed in the procedure established by the law criminal record for crime execution;

3) excluded from the register of patent agents in compliance by the Law;

4) being the staff of authorized body and its subordinated organizations, and also their close relatives, the spouse (spouse).

9. The authorized body in day of receipt of documents performs their acceptance and registration.

In case of the address of the applicant after the termination of working hours, in days off and holidays according to the labor law, reception of applications and issue of results of rendering the state service is performed the next working afternoon.

The service provider receives data on the identity document of uslugopoluchatel, information on payment of the state fee through PShEP from the corresponding state information systems through lock of "the electronic government".

Paragraph 2. Carrying out certification

10. Candidate lists, allowed to certification, are placed on Internet resource of authorized body.

The candidate allowed to certification in three working days is notified on the place, date, time of conducting testing through the web portal of "the electronic government" electronically and places it on Internet resource of the service provider.

Candidates hand over certification in case of presentation of the identity document, or by means of the "digital document" service within one working day.

11. The candidate at the choice undergoes certification on Kazakh or Russian. The candidate in writing confirms the choice of language prior to certification.

12. The list of the questions which are subject to inclusion in tests affirms certifying commission. Questions for assessment of knowledge of candidates correspond to subject of legal disciplines (The laws of the Republic of Kazakhstan "About protection of selection achievements", "The patent law of the Republic of Kazakhstan", "About trademarks, service marks, geographical instructions and names of places of goods origin", "About legal protection of topology of integral chips", and also the international treaties ratified by the Republic of Kazakhstan in the field of intellectual property) which knowledge is necessary for implementation of activities of the patent agent and to contain at least four answer options with one correct.

Testing is held with use of the computer equipment. Time allowed for testing constitutes ninety minutes.

Tests are confidential information and are not subject to free distribution.

Before certification passing the Certifying commission informs the candidate on procedure for carrying out, duration and contents of the procedure of candidate screen.

13. At meeting of Certifying commission the protocol (further - the protocol of the Commission) is taken in which are reflected: date, time and the venue of meeting, surname, name, middle name (in case of its availability) certified, result of testing.

14. The candidate discharged of the testing having the right to submit repeatedly the application for the admission to the following certification.

15. Calculation of the correct answers of testing is made by means of the used computer program automatically. Results of testing are printed in duplicate and are provided to the candidate directly for acquaintance by putting down of the personal signature after the termination.

One copy of leaf with results of testing is handed to the candidate, the second is given to Certifying commission.

16. The applicant is considered passed test if the number of the correct answers makes 70% and above from total number of the asked questions.

By results of testing the executive in charge prepares the protocol and within two working days directs it to the signature to the head of the structural unit and the authorized person of the service provider.

The protocol is signed by the commission chairman and his deputy.

The protocol goes to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.

17. Certification is carried out within 7 working days of the last month of the corresponding half-year.

18. At the choice of uslugopoluchatel the state service appears, by the principle of "one statement" in total with the state service "Issue of the Certificate of the Patent Agent" based on the statement for the admission to certification of the candidate for patent agents and issue of the certificate of the patent agent for form, according to appendix 5 to these rules.

Paragraph 3. Issue of the certificate of the patent agent

19. State service "Issue of the Certificate of the Patent Agent".

20. For receipt of the certificate of the patent agent the candidate directs the following documents through the web portal of "the electronic government":

1) the statement for receipt of the certificate of the patent agent in electronic form certified by the EDS of the candidate in the state or Russian languages in form according to appendix 6 to these rules;

2) the document confirming payment of the state fee for registration as the patent agent.

The service provider receives data on the identity document of uslugopoluchatel, information on payment of the state fee through PShEP from the corresponding state information systems through lock of "the electronic government".

When giving the uslugopoluchatel of all necessary documents in "personal account" of uslugopoluchatel displays the status about acceptance of request for provision of the state service.

The certificate of the patent agent is granted within three working days.

When rendering the state service in the principle of "one statement" from the date of provision of the document confirming payment of the state fee for registration as the patent agent.

21. The list of the main requirements to rendering the state service "Issue of the Certificate of the Patent Agent" is provided according to appendix 7 to these rules.

22. The authorized body in day of receipt of documents performs their acceptance and registration.

In case of the address of the applicant after the termination of working hours, in days off and holidays according to the labor law, reception of applications and issue of results of rendering the state service is performed the next working afternoon.

The service provider checks completeness and compliance of the submitted documents, stipulated in Item 20 these rules. In case of representation uslugopoluchately incomplete document package according to Item 20 of these rules and (or) documents with the expired effective period, the service provider sends to uslugopoluchatel the notification with indication of what requirements there does not correspond the document package.

Reduction term in compliance of the documents specified in the notification constitutes one working day.

If within one working day from the date of receipt of the notification the uslugopoluchatel did not bring it into accord with requirements, then the service provider directs refusal in further review of the statement.

The service provider by results of verification of documents draws up the certificate of the patent agent in form according to appendix 8 to these rules and sends for approval to the head of the structural unit within one working day.

23. The result of rendering the state service after signing by the authorized person of the service provider goes to uslugopoluchatel to personal account within one working day.

Paragraph 4. Registration in the register of patent agents and entering of changes into it

24. The information about the patent agents who received certificates and subsequent changes of information about them is entered in the Register. The register is kept by authorized body and is placed on Internet resource of authorized body.

25. The Register contains the following data:

1) the sequence number of registration which is certificate number;

2) registration date of the patent agent;

3) surname, name, middle name (in the presence) patent agent;

4) permanent place residence;

5) number and date of the solution of Certifying commission (the document based on which registration is made);

6) the address for correspondence, and also phone number, the teletype, the telefax if those are available, correspondence language(s);

7) place of employment, position;

8) data on issue or sending certificate;

9) data on suspension;

10) data on exception of the Register.

26. In case of change of the data of the patent agent specified in Item 25 of these rules the patent agent in a month from the moment of changes of such data, reports about it to authorized body.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the service provider and (or) his officials concerning rendering the state service

27. The claim to the decision, actions (failure to act) of staff of structural divisions of authorized body moves addressed to the head of the service provider and (or) in authorized body by assessment and control of quality of rendering the state services (further – the body considering the claim) according to the legislation of the Republic of Kazakhstan.

Consideration of the claim concerning rendering the state services is made by the higher administrative authority, the official, body considering the claim.

Claims moves to the service provider and (or) the official whose decision, action (failure to act) are appealed.

Uslogodatel the official whose decision, action (failure to act) are appealed, no later than three working days from the date of receipt of the claim send it and administrative case to the body considering the claim.

At the same time the service provider, the official, the decision, action (failure to act) are appealed, does not send the claim to the body considering the claim if he within three working days makes the decision or administrative action which are completely meeting the requirements specified in the claim.

The claim of uslugopoluchatel which arrived to the service provider according to the subitem 2) of Item 3 of article 25 of the Law of the Republic of Kazakhstan "About the state services" is subject to consideration within five working days from the date of its registration.

The claim of uslugopoluchatel which arrived to body, considering the claim, is subject to consideration within fifteen working days from the date of its registration.

28. In disagreement cases with results of the rendered state service the uslugopoluchatel takes a legal action according to the procedure, established by the legislation of the Republic of Kazakhstan.

The portal - round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays, reception of an application and issue of result of rendering the state service is performed the next working afternoon according to the labor law of the Republic of Kazakhstan).

9	The bases for refusal in rendering the state service established by the legislation of the Republic of Kazakhstan	1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them; 2) discrepancy of uslugopoluchatel and (or) the provided materials, objects, supplied and the information necessary for rendering the state service, to the requirements established by regulatory legal acts of the Republic of Kazakhstan; 3) concerning uslugopoluchatel there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring receipt of certain state service which took legal effect.
10	Other requirements taking into account features of rendering the state service	Addresses of places of rendering the state service are placed on Internet resource of the service provider – www.adilet.gov.kz, the Section "State Services". Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of portal "personal account", and also Single contact center. At the choice of uslugopoluchatel the state service appears, by the principle of "one statement" in total with the state service "Issue of the Certificate of the Patent Agent" in form, according to appendix 5 to these rules. 9	The bases for refusal in rendering the state service established by the legislation of the Republic of Kazakhstan	If representation by uslugopoluchatel of incomplete document package according to Item 8 of this Appendix and (or) documents with the expired effective period, the service provider sends to uslugopoluchatel the notification with indication of what requirements there does not correspond the document package. Reduction term in compliance of the documents specified in the notification constitutes one working day. If within one working day from the date of receipt of the notification the uslugopoluchatel did not bring it into accord with requirements, then the service provider directs refusal in further review of the statement.
10	Other requirements taking into account features of rendering the state service including rendered electronically and through the State corporation	When rendering the state service in the principle of "one statement" the term of rendering the state service is estimated from the date of provision of the document confirming payment of the state fee for registration as the patent agent.
