About modification and amendments in the resolution of Board of National Bank of the Republic of Kazakhstan of December 22, 2017 No. 245 "About approval of the list, forms, terms of the reporting of the insurance (reinsurance) organization and insurance broker and Rules of their representation"
According to the laws of the Republic of Kazakhstan of March 30, 1995 "About National Bank of the Republic of Kazakhstan", of December 18, 2000 "About insurance activity", of July 4, 2003 "About state regulation, control and supervision of the financial market and the financial organizations" and of March 19, 2010 "About the state statistics" and for the purpose of enhancement of the legislation on insurance and insurance activity the Board of National Bank of the Republic of Kazakhstan DECIDES:
1. Bring in the resolution of Board of National Bank of the Republic of Kazakhstan of December 22, 2017 No. 245 "About approval of the list, forms, terms of the reporting of the insurance (reinsurance) organization and insurance broker and Rules of their representation" (registered in the Register of state registration of regulatory legal acts at No. 16256, published on January 30, 2018 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan) the following changes and amendments:
add Item 1 with subitems 4-1) and 4-2) in the following edition:
"4-1) report form about the securities acquired for the asset account of insurers within insurance contracts, providing condition of participation of the insurer in investments in form according to appendix 4-1 to this resolution;
4-2) report form about the insurance contracts providing condition of participation of the insurer in investments in form according to appendix 4-2 to this resolution;";
21) of Item 1 to state the subitem in the following edition:
"21) report form about transactions with the faces tied with the insurance (reinsurance) organization, the Islamic insurance (reinsurance) organization the special relations on form according to appendix 21 to this resolution;";
26) of Item 1 to state the subitem in the following edition:
"26) report form about the insurance contracts and reinsurance concluded with the faces tied with the insurance (reinsurance) organization, the Islamic insurance (reinsurance) organization the special relations in form according to appendix 26 to this resolution;";
add Item 1 with subitem 36-1) in the following edition:
"36-1) report form about contracts of reinsurance with participation of the insurance nonresident brokers of the Republic of Kazakhstan who are affiliirovanny persons of insurance broker of the Republic of Kazakhstan and on conditions of placement by the insurance nonresident broker of the Republic of Kazakhstan of insurance risks for reinsurance to the reinsurance nonresident organizations of the Republic of Kazakhstan for form according to appendix 36-1 to this resolution;";
1) of Item 2 to state the subitem in the following edition:
"1) monthly - the reporting provided by subitems 2), 4), 4-1), 4-2), 6), 7), 8), 10), 11), 12), 13), 14), 15), 16), 17), 18), 19), 23) and 28) Item 1 of this resolution till the sixth working day (inclusive) the month following month under report.";
state Item 3 in the following edition:
"3. The insurance broker represents to National Bank of the Republic of Kazakhstan quarterly the reporting in electronic format provided by subitems 35), 36) and 36-1) Items 1 of this resolution till the sixth working day (inclusive) the month following reporting quarter.";
to add appendix 1 "List of the reporting of the insurance (reinsurance) organization and insurance broker" with the subitem 36) in the following edition:
"36) the report on contracts of reinsurance with participation of the insurance nonresident brokers of the Republic of Kazakhstan who are affiliirovanny persons of insurance broker of the Republic of Kazakhstan and on conditions of placement by the insurance nonresident broker of the Republic of Kazakhstan of insurance risks on reinsurance to the reinsurance nonresident organizations of the Republic of Kazakhstan.";
in form according to appendix 1 to state the list of the reporting of the insurance (reinsurance) company and insurance broker in edition according to appendix 1 to this resolution;
in form according to appendix 1 to state the list of the reporting of the insurance (reinsurance) company and insurance broker in edition according to appendix 2 to this resolution;

on form according to appendix 3 to state the report on remaining balance of the money and deposits placed for the asset account of Islamic insurance fund in edition according to appendix 5 to this resolution;

to state the report on securities on form according to appendix 4 in edition according to appendix 7 to this resolution;

to state the report on the signed insurance contracts with participation of insurance brokers of the Republic of Kazakhstan in form according to appendix 36 in edition according to appendix 57 to this resolution;
add with the report on contracts of reinsurance with participation of the insurance nonresident brokers of the Republic of Kazakhstan who are affiliirovanny persons of insurance broker of the Republic of Kazakhstan and on conditions of placement by the insurance nonresident broker of the Republic of Kazakhstan of insurance risks on reinsurance to the reinsurance nonresident organizations of the Republic of Kazakhstan for form according to appendix 36-1 in edition according to appendix 58 to this resolution.
2. To department of researches and statistics (Tutushkin V. A.) in the procedure established by the legislation of the Republic of Kazakhstan to provide:
1) together with Legal department (Sarsenov N. V.) state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration of this resolution of its direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) placement of this resolution on official Internet resource of National Bank of the Republic of Kazakhstan after its official publication.
3. To management on consumer protection of financial services and external communications (Terentyev A. L.) provide within ten calendar days after state registration of this resolution the direction it to the copy on official publication in periodic printing editions.
4. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Kurmanov Zh. B.
5. This resolution becomes effective after ten calendar days after day of its first official publication, except for paragraphs two, third, fourth, eleventh, twelfth, seventeenth, twenty fifth and twenty seventh Item 1 of this resolution which become effective since October 1, 2018 and paragraphs of the fifth, sixth, seventh, eighth, eighteenth, twentieth, twenty second, twenty fourth, twenty sixth, twenty ninth, thirty first, thirty third, thirty seventh, fortieth, forty fourth, forty sixth, forty eighth, fiftieth, fifty second, fifty fifth, sixty first, sixty third and sixty eighth Item 1 of this resolution which become effective since January 1, 2019. Paragraphs fifteen and sixteen Item 1 of this resolution are effective till October 1, 2018. Paragraphs seventeen, nineteen, twenty one, twenty three, twenty five, twenty eight, thirty, thirty two, thirty six, thirty nine, forty three, forty five, forty seven, forty nine, fifty one, fifty four, sixty, sixty two and sixty seven Item 1 of this resolution are effective till January 1, 2019.
