1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 197 "About approval of Rules of certification and issue of the certificate of the organization for maintenance and repair of the aircraft equipment of civil aviation" (it is registered in the Register of state registration of regulatory legal acts for No. 11722, it is published on September 1, 2015 in information system of law of Ad_let) the following change:

The rules of certification and issue of the certificate of the organization for maintenance and repair of the aircraft equipment of civil aviation approved by the specified order to state in edition according to appendix to this order.

2. To provide to committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of certification and issue of the certificate of the organization for maintenance and repair of the aircraft equipment of civil aviation

Chapter 1. General provisions

1. These rules of certification and issue of the certificate of the organization for maintenance and repair of the aircraft equipment of civil aviation (further - Rules) are developed according to subitem 41-25) of Item 1 of Article 14, and also article 48 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) and aviation standards of the International organization in the field of civil aviation (further - ICAO).

2. These rules determine procedure for certification, issue of the certificate of the organization for maintenance and repair of the aircraft equipment of civil aviation, and also procedure for recognition of certificates of the foreign organizations for maintenance and repair of the aircraft equipment.

3. The certificate of the organization for maintenance and repair of the aircraft equipment of civil aviation (further - the certificate) is inaliennable and is not transferred to other person.

To legal entities carrying out maintenance and repair of the aircraft equipment of civil aviation without availability of the existing certificate is not allowed.

4. The certificate of the organization for maintenance and repair of the aircraft equipment in form, according to appendix 1 to these rules (further - the certificate) is issued for two years with indication of the sphere and effective period. After effective period, the certificate is considered not valid.

5. Certification of the organization for maintenance and repair of the aircraft equipment of civil aviation (further - certification) and issue of the certificate is performed by authorized body in the field of civil aviation.

6. In these rules the following terms and determinations are used:

1) the aircraft equipment - complex of aviation technical means (aircrafts, their onboard equipment and aggregates, engines, aviation survival equipment, complex exercise machines (flight simulators), components, technical means of air traffic control, navigation of landing and communication, and also the means of land ensuring common and special application intended for accomplishment of flight, the organization of air traffic control and land ensuring flights;

2) the certificate on maintenance and repair of the aircraft equipment (further - the certificate on TO and PAT) - the document of the established sample certifying compliance of the organization for maintenance and repair of the aircraft equipment to certified requirements;

3) authorized body in the field of civil aviation (further - authorized body) - the central executive body performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

4) management according to procedures of the organization of maintenance and repair of the aircraft equipment of civil aviation - the document approved by the head of the organization for maintenance and repair of the aircraft equipment and containing the detailed information about structure of the organization for maintenance and repair of the aircraft equipment and obligations of its management, the sphere of the performed works, production base, procedures of maintenance and systems of quality assurance;

5) repair of the aircraft equipment - complex of transactions on recovery of operability and operability of the aircraft equipment;

6) the state aviation inspector - the official of authorized body in the field of civil aviation authorized on implementation of certification, the state control and supervision in the field of civil and experimental aviation;

7) the quality system - set of organizational structure, the documentary techniques, processes and resources necessary for implementation of managerial control by quality of maintenance and repair of the aircraft equipment;

8) maintenance - work, necessary for ensuring preserving the flight validity of the aircraft, including control recovery work, checks, replacements, elimination of defects which are carried out as separately, and in combination, and also practical implementation of modification;

9) the flight validity - the technical condition of the aircraft corresponding to flight technical characteristics which ensure its safety and flight quality;

10) safety management system of flights - system approach to safety management of flights, including necessary organizational structure, hierarchy of responsibility, the guidelines and procedures (Chapter 1 of Appendix 6 to the Chicago convention ICAO).

7. For certification collection according to the procedure and the sizes determined by the Code of the Republic of Kazakhstan of December 10, 2008 "About taxes and other obligatory payments in the budget" (Tax code) is levied.

Chapter 2. Procedure for carrying out

Certifications and issues of the certificate on maintenance and repair of the aircraft equipment of civil aviation

8. For certification passing the applicant submits to authorized body the application for receipt of the certificate to maintenance and repair of the aircraft equipment of civil aviation in form, according to appendix 2 to these rules (further - the Statement):

1) in case of planned certification (initial or on expiration of earlier issued certificate);

2) in need of expansion of field of activity of the organization.

Copies of documents according to the List of the documents attached to the request for receipt of the certificate of the organization for maintenance and the repair of the aircraft equipment of civil aviation specified in appendix 3 to these rules are enclosed to the application (further - the List).

9. Aggregate term of certification does not exceed twenty two working days from the date of receipt of the statement in authorized body. When carrying out additional studying or check by the state aviation inspectors is necessary, the term of consideration can be prolonged no more than for twenty two working days about what it is reported to the applicant within three working days from the moment of decision making about prolongation of term of consideration.

10. The authorized body in time five working days checks compliance of the statement and List to requirements of Item 8 of these rules by results of which:

in case of compliance directs to the applicant Resheniye according to the statement to receipt of the certificate of the organization for maintenance and repair of the aircraft equipment (TO and PAT) of civil aviation in form according to appendix 4 to these rules (further - Resheniye);

in case of discrepancy returns to the applicant documents with indication of the reasons for completion.

11. Certified inspection is performed by the state aviation inspectors as whom questions of operation, maintenance and maintenance of the flight validity of aircrafts belong.

The term of certified inspection does not exceed fifteen working days.

12. Certified examination is conducted in relation to the declared spheres of activity of the organization for maintenance and repair of the aircraft equipment of civil aviation specified in appendix 5 to these rules and characteristics of the organization.

Certified inspection is performed with use of the program of certified inspection of the organizations for maintenance and repair of the aircraft equipment of civil aviation in form, according to appendix 6 to these rules (further - the Program).
