1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of March 27, 2015 No. 364 "About approval of Rules of medical examination of crew members of the vessel, requirements to condition of their health and physical suitability, and also form of the medical certificate" (it is registered in the Register of state registration of regulatory legal acts for No. 11546, it is published on September 9, 2015 in information system of law of Ad_let) the following changes:

The rules of medical examination of crew members of the vessel approved by the specified order to state in edition according to appendix 1 to this order;

The requirements to the state of health and physical suitability of members of crews of the vessel approved by the specified order to state in edition according to appendix 2 to this order;

to state the form of the medical certificate approved by the specified order in edition according to appendix 3 to this order.

2. To provide to committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of medical examination of crew members of the vessel

Chapter 1. General provisions

1. These rules of medical examination of crew members of the vessel (further - Rules) are developed according to subitem 55-28) of Item 3 of article 4 of the Law of the Republic of Kazakhstan of January 17, 2002 "About merchant shipping", the Rules I/9 of the International convention about preparation and certification of seamen and execution of watch, 1978, with amendments (further - the Convention) and determine procedure for performing medical examination of crew members of the vessel (further - medical examination).

2. Requirements of Rules extend to members of crews of ocean ships.

3. Medical examination is performed in the medical organizations having qualified specialists, and also material resources for implementation of complete amount of laboratory and functional researches.

4. Each five years the doctor responsible for performing medical examination and issue of the medical certificate (further - the Doctor) who has retraining on professional pathology and the certificate of the specialist (pathologist) is appointed by the order of the head of the medical organization performing medical examination.

The copy of the order on appointment of the Doctor or his replacement (with indication of the reason) within five working days from the date of its approval goes to authorized body in the field of merchant shipping.

The authorized body in the field of merchant shipping constitutes the list of Doctors and places on the Internet resource: www.mid.gov.kz.

5. Medical examination is performed according to these rules.

The doctor is guided by Requirements to the state of health and physical suitability of members of crews of the vessel.

6. During medical examination the Doctor uses complete professional independence.

7. The purpose of medical examination of alternate members of crew of the vessel is determination of their suitability for health reasons to professional job.

The purpose of medical examination of the acting crew members of the vessel are:

1) dynamic observation of the state of health of persons working at courts;

2) timely detection of diseases, including professional, interfering further work in courts;

3) control of holding the preventive and rehabilitation actions directed to preserving health and recovery of working ability of workers;

4) diagnostics and prevention of spread of infectious and parasitic diseases.

8. Medical examination is performed every two years, for persons of not reached eighteen years - annually.

9. The medical organization within three working days provides in Sea port administration the copy of the issued medical certificate for introduction it in the register of professional diplomas, confirmations of professional diplomas and preferential permissions (further - the Register) according to the Rules of maintaining registers of identity certificates of the seaman of the Republic of Kazakhstan, professional diplomas, confirmations of professional diplomas, preferential permissions, seaworthy books approved by the order of the Minister of investments and development of the Republic of Kazakhstan of March 31, 2015 No. 417 (it is registered in the Register of state registration of regulatory legal acts for No. 11033).

10. The sea port administration recognizes foreign medical certificates in cases when between the Republic of Kazakhstan and the state which issued this conclusion there is the relevant agreement according to the Rules I/10 of the Convention if in the specified agreement other is not specified.

Chapter 2. Procedure for medical examination

11. Members of crews of vessel not more young and the acting members of crews of vessel are subject than sixteen years to medical examination.
