According to part two of article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity in the field of geological studying and rational use of subsoil is estimated and frequency of implementation of planned actions of the state supervision (control) by Public service of geology and subsoil which are applied is determined.

2. Recognize to invalid:

the resolution of the Cabinet of Ministers of Ukraine of November 5, 2014 "About approval of criteria by which the risk degree from implementation of economic activity in the field of geological studying and rational use of subsoil is estimated and is determined No. 593 frequency of implementation of planned actions of the state control by Public service of geology and subsoil" (The Official Bulletin of Ukraine, 2014, No. 90, the Art. 2585);

Item of 24 changes which are made to resolutions of the Cabinet of Ministers of Ukraine, approved by the resolution of the Cabinet of Ministers of Ukraine of December 18, 2017 No. 1103 (The Official Bulletin of Ukraine, 2018, No. 17, the Art. 573).

Criteria by which the risk degree from implementation of economic activity in the field of geological studying and rational use of subsoil is estimated and frequency of implementation of planned actions of the state supervision (control) by Public service of geology and subsoil is determined

1. Criteria by which the risk degree from implementation by subjects of managing of economic activity in the field of geological studying and rational use of subsoil is estimated are:

1) during implementation of construction and operation of the underground constructions which are not connected with mining including constructions for underground oil storage, gas and other substances and materials, burial of hazardous substances and production wastes, dumping of sewage:

type of object of accounting which is used by the subject of managing;

availability of violations of requirements of the legislation in the field of geological studying and rational use of the subsoil revealed during the last scheduled inspection;

2) during production of underground waters, therapeutic muds, brine and brines:

type of minerals which are extracted by the subject of managing;

the region (according to balance sheet operational inventories depending on quantity of inventories in subsoil);

well depth (for mineral and drinking waters);

availability of violations of requirements of the legislation in the field of geological studying and rational use of the subsoil revealed during the last scheduled inspection:

- for mineral and drinking waters;

- for industrial, technical and heat power waters, therapeutic muds, brine and brines;

3) during hydrocarbon production:

type of minerals which are extracted by the subject of managing;

useful life of the field subject of managing;

depth of well which is operated by the subject of managing;

availability of violations of requirements of the legislation in the field of geological studying and rational use of the subsoil revealed during the last scheduled inspection;

4) during production of metal ores, nonmetallic minerals, solid combustible minerals:

type of minerals which are extracted by the subject of managing;

method of development by the subject of managing of the mineral deposit;

depth of minerals which are extracted by the subject of managing;

availability of violations of requirements of the legislation in the field of geological studying and rational use of the subsoil revealed during the last scheduled inspection;

5) during geological studying, including trial development, underground waters, therapeutic muds, brine and brines:

type of use of natural resources by the subject of managing;

type of minerals concerning which the subject of managing carries out geological studying, including trial development;

well depth (for mineral and drinking waters);

availability of violations of requirements of the legislation in the field of geological studying and rational use of the subsoil revealed during the last scheduled inspection:

for mineral and drinking waters;

- for industrial, technical and heat power waters, therapeutic muds, brine and brines;

6) during geological studying, including trial development of hydrocarbons:

type of use of natural resources by the subject of managing;

type of minerals concerning which the subject of managing carries out geological studying, including trial development;

well depth;

availability of violations of requirements of the legislation in the field of geological studying and rational use of the subsoil revealed during the last scheduled inspection;

7) during geological studying, including trial development, metal ores, nonmetallic minerals, solid combustible minerals:

type of use of natural resources by the subject of managing;

type of minerals concerning which the subject of managing carries out geological studying, including trial development;

depth of minerals concerning which geological studying, including trial development is carried out;

availability of violations of requirements of the legislation in the field of geological studying and rational use of the subsoil revealed during the last scheduled inspection;

8) during creation of the geological territories and objects having important scientific, cultural, sanitary and improving value (scientific testing grounds, geological reserves, wildlife areas, nature sanctuaries, medical, improving institutions and so forth):

availability of minerals;

type of minerals for which special permission to use of natural resources is got;

availability of violations of requirements of the legislation in the field of geological studying and rational use of the subsoil revealed during the last scheduled inspection.

2. Risks of approach of negative effects from implementation of economic activity in the field of geological studying and rational use of subsoil are determined in appendices 1 - 8.

3. The list of criteria by which the risk degree from implementation of economic activity in the field of geological studying and rational use of subsoil is estimated their indicators and the number of points are determined by each indicator in appendices 9 - 16.

4. Reference of activities of the subject to high, average or insignificant risk degree is performed taking into account score, added by all criteria determined in appendices 9 - 16, on the following scale:

from 41 to 100 points - high risk;

from 21 to 40 points - to average risk degree;

from 0 to 20 points - to insignificant risk degree.

5. If activities of the subject of managing according to one special permission to use of natural resources are covered by two or more criteria determined in appendices 9 - 16, and can be referred at the same time to two or more risk degrees, such activities belong to more high risk from to what it can be carried.
