I ORDER:

1. Bring in the order of the Minister of Energy of the Republic of Kazakhstan of February 27, 2015 No. 152 "About approval of Rules of the organization and functioning of the market of electric power" (it is registered in the Register of state registration of regulatory legal acts for No. 10612, No. 29 (28155)) the following change is published in the Kazakhstanskaya Pravda newspaper of February 13, 2016:

the rules of the organization and functioning of the market of electric power approved by the specified order to state in edition according to appendix to this order.

2. To provide to department of power industry and coal industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of the organization and functioning of the market of electric power

Chapter 1. General provisions

1. These rules of the organization and functioning of the market of electric power (further - Rules) are developed according to the subitem 42) of article 5 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" (further - the Law), and determine procedure for the organization and functioning of the market of electric power.

2. In these rules the following concepts and determinations are applied:

1) decrease amount - difference corresponding to the power making organization of the certified electric power determined by results of carrying out extraordinary certifications of power plants of the power making organization, and total electric power of leave in network in MW;

2) the certified electric power - the amount of the certified electric powers of power plants by results of the corresponding certifications, in megawatts (further - MW);

3) the control period - interval of time of calendar day from 17:00 till 23:00 o'clock local time (Monday through Friday, except for holidays);

4) the generating installation - the device developing electrical energy;

5) certification of electric power of the generating installations - the events held by the System operator which are directed to determination of values of the certified electric power and the certified speeds of increase and reduction of electric power;

6) the sheet of working electric powers of generation, technological and technical minima - the document constituted by the System operator on every day in whom values of working electric powers of generation, technological and technical minima of power plants of the power making organizations which signed the contract (agreements) for rendering service in maintenance of readiness of electric power with the single purchaser are reflected;

Total 7) the electric power of leave in network - total electric power less the value of electric power of own needs of power plants, maximum in settlement year, of the power making organization considered in it, in MW;

8) total deductible electric power - the amount of the following parameters specified for the corresponding calendar year in current agreements about purchase of service in maintenance of readiness of electric power of the power making organization: the value of electric power of own consumption, maximum in settlement year, maximum in settlement year of electric power of deliveries to subjects of the retail market and the electric power of export, maximum in settlement year, in MW;

Total 9) electric power - the amount of contractual amount of service in maintenance and total deductible electric power, in MW;

10) planned repair - the planned repair included in the schedule of repairs approved with the System operator;

11) planning system - the set of program technical means intended for transfer by subjects of the wholesale market of electrical energy of requests on production consumption of electrical energy in day ahead, to forming of the daily schedule of production consumption of electrical energy, and also transfer of requests to the day (adjustment of the approved daily schedule);

12) repair capacity - the cumulative established electric power being in all types of repair (is able out of reserve) the generating installations of power plants of the power making organization without the established electric power of the generating installations which are technologically intended for work only on thermal consumption (in case of their availability);

13) regional profile of loading - the algorithm of calculation of hourly values of consumption (balance overflow) of electrical energy of consumers of the market of capacity determined by the regional electric grid company and approved with the system operator;

14) the delta of heating capacity - the part of amount of service in maintenance of readiness of electric power according to the purchase agreement of service in the maintenance of readiness of electric power concluded according to the subitem 3) of Item 11 of these rules having on the generating installations considered in this amount (in case of the set level of their thermal loading) which are technologically intended for work only on thermal consumption in MW;

15) contractual amount of service in maintenance - the amount of the amounts of service in maintenance of readiness of electric power specified for the corresponding calendar year in current agreements about purchase of service in maintenance of readiness of electric power of the power making organization of MW;

16) unavailable capacity - cumulative current restrictions of electric power of generation of the generating installations of the power plants of the power making organization which arose because of emergency stops of coppers or cases of coppers finding in work in MW;

17) the consumers of the market of capacity who - are power supplying, the power transferring organizations and the consumers who are subjects of the wholesale market of electrical energy, including, industrial complexes;

18) the nominal planning repair period - interval of time, (hundred eighty) calendar days lasting 180;

19) the operator of the market of centralized trade - the organization performing the centralized biddings by electrical energy including spot biddings electrical energy, and service in maintenance of readiness of electric power;

20) industrial complex - the organization which is the subject of the wholesale market of electrical energy, incorporating the power plants which are not separate legal entities, development of electrical energy by which it is performed with consumption purpose the companies and associations which are part of this organization and not being separate legal entities and realization in the wholesale and (or) retail markets of electrical energy;

21) admissible sales amount of capacity at the biddings - difference of the certified electric power and the electric power of the power making organization which is not sold at the biddings, in MW;

22) the electric power which is not sold at the biddings - the amount of the amounts of service in maintenance of readiness of electric power specified for the corresponding calendar year in the current agreements about purchase of service in maintenance of readiness of electric power of the power making organization concluded according to subitems 2) and 3) of Item 11 of these rules, and total deductible electric power in MW;

23) the test command - the order this by the System operator of the power making organization on change of electric power of the power plants which are part of the power making organization;

24) technical minimum - the amount of the minimum admissible electric powers of the generating installations: for condensation, heating, gas turbine and steam-gas power plants - under the terms of ensuring stability of their work according to the relevant passport data, for hydraulic power plants - under the terms of providing set by authorized body in the field of use and protection of water fund, water supply, water disposal of expenses of water, in MW;

25) technological minimum - the amount of the minimum electric powers of the generating installations (in case of the set level of their thermal loading), in MW;
