About approval of the Regulations on the state environmental assessment

In pursuance of the resolution of the President of the Republic of Uzbekistan of July 13, 2018 No. PP-3852 "About measures for further improvement of rating of the Republic of Uzbekistan in the annual report of the World Bank and the International Finance Corporation "Vedeniye Businessa"", and also for the purpose of creation of more favorable conditions for development of activities of subjects of entrepreneurship, increase in efficiency of the undertaken reforms in creation of the most favorable business climate the Cabinet of Ministers decides:

1. Approve:

Regulations on the state environmental assessment according to appendix No. 1;

the list of types of activity on which the state environmental assessment, according to appendix No. 2 is performed.

2. Determine that the state environmental assessment of the objects which are in production of specialized expert divisions of the State committee of the Republic of Uzbekistan on ecology and environmental protection is performed according to earlier operating procedure.

3. To the state committee of the Republic of Uzbekistan on ecology and environmental protection in a month:

together with the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution;

approve the actions plan on extended coverage of the purposes, content and the practical importance of this resolution among subjects of entrepreneurship and to provide its realization at the scheduled time;

approve in accordance with the established procedure charters of the state unitary enterprise "Center of the State Environmental Assessment" of the State committee of the Republic of Uzbekistan on ecology and environmental protection, the state unitary enterprises "Center of the State Environmental Assessment of the Republic of Karakalpakstan" and "Center of the State Environmental Assessment" of areas and Tashkent (further - the centers of the state environmental assessment), and also at to complete them with highly qualified specialists;

approve payment procedure of work and material stimulation of workers of system of the State committee of the Republic of Uzbekistan on ecology and environmental protection by extrabudgetary funds of the centers of the state environmental assessment.

4. Make changes to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 3.

5. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 4.

6. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzbekiston temir yullari A. Zh. Ramatov and the chairman of the State committee of the Republic of Uzbekistan on ecology and environmental protection B. T. Kuchkarov.

Regulations on the state environmental assessment

Chapter 1. General provisions

1. This Provision determines procedure and the procedure of conducting the state environmental assessment of the materials represented for conducting the state environmental assessment according to the Law of the Republic of Uzbekistan "About environmental assessment".

2. In this Provision the following basic concepts are applied:

the state environmental assessment - type of the environmental assessment performed by specialized expert divisions for the purpose of establishment of compliance to the planned or performed economic and other activity to ecological requirements and determinations of admissibility of realization of object of environmental assessment;

the customer - legal entity or physical person which represents materials and other documentation for the purpose of conducting the state environmental assessment on the performed and planned economic activity;

the planned economic and other activity - any planned activities providing use of natural resources in the course of which impact on components of the surrounding environment can be made;

developer of the state environmental assessment - the legal entity or physical person performing activities for development of the materials represented on the state environmental assessment, the taken place retraining and advanced training of the workers performing activities in the field of environmental protection, in accordance with the established procedure;

ecological requirements - the requirements aimed at providing rational use of natural resources, prevention of negative impact on the environment and health of citizens.

3. Environmental assessment is carried out for the purpose of determination:

compliance to ecological requirements of the predicted economic and other activity at the stages preceding decision making about its realization;

level of ecological danger of the planned or performed economic and other activity which can make or makes negative impact on condition of the surrounding environment and health of citizens;

sufficiency and justification of the provided measures for protection of the surrounding environment and rational use of natural resources.

4. Materials for conducting the state environmental assessment are represented by customers to the relevant specialized expert divisions of the State committee of the Republic of Uzbekistan on ecology and environmental protection (further - Goskomecologies) for their further review in the procedure established by the legislation.

The organization and conducting the state environmental assessment are performed according to the procedure according to appendix No. 1 to this Provision.

The procedure for conducting the state environmental assessment is performed according to the scheme according to appendix No. 2 to this Provision.
