According to the laws of the Republic of Uzbekistan of September 19, 2016 "About modification and amendments in the Law of the Republic of Uzbekistan "About protection and use of fauna"" of September 21, 2016 No. ZRU-409 "About modification and amendments in the Law of the Republic of Uzbekistan "About protection and use of flora"" and for the purpose of enhancement of procedure for conducting the state accounting, accounting of amounts of use and the state inventory of objects of biodiversity, implementation of modern technologies for collection, processing and storage of the cadastral information, settlement of conducting the state accounting and the inventory of objects of animal and flora the Cabinet of Ministers decides No. ZRU-408:

1. Approve:

Regulations on procedure for conducting the state accounting, accounting of amounts of use and the state inventory of objects of fauna according to appendix No. 1;

Regulations on procedure for conducting the state accounting, accounting of amounts of use and the state inventory of objects of flora according to appendix No. 2.

2. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 3.

3. To the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

4. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzbekiston temir yullari A. Zh. Ramatov, the chairman of the State committee of the Republic of Uzbekistan on ecology and environmental protection B. T. Kuchkarov and the chairman of the State committee of the Republic of Uzbekistan on land resources, geodesy, cartography and the state inventory A. H. Abdullaev.

Regulations on procedure for conducting the state accounting, accounting of amounts of use and state inventory of objects of fauna

Chapter 1. General provisions

1. This Provision establishes procedure for conducting the state accounting, accounting of amounts of use and the state inventory of objects of fauna.

2. In this Provision the following concepts are applied:

biological diversity is the specific variety of all fauna (animals, plants, microorganisms) including variety within type between types and variety of ecosystems;

bases of geodata - the information containing data on location of objects of the area, provided in electronic graphical and/or text forms and systems of coordinates;

the state accounting of objects of fauna - information collection about the wild animals living in condition of natural freedom and their current quantitative and high-quality characteristics which are subject of use or influencing the ecological circle of the region, or carried to rare and endangered species within certain territory, with reflection of these data in accounting and cadastral documents;

the state inventory of objects of fauna - the system of regularly updated information based on data of the state accounting of objects of fauna and amounts of their use, containing data on their geographical distribution, specific structure, number, other quantity and quality characteristics, the habitat, economic use, economic evaluation;

wild animals are invertebrates, fishes, Amphibia, reptiles, birds, mammals who were not exposed to domestication, living on the land in water, the atmosphere and the soil;

cadastral inspection of the territory - accounting of objects of fauna on scientific basis for the purpose of collection of primary information on quantity and quality characteristics, geographical distribution, use, circle condition of their dwelling, economic evaluation;

the book of registration of accounting and other data on fauna objects - the book containing the code of data on fauna objects, their specific structure and number, the habitat of animals, geographical distribution, quality and quantity characteristics, habitat condition, economic evaluation, etc.;

subject of the state inventory of fauna - the wild animal who is living in condition of natural freedom in the territory of the Republic of Uzbekistan, subject to the state accounting;

primary collection of the cadastral information - is performed by primary inspection of the habitat of animals, accounting of the animals and factors which are negatively influencing their condition which data are used for comparison happening to fauna and the circle of their dwelling of changes;

the subject of the state accounting of objects of fauna - authorized state body and the legal entity performing in accordance with the established procedure collection, forming and provision of information on wild animals within certain territory;

the current collection of the cadastral information - annual accounting of animals in the territory of primary inspection for identification of the happened quantitative and high-quality changes, entering of data into the state inventory of objects of fauna;

forming of the main cadastral information - process of primary registration of accounting and other data on the objects of fauna received on the basis of cadastral inspection of the territory;

forming of the current cadastral information - process of modification of the cadastral information on the basis of accounting and other data on the objects of fauna received as a result of the state accounting of objects of fauna and amounts of their use;

economic evaluation of objects of fauna - determination in monetary units of the maximum economic effect of use of this type of wild animal.

3. This the state accounting of objects of fauna, accounting of amounts of their use, the state inventory of objects of fauna are basis for implementation of planning of actions for preserving, use, protection, reproduction and recovery of objects of fauna and the circle of their dwelling.

4. The state inventory of objects of fauna is kept for the purpose of:

determinations of quantitative and high-quality condition of objects of fauna;

economic evaluation of objects of fauna;

determinations of amounts of economic use of objects of fauna;

provisions to the state bodies interested to legal entities and physical persons of reliable information about condition of objects of fauna;

organizations of preserving, rational, steady use, protection, reproduction and recovery of objects of fauna and preserving their biological diversity;

ensuring control of observance of requirements for preserving, use, protection, reproduction and recovery of objects of fauna, circle their dwelling.

5. The state inventory of objects of fauna includes:

data on distribution of objects of fauna, condition of their populations, quantity and quality characteristics;

data on nature and amounts of economic use of objects of fauna;

distribution maps of objects of fauna;

economic evaluation of objects of fauna;

the habitats of objects of fauna this about condition;

the regulating requirements for systematization, storage, updating and operational issue in accordance with the established procedure the cadastral information to the interested users in the corresponding forms and amounts;

other information on fauna objects.

6. The basic principles of maintaining the state inventory of objects of fauna are:

scope of all types (subspecies) of the wild animals who are subject to inclusion in the state inventory and living in all territory of the Republic of Uzbekistan;

application of single system of space coordinates;

unity of technique of collection, technology of processing and provision of information;

centralized management of maintaining the state inventory;

providing requirements of the Single system of the state inventories;

reliability of the cadastral information.

7. Maintaining the state inventory of objects of fauna is performed by the State committee of the Republic of Uzbekistan on ecology and environmental protection (further - Goskomecologies) together with Academy of Sciences of the Republic of Uzbekistan (further - Academy of Sciences).

Scientific ensuring maintaining the state inventory of objects of fauna is performed by Academy of Sciences.

8. When maintaining the state inventory of objects of fauna the data obtained as a result of cadastral inspection of the territory, the state accounting of objects of fauna, accounting of amounts of their use, circle condition of their dwelling, and also the research and other works necessary for maintaining the state inventory of objects of fauna are used.

9. The state inventory of objects of fauna considers all types of wild animals, being subject of use or influencing the ecological circle of the region, or having the status rare and being under the threat of extinction of species.

10. The list of types of the wild animals who are subject to the state accounting, accounting of amounts of their use and inclusion in the state inventory of objects of fauna affirms Goskomecology in coordination with Academy of Sciences.

11. In national parks, complex (landscape) wildlife areas, natural parks and biological wildlife areas, the state biospheric wildlife reserves, natural nurseries the state accounting and the state inventory of objects of fauna is conducted concerning all types of objects of fauna.

12. Accounting and registration and estimative information constitutes set of the cadastral information on fauna which is provided in alphanumeric (texts, tables) and graphical (cards, schemes) forms, in paper and electronic (base of geodata) options.

13. State bodies obtain the cadastral information on a grant basis, and the interested legal and physical persons patches in the sizes established by the Cabinet of Ministers of the Republic of Uzbekistan.

14. Conducting the state accounting of objects of fauna and accounting of amounts of their use, the state inventory of objects of fauna is performed at the expense of means of the Government budget of the Republic of Uzbekistan on the basis of the annual target financing and other sources which are not prohibited by the legislation.

15. Amounts and terms of financing of works on conducting the state accounting, accounting of amounts of use and the state inventory of objects of fauna are determined according to the procedure, stipulated by the legislation.

16. Performs Goskomecologies:

coordination of maintaining the state inventory of objects of fauna;

development of normative and methodical documentation;

determination of procedure and conditions of use of information of the state inventory of objects of fauna of legal entities and physical persons.

Chapter 2. Procedure for cadastral inspection of the territories, state accounting and accounting of amounts of use of objects of fauna

17. Primary collection of the cadastral information on the state inventory of objects of fauna is performed by cadastral inspection of the territory.

18. In case of cadastral inspection of the territory data on fauna objects, and also the circle of their dwelling are determined.

During cadastral inspection of the territory the inventory of objects of fauna, collection of information about their specific structure, gender and age condition, quantity and quality characteristics, the habitat, economic use is performed, the economic evaluation is carried out, schematic maps of territorial distribution are constituted.

The listed data are entered in the book of registration of accounting and other data on objects of fauna and transferred to Goskomecologies for forming and updating of the state inventory of objects of fauna.

19. Cadastral examination of the territory of the habitat of objects of fauna is conducted once in five years.

If effects of natural disasters, technogenic accidents, fires and other events led to mass death of animals or change of the habitat of animals, extraordinary cadastral examination of the territory in the places subjected to negative impact of the specified events is conducted.

20. Cadastral inspection of the territory, including the state accounting of objects of fauna, is performed:

Academy of Sciences - by the rare and being under the threat of disappearance types of wild animals - in all territory of the Republic of Uzbekistan;

structural divisions of the State committee of the Republic of Uzbekistan on forestry (further - Goskomles) - on lands of forest fund, including accounting of animals wreckers of forestry;

national parks, complex (landscape) wildlife areas, natural parks, the state biospheric wildlife reserves, biological wildlife areas and natural nurseries - in the territory of the specified protected natural territories;

hunting-fishing farms - in the territory of these farms;

the fishing organizations - on the provided water objects or their parts;

Uzbekbaliksanoat association, Directorate of Aydar-Arnasaysky system of lakes - on trade species of fish;

The republican center of prevention of plague, quarantine and especially dangerous infections of the Ministry of Health of the Republic of Uzbekistan - on animals carriers of especially dangerous infectious diseases;

The Ministry of Agriculture of the Republic of Uzbekistan (further - the Ministry of Agriculture) - on animals wreckers of agricultural industry;

the scientific, educational organizations and specialists biologists on contractual basis from Goskomecology - in other territory.

21. The state accounting of objects of fauna represents complex of regularly held events necessary for receipt of information on specific variety of objects of fauna, number and their distribution for the purpose of observation of changes of condition of objects of fauna and the circle of their dwelling.

22. The interested ministries, departments and other organizations annually create the list of legal entities - users fauna, with indication of their name, departmental accessory, locations which will carry out the state accounting next year and no later than November 1 represent it to Goskomecologies.

23. State bodies, legal entities - users can attract with objects of fauna to carrying out annual state accounting of objects of fauna other organizations or specialists on contractual basis.

24. In case of the current information collection which is carried out by subjects of the state accounting of objects of fauna on places during the state accounting, accounting of amounts of their use are fixed and all further changes which happened after carrying out cadastral inspection of the territory are annually made to the inventory.

25. The state accounting of objects of fauna is carried out annually.

26. When implementing the state accounting of objects of fauna (the current collection of the cadastral information), authorized persons of subjects of the state accounting of objects of fauna fix and introduced in the book of registration of accounting and other data information on fauna objects, the circle of their dwelling, and also all changes which happened after carrying out cadastral inspections of the territory.

27. Accounting of amounts of use of objects of fauna is performed concerning the use connected with withdrawal of animals or their parts from the environment.

28. Accounting of amounts of use of objects of fauna is performed on the basis of the following data:

on permissions to getting of objects of fauna - to quantity of the got animals or their parts from the circle of their dwelling;

by quantity of the caught fish amateur fishermen;

on materials about illegal production of animals.

29. Accounting of amounts of use of objects of fauna is performed:

structural divisions of Goskomles - regarding use in the territory of forest fund;

hunting-fishing farms - in the territory of these farms;

the fishing organizations - on the provided water objects or their parts;

authorized divisions of Goskomecology - in all other territory of the Republic of Uzbekistan.

Data of accounting of amounts of use of objects of fauna are represented to Goskomecologies.

30. Cadastral inspection of the territory, the state accounting of objects of fauna and accounting of amounts of their use are carried out on the basis of the methods of their carrying out approved Goskomecologies in coordination with Academy of Sciences. One method shall be applied to ensuring comparability of earlier obtained data with the subsequent data.

31. The ministries, departments and the organizations conducting cadastral inspection of the territory, the state accounting of objects of fauna and accounting of amounts of their use gratuitously provide necessary information for maintaining the state inventory of objects of fauna in Goskomecology.

Types, amounts and terms of provision of necessary information on the state inventory of objects of fauna are established Goskomecologies.

Authorized bodies keep books of registration of accounting and other these objects of fauna according to the instruction according to appendix No. 1 to this Provision.
