1.1. For renewal of the license for implementation of insurance, reinsurance, mutual insurance, intermediary activities as insurance broker (further - the license for implementation of insurance activity) the subject of insurance case within 10 working days from the date of state registration of changes in the data containing in the license for implementation of insurance activity or from the date of acceptance by the subject of insurance case of the decision on modification of the data containing in the license for implementation of insurance activity (if state registration of the made changes is not required), shall submit the following documents to the Bank of Russia:
the statement for renewal of the license for implementation of insurance activity (the recommended sample is given in appendix 1 to this Instruction);
the document on payment of the state fee for renewal of the document confirming availability of the license for implementation of insurance activity.
1.2. For renewal of the license for implementation of insurance activity in case of change of data on the name (trade name) and (or) the location of the subject of insurance case - the legal entity the subject of insurance case - the legal entity along with the documents specified in Item 1.1 of this Instruction shall submit the following documents to the Bank of Russia:
the copy of the charter (changes in the charter) the subject of insurance case;
the copy of the decision of authorized body of the subject of insurance case on approval of the charter of the subject of the insurance case containing information on the changes made to the charter of the subject of insurance case.
1.3. For renewal of the license for implementation of insurance activity in case of change of data on surname, name, middle name (in the presence) and (or) the residence of the subject of insurance case - the individual entrepreneur the subject of insurance case - the individual entrepreneur along with the documents specified in Item 1.1 of this Instruction shall submit the following documents to the Bank of Russia:
copy of the identity document;
the copy of the document confirming registration address of the individual entrepreneur at the place of residence in the territory of the Russian Federation.
1.4. For renewal of the license for implementation of insurance activity in case of change of data on the list of the types of insurance performed by society of mutual insurance, society of mutual insurance along with the documents specified in Item 1.1 of this Instruction shall submit the following documents to the Bank of Russia:
copy of the charter of society of mutual insurance;
the copy of the decision of general meeting of members of society of mutual insurance on approval of the charter of society of the mutual insurance containing information on modification of the list of the types of insurance specified in the charter;
information about members of society of mutual insurance with indication of their valuable interest concerning implementation of mutual insurance on the types of insurance determined in the charter of society of mutual insurance.
1.5. Decision making about renewal of the license for implementation of insurance activity shall be performed by the Bank of Russia in time, not exceeding twenty working days from the date of submission by the subject of insurance case to the Bank of Russia of the documents provided by Items 1.1 - 1.4 presents of the Instruction.
In case of representation by the subject of insurance case of the documents provided by Items 1.1 - 1.4 presents of the Instruction, not in full the Bank of Russia shall send to the subject of insurance case to the time specified in paragraph one of this Item the notification with the list of missing documents and terms of their representation. The direction to the subject of insurance case of the specified notification shall be performed by its placement in personal account of the participant of information exchange, the reference to which is posted on the official site of the Bank of Russia on the Internet, according to the procedure established by the Instruction of the Bank of Russia of November 3, 2017 No. 4600-U "About order of interaction of the Bank of Russia with credit institutions, not credit financial credit institutions and other participants of information exchange when using by them of information resources of the Bank of Russia, including personal account", registered by the Ministry of Justice of the Russian Federation on January 11, 2018 No. 49605 (further - the Instruction No. 4600-U).
The Bank of Russia within five working days from the date of adoption by the Bank of Russia of the decision on renewal of the license for implementation of insurance activity shall send to the subject of insurance case by the registered mail on paper with the assurance of receipt the notification on renewal of the license (with appendix of the license).
1.6. The documents provided by Items 1.1 - 1.4 presents of the Instruction, shall be provided to the Bank of Russia by the subject of insurance case in type of the electronic documents signed by the strengthened qualified digital signature of the head of the subject of insurance case (person who is temporarily fulfilling its duties) according to requirements of the Instruction No. 4600-U.
2.1. For replacement of the form of the license for implementation of insurance activity to the subject of insurance case - to the legal entity created according to the procedure of reorganization in the form of transformation, the subject of insurance case within 10 working days from the date of state registration of the legal entity created according to the procedure of reorganization in the form of transformation shall submit the following documents to the Bank of Russia:
the statement for replacement of the form of the license for implementation of insurance activity of the subject of insurance case - the legal entity created according to the procedure of reorganization in the form of transformation (the recommended sample is given in appendix 2 to this Instruction);
the documents provided by paragraphs the second - the fifth Item 1.6 of the Instruction of the Bank of Russia of November 23, 2017 No. 4617-U "About the list of the documents confirming fulfillment of requirements to the authorized capital of the insurer, and the list of the documents confirming sources of origin of the money deposited by founders of the license applicant on implementation of insurance and (or) on reinsurance implementation - physical persons in the authorized capital", registered by the Ministry of Justice of the Russian Federation on April 4, 2018 No. 50622 (further - the Instruction No. 4617-U);
the documents specified in Item 1.5 of the Instruction No. 4617-U if the authorized capital of insurance company - the legal entity, the reorganization created according to the procedure in the form of transformation, was created not only at the expense of the authorized capital of the reorganized insurance company, but also at the expense of other own means (at the expense of the added capital, retained earnings and other sources);
information about persons specified in article 32.1 of the Law of the Russian Federation of November 27, 1992 to No. 4015-1 "About the organization of insurance case in the Russian Federation" with indication of position, surnames, name, middle name (in the presence), type and details of the identity document, document on position assignment (the name of the document, its date and number);
the document on payment of the state fee for renewal of the document confirming availability of the license for implementation of insurance activity;
copy of the charter of the subject of insurance case.
2.2. Decision making about replacement of the form of the license shall be performed by the Bank of Russia in time, not exceeding twenty working days from the date of submission by the subject of insurance case to the Bank of Russia of all documents, the stipulated in Item 2.1 presents of the Instruction.
In case of representation by the subject of insurance case of documents, the stipulated in Item 2.1 presents of the Instruction, not in full the Bank of Russia shall send to the subject of insurance case to the time specified in paragraph one of this Item the notification with the list of missing documents and terms of their representation. The direction to the subject of insurance case of the specified notification shall be performed by its placement in personal account of the participant of information exchange, the reference to which is posted on the official site of the Bank of Russia on the Internet, according to the procedure established by the Instruction No. 4600-U.
The Bank of Russia within five working days from the date of adoption by the Bank of Russia of the decision on replacement of the form of the license shall send to the subject of insurance case by the registered mail on paper with the assurance of receipt the notification on replacement of the form of the license (with appendix of the license).
2.3. Documents, the stipulated in Item 2.1 presents of the Instruction, shall be provided to the Bank of Russia by the subject of insurance case according to the procedure, the stipulated in Item 1.6 presents of the Instruction.
3.1. For receipt of the duplicate of the license for implementation of insurance activity in case of its loss or spoil the subject of insurance case shall submit the following documents to the Bank of Russia:
the statement for provision of the duplicate of the license for the implementation of insurance activity (recommended sample is given in appendix 3 to this Instruction) containing information on the reasons of loss or spoil of the form of the license;
the damaged form of the license (it is represented in case of spoil of the form of the license);
document on payment of the state fee for provision of the duplicate of the license for implementation of insurance activity.
3.2. Decision making about provision of the duplicate of the license for implementation of insurance activity shall be performed by the Bank of Russia in time, not exceeding ten working days from the date of submission by the subject of insurance case to the Bank of Russia of all documents, the stipulated in Item 3.1 presents of the Instruction.
In case of representation by the subject of insurance case of documents, the stipulated in Item 3.1 presents of the Instruction, not in full the Bank of Russia shall send to the subject of insurance case to the time specified in paragraph one of this Item the notification with the list of missing documents and terms of their representation. The Bank of Russia within five working days from the date of decision making about provision of the duplicate of the license for implementation of insurance activity shall send to the subject of insurance case by the registered mail on paper with the assurance of receipt the notification on provision of the duplicate of the license (with appendix of the duplicate of the license).
3.3. Documents, the stipulated in Item 3.1 presents of the Instruction, shall be provided to the Bank of Russia by the subject of insurance case according to the procedure, the stipulated in Item 1.6 presents of the Instruction.
The original document, Item 3.1 of this Instruction provided by the paragraph third, shall be provided to the Bank of Russia by the subject of insurance case no later than five working days from the date of submission of all documents, the stipulated in Item 3.1 presents of the Instruction, on paper the registered mail with the assurance of receipt.
4.1. This Instruction becomes effective after 10 days after day of its official publication.
