About structural divisions of the Office of the President of the Kyrgyz Republic

For the purpose of enhancement of activities of the Office of the President of the Kyrgyz Republic and ensuring realization of powers of the President of the Kyrgyz Republic, being guided by articles 64 and 65 of the Constitution of the Kyrgyz Republic, I decide:

1. Approve:

- Regulations on the authorized representation of the President of the Kyrgyz Republic in Jogorku Kenesh of the Kyrgyz Republic according to appendix 1;

- Regulations on the secretariat of the Security Council of the Kyrgyz Republic according to appendix 2;

- Regulations on department of policy of public administration and organizational and inspection operation of the Office of the President of the Kyrgyz Republic according to appendix 3;

- Regulations on department of legal support of the Office of the President of the Kyrgyz Republic according to appendix 4;

- Regulations on department of judicial reform and legality of the Office of the President of the Kyrgyz Republic according to appendix 5;

- Regulations on department of foreign policy of the Office of the President of the Kyrgyz Republic according to appendix 6;

- Regulations on department of policy of strategic development, economy and finance of the Office of the President of the Kyrgyz Republic according to appendix 7;

- Regulations on department of civil development, religious and ethnic policy of the Office of the President of the Kyrgyz Republic according to appendix 8;

- Regulations on department of work with addresses of citizens of the Office of the President of the Kyrgyz Republic according to appendix 9;

- Regulations on department of information policy of the Office of the President of the Kyrgyz Republic according to appendix 10;

- Regulations on office of the Office of the President of the Kyrgyz Republic according to appendix 11;

- Regulations on the secretariat of the Commission on the state awards in case of the President of the Kyrgyz Republic according to appendix 12;

- Regulations on the secretariat of the Commission on questions of nationality in case of the President of the Kyrgyz Republic according to appendix 13;

- Regulations on the secretariat of the Commission on pardon questions in case of the President of the Kyrgyz Republic according to appendix 14.

2. Bring in the Presidential decree of the Kyrgyz Republic "About the Office of the President of the Kyrgyz Republic" of January 16, 2018 No. 4 the following changes:

- third Item 2 to declare the paragraph invalid;

- in Regulations on the Office of the President of the Kyrgyz Republic approved by the above-named Decree:

in Item 22 of the word "on representation of the Chief of staff of the President" shall be replaced with words "on representation of the Chief of staff of the President, except for the secretary of the Security Council of the Kyrgyz Republic".

3. Declare invalid the Presidential decree of the Kyrgyz Republic "About the secretariat of the Security Council of the Kyrgyz Republic" of November 22, 2017 No. 274.

4. To the chief of staff of the President of the Kyrgyz Republic to take the necessary measures following from this Decree.

5. This Decree becomes effective from the date of signing.

Regulations on the authorized representation of the President of the Kyrgyz Republic in Jogorku Kenesh of the Kyrgyz Republic

1. General provisions

1. The authorized representation of the President of the Kyrgyz Republic in Jogorku Kenesh of the Kyrgyz Republic (further - representation) is the structural division of the Office of the President of the Kyrgyz Republic (further - the Office of the President) providing representation of interests and realization of the constitutional powers of the President of the Kyrgyz Republic in Jogorku Kenesh of the Kyrgyz Republic (further - Jogorku Kenesh).

2. The representation in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, decrees and orders of the President of the Kyrgyz Republic, orders of the Chief of staff of the President of the Kyrgyz Republic (further - the Chief of staff of the President), Regulations on the Office of the President of the Kyrgyz Republic and other regulatory legal acts of the Kyrgyz Republic, and also this Provision.

The representation is headed by the plenipotentiary of the President of the Kyrgyz Republic in Jogorku Kenesh in the rank of the deputy manager of the Office of the President (further - the plenipotentiary) who is appointed to position and is dismissed by the President of the Kyrgyz Republic.

4) expresses line item of the President of the Kyrgyz Republic in case of adoption of drafts of the laws by Jogorku Kenesh;

5) informs the President of the Kyrgyz Republic on condition of legislative work in Jogorku Kenesh and questions considered by it;

Represents 6) to Jogorku Kenesh of the candidate, provided by the Constitution of the Kyrgyz Republic, brought by the President of the Kyrgyz Republic for election, release, and also consents;

7) at the request of the President of the Kyrgyz Republic submits to Jogorku Kenesh presidential decrees of the Kyrgyz Republic about introduction of emergency state in certain areas; about the announcement of state of war in case of aggression or direct threat of aggression to the Kyrgyz Republic, introduction of warlike situation;

8) represents proposals of the President of the Kyrgyz Republic on convocation of extraordinary session and/or emergency meeting of Jogorku Kenesh, and also questions which are subject to consideration on it;

Carries out 9) in need of consultation with management of Jogorku Kenesh, committees and fractions;

10) participates in development of offers to the agenda of meeting of Jogorku Kenesh;

11) participates in preparation of reports and other materials which are brought by the President of the Kyrgyz Republic for consideration in Jogorku Kenesh;

12) promotes strengthening of interaction, the organization of meetings of the President of the Kyrgyz Republic with management of Jogorku Kenesh, committees, temporary commissions, parliamentary fractions;

13) is coordinated by activities of the expert and working groups and officials specified in the subitem 4 of Item 6 of this provision regarding interaction with Jogorku Kenesh;

14) considers the addresses of citizens and the organizations addressed to the President of the Kyrgyz Republic, the Chief of staff of the President to the Office of the President on the questions carried to competence of representation.

3. Rights of the plenipotentiary of the President of the Kyrgyz Republic in Jogorku Kenesh of the Kyrgyz Republic

6. The plenipotentiary in case of accomplishment of the functions has the right:

1) to act on behalf of the President of the Kyrgyz Republic, expressing line item of the President of the Kyrgyz Republic, on the questions considered in Jogorku Kenesh;

2) to give the corresponding explanations under the laws returned by the President of the Kyrgyz Republic with objections;

3) to participate in process of development of the approved edition of regulations of the law rejected by the President of the Kyrgyz Republic;

4) to make offers to the President of the Kyrgyz Republic, the Chief of staff of the President about creation of expert and working groups on the separate directions of the activities, and also about involvement in accordance with the established procedure of employees of the Office of the President, other state bodies and local government bodies, and also developers of bills, scientists and experts for assistance in implementation of the functions;

5) to request and receive in accordance with the established procedure the necessary decisions, materials and information from structural divisions of the Office of the President, state bodies and local government bodies;

6) to address for receipt of the materials necessary for accomplishment of the powers, in committees, the temporary commissions, parliamentary fractions and in the Office of Jogorku Kenesh;

7) to obtain the required materials and information distributed in Jogorku Kenesh, structural divisions of the Office of the President;

8) to use in accordance with the established procedure information databanks, including governmental, communication systems and communications, other technical means of the Office of the President, the Government and other state bodies;

9) to perform other rights necessary for accomplishment of the functions assigned to representation.

4. Employees

7. The deputy plenipotentiary and the expert of the authorized representation are appointed to position and dismissed by the Chief of staff of the President on representation of the plenipotentiary.

8. Deputy plenipotentiary:

1) replaces the plenipotentiary during its absence;

2) prepares offers on the laws adopted by Jogorku Kenesh and also on the bills considered in Jogorku Kenesh;

3) participates at the request of the plenipotentiary in work of committees, the temporary commissions, parliamentary fractions of Jogorku Kenesh;

4) participates at the request of the plenipotentiary in work of conciliation commissions on development to the coordinated edition of regulations of the law rejected by the President of the Kyrgyz Republic;

5) during absence of the plenipotentiary participates at meetings with the Chief of staff of the President and his deputies for the questions carried to competence of the plenipotentiary;

6) exercises control of timely representation by the ministries, administrative departments, other state bodies and local government bodies of drafts of decisions of the President of the Kyrgyz Republic, reports and other materials on the questions carried to competence of the plenipotentiary;

7) performs other powers at the request of the plenipotentiary.

9. Expert:

1) prepares offers on the laws adopted by Jogorku Kenesh and also on the bills considered in Jogorku Kenesh;

2) participates at the request of the plenipotentiary in work of committees, the temporary commissions, parliamentary fractions of Jogorku Kenesh;

3) participates at the request of the plenipotentiary in work of conciliation commissions on development to the coordinated edition of regulations of the law rejected by the President of the Kyrgyz Republic;

Develops 4) and takes part in preparation of drafts of decisions of the President of the Kyrgyz Republic, the Chief of staff of the President and other materials;

5) performs other rights at the request of the plenipotentiary.

Appendix 2

Regulations on the secretariat of the Security Council of the Kyrgyz Republic

1. General provisions

1. This Provision determines legal status, tasks, functions and powers of the secretariat of the Security Council of the Kyrgyz Republic (further - the Secretariat), and also the organizational principles of its activities.

2. The secretariat is the structural division of the Office of the President of the Kyrgyz Republic (further - the Office of the President) providing activities of the Security Council of the Kyrgyz Republic (further - Council) and carrying out single state policy in the field of ensuring national security of the Kyrgyz Republic.

The secretariat has forms and emblem of the established sample.

3. The secretariat in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, decrees and orders of the President of the Kyrgyz Republic, other regulatory legal acts of the Kyrgyz Republic, orders of the Chief of staff of the President of the Kyrgyz Republic, Regulations on the Office of the President of the Kyrgyz Republic and this Provision.

The secretariat performs the activities in close interaction with other structural divisions of the Office of the President, Government office of the Kyrgyz Republic, the Device and committees of Jogorku Kenesh of the Kyrgyz Republic, the ministries, the state committees, administrative departments, and also the National center of the Kyrgyz Republic for the prevention of tortures and other cruel, inhuman or degrading treatment or punishment and other bodies.

5. Tasks of the Secretariat are:

2) accumulating, research and information processing about functioning of system of ensuring national security and defense capability of the Kyrgyz Republic;

3) preparation to the President of the Kyrgyz Republic of offers on:

- to forming and enhancement of state policy in the field of ensuring national security, the organization of development of target programs in the field;

- to the prevention and liquidation of emergency situations and overcoming their effects;

- to introduction, prolongation and cancellation of emergency state, and also on introduction and cancellation of warlike situation;

4) efficiency evaluation of activities of the state bodies ensuring safety and defense capability of the state;

5) the analysis of activities of state bodies in the field of the prevention of tortures and ill treatment in places of deprivation and restriction of freedom on persons containing in them;

6) forming of the list of perspective subjects for consideration at meetings of Council;

7) ensuring preparation, holding meetings and operational meetings of Council;

8) monitoring of implementation of decisions of Council and control of their execution.

6. The secretariat for the solution of tasks performs the following functions:

1) organization and holding meetings, operational meetings of Council;

2) project development of decisions of Council, and also participation in project development of regulatory legal acts concerning ensuring national security and defense capability;

3) coordination of activities of state bodies for implementation of decisions of the President of the Kyrgyz Republic and Council in the field of safety and defense, control of their execution;

4) the analysis and forecasting in the field of ensuring defense capability, the homeland, regional and international security;

5) development of offers regarding enhancement of the mechanism on identification of internal and external threats to the vital interests of the personality, society and state;

6) preparation of offers to the President of the Kyrgyz Republic on measures of rapid response in case of threats of homeland security of the Kyrgyz Republic;

7) the analysis of implementation process of foreign and domestic policy in the field of ensuring national security and strengthening of defense capability, socio-political and economic situation, condition of legality and law and order in the country, efficiency of the taken measures for counteraction to threats of homeland security, ensuring boundary safety, protection of the population and the territory of the state in emergency situations;

8) implementation of interaction with local public administrations and local government bodies on the questions carried to competence of Council;
