About approval of criteria by which the risk degree from implementation of economic activity in the field of power industry is estimated, economic activity on oil transportation, oil products by the bulk distribution line, economic activity in the natural gas market, by production of heat energy, transportation of heat energy by the high-level and local (distribution) thermal networks and delivery of heat energy, centralized water supply and drainage system, conversion and burial of household waste which is subject to licensing by the National commission performing state regulation in spheres of power and utilities and determines frequency of holding planned actions of the state control

According to part two of article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity in the field of power industry is estimated of economic activity on oil transportation, oil products by the bulk distribution line, economic activity in the natural gas market, frequency of holding planned actions of the state control which are applied also is determined by production of heat energy, transportation of heat energy by the high-level and local (distribution) thermal networks and delivery of heat energy, centralized water supply and drainage system, conversion and burial of household waste which is subject to licensing by the National commission performing state regulation in spheres of power and utilities.

2. Recognize to invalid:

the resolution of the Cabinet of Ministers of Ukraine of August 5, 2015 No. 565 "About approval of criteria by which the risk degree from implementation of economic activity in the natural gas market is estimated in spheres of power industry, oil transportation and oil products the bulk distribution line, to centralized water supply and drainage system, production of heat energy, transportation of heat energy by the high-level and local (distribution) thermal networks and delivery of heat energy which is subject to licensing by the National commission performing state regulation in spheres of power and utilities and is determined frequency of holding planned actions of the state supervision (control)" (The Official Bulletin of Ukraine, 2015, No. 64, the Art. 2132);

1. Criteria by which the risk degree from implementation of economic activity in the field of power industry which is subject to licensing of NKREKP is estimated and determine frequency of holding planned actions of the state control, are:

type of economic activity;

amount of transfer, distribution, deliveries or resale of electrical energy within the year preceding year in which the annual plan of actions of the state control is created;

installed capacity of electroinstallations on production of electrical energy;

total amount of the penalties inflicted on the licensee by results of the held events of the state control for the last five years;

index of average duration of long breaks in electric utility service of consumers (SAIDI) within the year preceding year in which the annual plan of actions of the state control is created;

index of average frequency of long breaks in electric utility service of consumers (SAIFI) within the year preceding year in which the annual plan of actions of the state control is constituted;

observance of standards and quality requirements of consumer service of electrical energy (compensation provision to consumers for non-compliance with standards and requirements) within the year preceding year in which the annual plan of actions of the state control is created;

the number of consumers of electrical energy which performs delivery of electrical energy, as of the end of the year, preceding year in which the annual plan of actions of the state control is created;

the number of users of electrical energy who are attached to systems of distribution/transfer of electrical energy, as of the end of the year, preceding year in which the annual plan of actions of the state control is constituted;

production of electricity by generation types.

2. Criteria by which the risk degree from implementation of economic activity on oil transportation is estimated of oil products the bulk distribution line, economic activity in the natural gas market which is subject to licensing of NKREKP, and determine frequency of holding planned actions of the state control, are:

type of economic activity;

amount of distribution of natural gas within the year preceding year in which the annual plan of actions of the state control is created;

the scope of supply of natural gas within the year preceding year in which the annual plan of actions of the state control is created;

the number of the violations revealed during the previous planned action of the state control;

total amount of the penalties inflicted on the licensee by results of the held events of the state control for the last five years.
