About modification and amendments in some orders of the Chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption
I ORDER:
1. Approve the enclosed list of some orders of the Chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption to which changes and additions are made.
2. And to anti-corruption in the procedure established by the legislation to provide to department of public service of the Agency of the Republic of Kazakhstan for public service:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration of this order the direction in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) placement of this order on Internet resource of the Agency of the Republic of Kazakhstan for public service and to anti-corruption.
3. To impose control of execution of this order on the vice-chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption supervising questions of public service.
4. This order becomes effective since January 1, 2019 and is subject to official publication.

To be reworded as follows the standard document forms of personnel clerical work of classified public service approved by the specified order according to appendix 1 to this list.
2. In Standard forms of the Chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption of December 13, 2016 No. 85 "About approval of Standard qualification requirements to managerial state positions of the case "B" (it is registered in the Register of state registration of regulatory legal acts for No. 14542, it is published on December 23, 2016 in information system of law of Ad_let):
The standard qualification requirements to managerial state positions of the case "B" approved by the specified order to be reworded as follows according to appendix 2 to this list.
3. In the order of the Chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption of February 21, 2017 No. 40 "About some questions of occupation of managerial state position" (it is registered in the Register of state registration of regulatory legal acts for No. 14939, it is published on April 19, 2017 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan):
in the Rules of carrying out tender on occupation of managerial state position of the case "B" approved by the specified order:

"41. Persons who showed willingness to participate in internal tender submit documents to the state body which announced competition in electronic form by means of the integrated information system "E-Kyzmet" or the portal of electronic government "E-gov" or on the e-mail address specified in the announcement in documents acceptance terms.
42. By provision of documents in electronic form on the e-mail address of state body their originals are represented not later than one hour prior to the interview.

"76-1. The service of personnel management (personnel service) by means of the integrated information system "E-Kyzmet" checks availability at the candidate:
1) the certificate on passing of testing for knowledge of the legislation with results not below threshold values according to the program of the testing for category of the announced position valid for the moment of submission of documents;
2) the conclusion about passing of personal evaluation in authorized body with results is not lower than threshold values, valid for the moment of submission of documents for participation in tender.
This Item becomes effective since February 1, 2019.";

"2. Testing is held in the presence of the operator of testing who is employee of "National Center for Personnel Management of Public Service" Joint-stock company (further - the operator).
3. Objectivity of conducting testing is provided with commonality of conditions, time, calculation of results, contents of tests, and also acceptance of written restrictions by the operator about inadmissibility of corruption actions.";

"6. The period of conducting testing constitutes no more than three working days according to the schedule constituted by authorized body for public service (further - authorized body).";

Value of passing of testing on personal evaluation makes at least 50% on reliability level.

"25-1. Repeated testing of the candidates for position of the case "B" who received results of testing is one personal evaluation lower than the value specified in Item 24 of these rules, it is allowed not earlier than in one month from the date of testing passing.".;

"27. Prior to testing the operator acquaints the tested persons with the instruction for testing and answers the questions which arose at them on test procedure.
28. Persons having unsatisfactory health at the time of testing report about it to the operator prior to conducting testing. In this case testing of such persons is held in other time during this day or in other day according to the schedule of testing.";

"33. In case of violation by the tested person of requirements of Item 32 of these rules, the operator stops process of testing of such person and deletes it from the room for testing.

Persons concerning whom the statement of violation was drawn up pass repeated test not earlier than in six months from the date of violation. Results of testing of persons which violated requirements of Item 32 of these rules are cancelled."
