About approval of Rules of participation of the consumers included in the Register of groups of persons, in creation of electric power for covering of the predicted deficit
According to the subitem 312) of Item 15 of the Regulations on the Department of Energy of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 19, 2014 No. 994, I ORDER:
1. Approve the enclosed Rules of participation of the consumers included in the Register of groups of persons, in creation of electric power for covering of the predicted deficit.
2. To provide to department of realization of state policy in the field of power industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;
4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.
3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of participation of the consumers included in the Register of groups of persons, in creation of electric power (further – Rules) are developed for covering of the predicted deficit according to the subitem 312) of Item 15 of the Regulations on the Department of Energy of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 19, 2014 No. 994, and determine procedure for participation of the consumers included in the Register of groups of persons, in creation of electric power for covering of the predicted deficit.
2. In these rules the following basic concepts are used:
1) Market Council – the non-profit organization performing activities for monitoring of functioning of the market of electrical energy and capacity, and also other functions provided by the Law of the Republic of Kazakhstan "About power industry" (further – the Law);
2) the register of groups of persons (further - the Register) - the list of the power making organizations and the consumers entering one group of persons created and placed on official Internet resource by authorized body on condition of control availability according to parts two and third Item 1-1 of article 9 of the Law;
3) authorized body - the state body performing management in the field of power industry.
Other concepts and determinations used in these rules are applied according to the legislation of the Republic of Kazakhstan in the field of power industry.
3. According to Item 8 of article 15-1 of the Law if in the approved balance estimation of electrical energy and capacity for the forthcoming seven-year period the predicted not covered deficit of electric power in single electric utility system of the Republic of Kazakhstan or in any of its zones within the first five years of the forecast exceeds 100 megawatts, the authorized body within thirty calendar days sends notifications to Market Council, to the consumers included in the Register, about emergence of the predicted not covered deficit of electric power.
The zone of single electric utility system of the Republic of Kazakhstan is part of single electric utility system of the Republic of Kazakhstan in which there are no restrictions of technical nature interfering transfer of the electrical energy made by the generating sources, the development of balance estimations of electrical energy and capacity determined according to procedure.
Not covered deficit of electric power is calculated taking into account handling capacity of the power lines connecting power shortage zones with other zones of single electric utility system of the Republic of Kazakhstan.
4. According to Item 6 of article 15-5 of the Law, the consumers included in the Register of the corresponding group of persons participate in creation of electric power in the amount calculated by Market Council by the following formula:
Mrop? = Dem * (Pnpr/PNEES), where
Mrop - settlement amount of obligations of the consumers included in the Register of the corresponding group of persons in creation of electric power;
Dem - amount of the predicted deficit of electric power in single electric utility system of the Republic of Kazakhstan or in any of its zones;
Pnpr - peak load of the consumers included in the Register of the corresponding group of persons at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period;
PNEES - general peak load in single electric utility system of the Republic of Kazakhstan at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period.
5. According to Item 8 of article 15-5 of the Law, obligation of the consumers included in the Register on creation of electric power, stipulated in Item the 6th article 15-5 of the Law, decrease at size of the electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons, calculated by Market Council by the following formula:

Mop - amount of obligations of the consumers included in the Register of the corresponding group of persons in creation of electric power;
Dem - amount of the predicted deficit of electric power in single electric utility system of the Republic of Kazakhstan or in any of its zones;
Smpr - the amount of electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons in case of accomplishment of the conditions specified in Item 8 of article 15-5 of the Law;
Pnpr - peak load of the consumers included in the Register of the corresponding group of persons at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period;
PNEES-general peak load in single electric utility system of the Republic of Kazakhstan at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period.
If Mop is equal to zero, or negative, obligations of the consumers included in the Register of the corresponding group of persons are equal to zero.
6. If the amount of electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons according to subitems 1) and 2) of Item 6 of article 15-5 of the Law is equal or more Mop, other consumers of the corresponding group of persons included in the Register are exempted from participation in creation of electric power.
7. If the amount of electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons according to subitems 1) and 2) of Item 6 of article 15-5 of the Law less Mop, consumers included in the Register of the corresponding group of persons participate in creation of electric power according to the subitem 4) of Item 6 of article 15-5 of the Law, in the amount calculated by Market Council based on the notification of authorized body, on the following formula:

Meuse - purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser the consumers included in the Register according to the subitem 4) Item 6 of article 15-5 of the Law;
Mop - amount of obligations of the consumers included in the Register of the corresponding group of persons in creation of electric power;
Smop - the amount of electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons according to subitems 1) and 2) of Item 6 of article 15-5 of the Law.
8. The purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser is distributed by Market Council between the consumers included in the Register on the following formula:
Mez1? = Meuse * (Pnpr1/Pnpr), where
Mez1 - purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser the consumer included in the Register according to the subitem 4) Item 6 of article 15-5 of the Law;
Meuse - purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser the consumers included in the Register according to the subitem 4) Item 6 of article 15-5 of the Law;
Pnpr1 - peak load of the consumer included in the Register of the corresponding group of persons at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period;
Pnpr - peak load of the consumers included in the Register of the corresponding group of persons at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period.
9. In case of obligation fulfillment, provided in Item 6 of article 15-5 of the Law, by accomplishment of the actions specified in subitems 1) and 2) of Item 6 of article 15-5 of the Law the location (platform), type and type of fuel for the generating installations put into operation, are approved by the subjects of the wholesale market included in the Register with authorized body according to Items 13 and 14 of these rules.
10. Interaction of the subjects of the wholesale market included in the Register with the single purchaser and authorized body concerning decision making about participation in creation of electric power, the direction of notifications and information, the conclusion of contracts for creation of electric power and about purchase of service in maintenance of readiness of electric power, is performed according to Items 10-12 of article 15-5 of the Law.
11. In case of decision making about participation in creation of electric power by accomplishment of the action specified in the subitem 4) of Item 6 of article 15-5 of the Law, the consumers included in the Register of the corresponding group of persons buy from the single purchaser of service in ensuring readiness of electric power for execution of loading in the amount calculated by Market Council by the following formula:

Meuse - purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser the consumers included in the Register according to the subitem 4) Item 6 of article 15-5 of the Law;
Mop - amount of obligations of the consumers included in the Register of the corresponding group of persons in creation of electric power;
Smop - the amount of electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons according to subitems 1) and 2) of Item 6 of article 15-5 of the Law.
Distribution of purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser according to the subitem 4) of Item 6 of article 15-5 of the Law between the consumers included in the Register is made according to Item 8 of these rules.
12. The groups of persons created after carrying out the tender for construction of the generating installations which are again put into operation and (or) after carrying out biddings participate in creation of electric power according to the subitem 4) of Item 6 of article 15-5 of the Law.
Purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser are calculated Market Council according to Items 8, of 21 these rules.
13. According to Item 9 of article 15-1 of the Law if in the approved balance estimation of electrical energy and capacity for the forthcoming seven-year period the predicted not covered deficit of adjusting electric power in single electric utility system of the Republic of Kazakhstan or in any of its zones within the last three years of the forecast exceeds 100 megawatts, the authorized body determines amounts, terms of commissioning of the adjusting generating installations with the maneuverable mode of generation and sends notifications to Market Council, to the consumers included in the Register, about emergence of the predicted not covered deficit of adjusting electric power.
14. According to Item 6 of article 15-5 of the Law, the consumers included in the Register of the corresponding group of persons participate in creation of adjusting electric power in the amount calculated by Market Council based on the notification of authorized body on the following formula:
Mregrop? = Dregem * (Pnpr/PNEES), where
Mregrop - settlement amount of obligations of the consumers included in the Register of the corresponding group of persons in creation of adjusting electric power;
Dregem-amount of the predicted deficit of adjusting electric power in single electric utility system of the Republic of Kazakhstan or in any of its zones;
Pnpr - peak load of the consumers included in the Register of the corresponding group of persons at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period;
PNEES - general peak load in single electric utility system of the Republic of Kazakhstan at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period.
15. According to Item 8 of article 15-5 of the Law, obligation of the consumers included in the Register on creation of adjusting electric power, stipulated in Item the 6th article 15-5 of the Law, decrease at size of the adjusting electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons, calculated by Market Council by the following formula:

Мопрег - amount of obligations of the consumers included in the Register of the corresponding group of persons in creation of adjusting electric power;
Dregem - amount of the predicted deficit of adjusting electric power in single electric utility system of the Republic of Kazakhstan or in any of its zones;
Smregpr - the amount of adjusting electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons in case of accomplishment of the conditions specified in Item 8 of article 15-5 of the Law;
Pnpr - peak load of the consumers included in the Register of the corresponding group of persons at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period;
PNEES - general peak load in single electric utility system of the Republic of Kazakhstan at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period.
If Mopreg is equal to zero, or negative, obligations of the consumers included in the Register of the corresponding group of persons are equal to zero.
16. If the amount of adjusting electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons according to subitems 1) and 2) of Item 6 of article 15-5 of the Law is equal or more Mopreg, other consumers of the corresponding group of persons included in the Register are exempted from participation in creation of adjusting electric power.
17. If the amount of adjusting electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons according to subitems 1) and 2) of Item 6 of article 15-5 of the Law of less Mopreg, the consumers included in the Register of the corresponding group of persons participate in creation of adjusting electric power according to the subitem 4) of Item 6 of article 15-5 of the Law, in the amount calculated by Market Council by the following formula:

Smregop - the amount of adjusting electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons according to subitems 1) and 2) of Item 6 of article 15-5 of the Law.
18. The purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser is distributed by Market Council between the consumers included in the Register on the following formula:

Mez1 - purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser the consumer included in the Register according to the subitem 4) Item 6 of article 15-5 of the Law;
Meuse - purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser the consumers included in the Register according to the subitem 4) Item 6 of article 15-5 of the Law;
Pnpr1 - peak load of the consumer included in the Register of the corresponding group of persons at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period;
Pnpr - peak load of the consumers included in the Register of the corresponding group of persons at the time of approval of the balance estimation of electrical energy and capacity for the forthcoming seven-year period.
19. In case of obligation fulfillment, provided in Item 6 of article 15-5 of the Law, by accomplishment of the actions specified in subitems 1) and 2) of Item 6 of article 15-5 of the Law the location (platform), type and type of fuel for the generating installations put into operation, are approved by the subjects of the wholesale market included in the Register with authorized body according to Items 22 and 23 of these rules.
20. Interaction of the subjects of the wholesale market included in the Register with the single purchaser and authorized body concerning decision making about participation in creation of adjusting electric power, the direction of notifications and information, the conclusion of contracts for creation of adjusting electric power and about purchase of service in maintenance of readiness of electric power, is performed according to Items 10-12 of article 15-5 of the Law.
21. In case of decision making about participation in creation of adjusting electric power by accomplishment of the action specified in the subitem 4) of Item 6 of article 15-5 of the Law, the consumers included in the Register of the corresponding group of persons buy from the single purchaser of service in ensuring readiness of electric power for execution of loading in the amount calculated by Market Council by the following formula:

Meuse - purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser the consumers included in the Register according to the subitem 4) Item 6 of article 15-5 of the Law;

Smregop - the amount of adjusting electric power created by the subjects of the wholesale market included in the Register of the corresponding group of persons according to subitems 1) and 2) of Item 6 of article 15-5 of the Law.
Distribution of purchasing amount of services in ensuring readiness of electric power for execution of loading at the single purchaser according to the subitem 4) of Item 6 of article 15-5 of the Law between the consumers included in the Register is made according to Item 18 of these rules.
22. The subjects of the wholesale market included in the Register submit to authorized body the petition for approval of the location (platform), type and type of fuel of the generating installations put into operation, on paper and electronic carriers together with information on key parameters of the generating installations on form according to appendix to these rules.
23. The authorized body approves the location (platform), type and type of fuel for the generating installations put into operation, the subjects of the wholesale market included in the Register provided that the electric power and (or) adjusting electric power will be created in single electric utility system of the Republic of Kazakhstan or in any of its zones in which not covered deficit of electric power is predicted.
24. In case of construction of the generating installations which are again put into operation with the maneuverable mode of generation using hydrodynamic energy of water and (or) gas for development of electrical energy, the range of regulation is determined according to Rules of the organization and carrying out biddings on construction of the generating installations which are again put into operation with the maneuverable mode of generation approved by the order of the acting minister of power industry of the Republic of Kazakhstan of April 30, 2021 No. 161 (it is registered in the Register of state registration of regulatory legal acts for No. 22727).
In case of construction of the generating installations which are again put into operation with the maneuverable mode of generation using coal and (or) secondary energy resources for development of electrical energy, the range of regulation is determined according to appendix 2 to these rules.
