About approval of the General technical regulation about tobacco products

According to the Law of the Republic of Uzbekistan "About technical regulation", and also for the purpose of establishment of single requirements to safety of tobacco and tobacco products the Cabinet of Ministers decides:

1. Approve the General technical regulation about tobacco products and the scheme of its implementation according to appendices No. No. 1 and 2.

Enact the General technical regulation about tobacco products after twelve months from the date of its official publication.

2. Take into consideration that according to requirements of the Law of the Republic of Uzbekistan "About technical regulation" with enforcement of technical regulations the accepted earlier regulating documents on standardization on products specified in them and services lose binding character and acquire voluntariness of application in accordance with the established procedure.

3. To the Uzstandart agency together with authorized state bodies to take measures for cancellation of binding character and ensuring voluntariness in case of application of regulating documents on standardization of tobacco and tobacco products from the date of enforcement of the General technical regulation approved by this resolution in accordance with the established procedure.

4. To provide to HK "Uzbekozikovkatholding", the Uzstandart Agency together with National broadcasting company of Uzbekistan broad informing the population, bodies of the public and economic board, subjects of business activity about the purposes, content and procedure for application of the General technical regulation about tobacco products.

5. To impose control of execution of this resolution on the Secretariat concerning development fuel and energy and key branches of the industry of the Cabinet of Ministers and the chairman of the board of HK "Uzbekozikovkatholding" T.A. Zhalilova.

The general technical regulation about tobacco products

Chapter 1. General provisions

§1. Purposes and scope

1. This General technical regulation (further - the Technical regulation) establishes mandatory requirements to tobacco products for the purpose of the prevention of the actions misleading acquirers concerning their appointment and safety.

2. Requirements of the Technical regulation extend to the tobacco products specified in appendix No. 1 to the Technical regulation.

3. Requirements of the Technical regulation do not extend to tobacco products:

intended for realization for export or following en route through the territory of the Republic of Uzbekistan;

imported by legal entities and physical persons, including foreign, without intention of its subsequent realization for own needs or as exhibition models, test pieces and carrying out marketing researches;

made by physical persons for personal use without intention of its subsequent realization.

4. The tobacco products are released in the territory of the Republic of Uzbekistan in case of its compliance to requirements of the Technical regulation.

If in other Technical regulations requirements for separate types of tobacco products are established, then these types of tobacco products shall conform to requirements of all technical regulations which action extends to them.

§2. Terms and determinations

5. In the Technical regulation the following terms and determinations are used:

the block - unit of group consumer pack containing certain number of consumer packagings with tobacco products;

the warranty period of storage - fixed term of storage of tobacco products (in months) during which the manufacturer (importer) guarantees and provides compliance of tobacco products to requirements of the Technical regulation in case of observance of storage conditions;

the manufacturer - the legal entity, including the foreign manufacturer who performs on its own behalf production or production and realization of tobacco products and meets for its compliance the requirements of the Technical regulation;

the importer - the legal entity - the resident of the Republic of Uzbekistan who signed the import contract with the nonresident of the Republic of Uzbekistan for import of tobacco products for the territory of the Republic of Uzbekistan, and also enabling the realization of tobacco products and bearing responsibility for its compliance to requirements of the Technical regulation;

ingredient - the substance (except for tobacco leaf and other parts of tobacco) used in case of production of tobacco products and which is present at finished tobacco products including in the changed form;

smoking tobacco products - the tobacco products intended for smoking;

the licensor - the legal entity or physical person having rights to the trademark, granting right to use of such trademark based on the license agreement;

the medical prevention - information on negative impact of the use of tobacco products on health of the person which is placed on consumer packaging of tobacco products;

the name of tobacco products (brand) - the designation of tobacco products appropriated by the manufacturer;

not smoking tobacco products - the tobacco products intended for suction, chewing, shuffing;

nicotine - the alkaloid containing in plants of the family Nicotiana of family of solanaceous types of Nicotiana Tabacum and Nicotiana Rustica;

consumer packaging - the packaging (primary package, pack) intended for direct placement of tobacco products, its demonstration and realization to the final consumer, ensuring safety of consumer properties of products during warranty period of storage in case of the observance of conditions of transportation and storage established by the manufacturer;

pitch - the dehydrated condensate of tobacco smoke which is not containing nicotine;

raw materials - the tobacco which underwent postharvest and (or) other industrial processing, used in case of production of tobacco products;

tobacco - the plant of the family Nicotiana of family of solanaceous types of Nicotiana Tabacum and Nicotiana Rustica cultivated for the purpose of receipt of raw materials;

tobacco products - any products made of tobacco or its substitute;

person authorized by the manufacturer - the legal entity registered in the procedure established by the legislation who based on the contract with the manufacturer, including with the foreign manufacturer, performs actions on behalf of this manufacturer in case of assessment (confirmation) of compliance and release into the stream of commerce of tobacco products in the territory of the Republic of Uzbekistan and also bears responsibility for discrepancy of tobacco products to requirements of the Technical regulation;

the filter - the adaptation established in production process of some types of smoking tobacco products, providing detention of part of tobacco smoke in case of their smoking;

box (box) - the unit of transport container made of corrugated or plywood fibreboard, and containing certain number of consumer packagings or blocks of tobacco products.

Chapter 2. Requirements to production, transportation and storage of tobacco products

§1. Maximum permissible indicators of content of the normalized substances

6. The tar content cannot exceed in smoke of one cigarette:

with the filter - 10 milligrams;

without filter - 16 milligrams.

7. The nicotine content in smoke of one cigarette (with the filter or without filter) cannot exceed 1.0 milligrams.

8. Maximum permissible indicators of content of chemical and microbiological substances in tobacco products are established according to appendix No. 2 to the Technical regulation.

§2. Requirements to production and address

9. The manufacturers authorized by the manufacturer of person and importers (sellers) shall perform production processes and addresses of tobacco products so that products conformed to requirements of the Technical regulation.

10. Requirements and indicators of tobacco products regulated by the Technical regulation in production process and addresses are provided in the way:

the choice of the engineering procedures of production providing compliance to the made tobacco products to requirements of the Technical regulation;

monitoring procedures of raw materials, the packaging materials, technological means and auxiliary materials used in production process of tobacco products;

contents, the production rooms used in production process of tobacco products, processing equipment and stock in the condition excluding pollution of tobacco products;

creations of conditions for observance by personnel of rules of personal hygiene;

applications of methods and frequency of carrying out cleaning, the sink, disinfection, disinsection and deratization used in production process of tobacco products of production and storage facilities, processing equipment and stock.

§3. Requirements to raw materials and the ingredients applied in case of production

11. The raw materials and ingredients applied in case of production of tobacco products shall have the accompanying documentation confirming their origin. On safety indicators they shall conform to the requirements established in the existing regulating documentation in the field of technical regulation.

12. The raw materials applied to production of tobacco products shall be followed by information on compliance of content of pesticides in it to requirements of the regulating documentation in the field of technical regulation.

13. Storage conditions shall provide prevention of spoil of raw materials and materials, changes of their consumer properties and their protection against pollutants.

14. Use as ingredients of the substances, in case of production specified in appendix No. 3 to the Technical regulation is not allowed.

§4. Requirements to conditions of transportation and storage

15. Tobacco products are transported by all modes of transport according to the rules of transportation of goods existing on the corresponding mode of transport. Vehicles shall be covered, dry, net and without foreign smell.

In case of simultaneous transportation of tobacco and food products or other loads the conditions excluding their contact, pollution and change of properties of tobacco products shall be provided.

16. Storage conditions of tobacco products shall provide prevention of spoil and change of their consumer properties, protection against pollutants.

17. The warranty period of storage and the storage condition of tobacco products are established by the manufacturer.

18. The tobacco products which are in circulation in the territory of the Republic of Uzbekistan shall conform to requirements of the Technical regulation during all established warranty period of storage.

Chapter 3. Requirements to packaging and marking of tobacco products

§1. Requirements to packaging

19. The tobacco products are without fail packed into consumer packaging.

20. Consumer packaging shall provide invariance of consumer properties and compliance of tobacco products to the Technical regulation during all warranty period of storage.

21. Surface area of consumer packaging shall provide possibility of drawing on it of marking and the medical prevention according to requirements of the Technical regulation.

§2. Requirements to marking

22. Marking of tobacco products is applied on consumer packaging and shall contain:

name of type of tobacco products. At the same time it is allowed to put the name in combination with tobacco products other information, for example, of "20 filtered cigarettes", "50 grams of pipe tobacco";

name of tobacco products (brand) and (or) registered trade mark;

the name, the address and phone of the organization authorized by the manufacturer on adoption of claims from consumers. The name and the address of authorized organization is allowed to be put on inside of consumer packaging in the place available to reading in case of packaging opening;

name and legal address of the manufacturer, and also country of production of tobacco products (for example "O" zbekistonda ishlab chiqarilgan");

information on quantity or net weight of products in packaging;

the medical prevention in the form of text text and (or) the drawing, according to §3 this Chapter of the Technical regulation;

information on confirmation of conformity of products (mark of conformity);

information on tar and nicotine content in cigarette smoke condensate (for cigarettes);

text of "20 yoshga yetmaganlarga sotish taqiqlanadi";

month and year of production of tobacco products.

In case of change of the data specified in marking of tobacco products, the manufacturer, person authorized by the manufacturer or the importer shall within 6 months from the date of such changes provide introduction of corresponding changes on consumer packaging. At the same time the manufacturer, person authorized by the manufacturer or the importer during the specified term have the right to release tobacco products with former information.

23. The text with indication of the name of cigarettes (brand) shall be applied on each cigarette.

24. Information on box (box) shall contain the following data:

name and legal address of the manufacturer;

the name and legal address of the importer (for the imported products);

name of tobacco products (brand);

quantity of tobacco products in box (box);

information on certification;

month and year of production;

warranty period of storage;

"Protect handling instructions from moisture", "Protect from heating";

storage conditions of "Salqin va quruq joyda saqlansin".

On box (box) the additional information characterizing tobacco products can be placed.

25. The manufacturer can use the inserts placed in consumer packaging for placement of information on the tobacco products which are not contradicting the Technical regulation. On the insert at the discretion of the manufacturer other information characterizing products can be in addition placed.

Use of the inserts attached outside, including under wrapping film or attached to such consumer packaging is not allowed.

26. Information placed on consumer packaging shall not contain images of foodstuff, medicines, herbs, and also words or phrases which directly or indirectly create associations of tobacco products with foodstuff, medicine or herb.

27. Drawing on consumer packaging and the block, the words or phrases specifying content of menthol in tobacco products on nature of aroma and the other information which is characterizing tobacco products, not contradicting requirements of the Technical regulation is allowed.

28. Placement on consumer packaging of tobacco products and the insert of the information belittling the harm done to health of the person, making false impression about the characteristic of tobacco products as about products, the being tobacco products, harmless or less harmful in comparison with other samples, is not allowed.

29. The technology of drawing marking shall ensure its safety during the transporting, storage and realization of tobacco products during warranty period of storage.

30. Marking, except for names of tobacco products (brand), shall is put so that integrity of texts when opening consumer packaging was not broken.

31. Information placed on consumer packaging shall not be printed on transparent wrapping film or any other external wrapping material, be blocked by other printing information except for of the face of consumer packaging. At the same time this information can partially be blocked by excise stamp.

32. Information placed on consumer packaging of tobacco products is put in state language and can be repeated in other languages. The verbal designation entering registered trade mark or industrial design is put in language of its registration.

§3. Requirements to drawing medical preventions

33. The medical prevention is applied on each consumer packaging and the block of tobacco products.

34. Contents of the medical preventions placed on consumer packaging of tobacco products affirm the Ministry of Health of the Republic of Uzbekistan in the form of text text and (or) the drawing, not more often than once in five years.

The manufacturer (person authorized by the manufacturer) or the importer shall provide drawing again approved sketches of medical preventions in time, not exceeding 12 months from the date of their approval.

35. The medical prevention is located in the lower part of the front and return main parties of consumer packaging of tobacco products and shall occupy at least 40 percent of the area of these parties.

The medical prevention is placed so that when opening consumer packaging integrity of text text and (or) the drawing was provided.

The text of the medical prevention shall be placed parallel to the upper side of consumer packaging and is put in the state and Russian languages.

Requirements to drawing the medical prevention on the block are same, as for consumer packaging, taking into account pro rata scaling of contents of the medical prevention on the front and turnover parties of the block.

Sketches of medical warnings of harm of consumption of tobacco products are put on the basis of rotation.

Chapter 4. Identification and assessment of conformity, sampling and carrying out testing

§1. Identification

36. Identification is understood as the procedure of reference of tobacco products to scope of the Technical regulation.

Carries out identification of tobacco products:

the manufacturer (person authorized by the manufacturer), the importer (seller);

certification body, for the purpose of assessment and confirmation of conformity of products;

authorized state body, for the purpose of check of compliance of products which are in circulation in the territory of the Republic of Uzbekistan to requirements of the Technical regulation.

37. Identification of tobacco products is carried out:

according to the name of type - by comparison of the name of the type of tobacco products containing in information placed on consumer packaging and (or) in accompanying documents (originals (verified copies) of the delivery agreement, the shipping documentation or the certificate of conformity) with determinations of types of tobacco products according to the Technical regulation;

by visual method - by comparison of appearance of tobacco products with the signs stated in determination of such tobacco products according to the Technical regulation.

The signs characterizing tobacco products are: component structure (availability of tobacco leaf and (or) other parts of tobacco plant), its characteristics and method of application of tobacco products.

38. Reference or not reference of identifiable products to tobacco products is result of identification.

§2. Sampling and testing

39. Test methods, including the sampling methods necessary for assessment of conformity of tobacco products for requirements of the Technical regulation are determined according to regulating documents in the field of technical regulation.

§3. Assessment (confirmation) of compliance

40. Assessment (confirmation) of compliance of tobacco products to requirements of the Technical regulation, is carried out in the form of obligatory certification or in the declaration form of compliance.

41. To assessment (confirmation) of compliance to requirements of the Technical regulation, the tobacco products released in the territory of the Republic of Uzbekistan are subject.

42. Assessment (confirmation) of compliance of tobacco products is carried out according to the request of the legal entities registered in the territory of the Republic of Uzbekistan, who are manufacturers (person authorized by the manufacturer) or importers (sellers) of tobacco products.

Chapter 5. State control (supervision) of observance of requirements of the Technical regulation

43. The state control (supervision) of observance of requirements of the Technical regulation, is performed by authorized bodies of public administration within their competence in compliance with the procedure established by the legislation of the Republic of Uzbekistan.

Chapter 6. Transition period

44. From the moment of enforcement of the Technical regulation the regulating documents in the field of technical regulation existing in the territory of the Republic of Uzbekistan and establishing requirements to tobacco products before their reduction in compliance with the Technical regulation are applied in the part which is not contradicting requirements of the Technical regulation.

45. The sanitary and epidemiologic conclusions and the certificates of conformity issued on tobacco products before entry into force of the Technical regulation are considered valid before the termination of term of their action.

Chapter 7. Responsibility for violation of requirements of the Technical regulation

46. Persons guilty of violation of requirements of the Technical regulation bear responsibility according to the procedure, established by the legislation.

to the General technical regulation about tobacco products

1.7	Cigarillo (cigarette)	Type of the smoking tobacco products made of cigar and other raw materials and having many layers: cut or fragmentary cigar and other raw materials stuffing with addition or without addition of ingredients, podvertka from cigar and (or) other raw materials and wrapper from cigar tobacco leaf, the recovered tobacco or the special paper made on the basis of cellulose and tobacco. 1.8	Tobacco for hookah	Type of the smoking tobacco products intended for smoking with use of hookah and consisting of mix of cut or fragmentary raw materials with addition or without addition of ingredients.
1.9	Tonkorezany smoking tobacco	Type of the smoking tobacco products intended for manual production of cigarettes or cigarettes and consisting from cut, the fragmentary, twisted or pressed tobacco with addition or without addition of ingredients in which at least 25 percent of net weight of product make fibers 1 mm wide or less.
1.10	Pipe tobacco	Type of the smoking tobacco products intended for smoking with use of pipe and consisting from cut, the fragmentary, twisted or pressed tobacco with addition or without addition of ingredients in which more than 75 percent of net weight of product make fibers more than 1 mm wide.
2	Not smoking tobacco products
2.1	Tobacco chewing	Type of the not smoking tobacco products intended for chewing and made of the pressed scraps of tobacco leaves with addition or without addition of ingredients.
2.2	Tobacco snuff	Type of the not smoking tobacco products intended for shuffing and made of tonkoizmelchenny tobacco with addition or without addition of ingredients.
2.3	Tobacco sucking (снюс)	Type of the not smoking tobacco products intended for suction and fully or partially the purified tobacco dust and (or) small fraction of cut tobacco made from with addition or without addition of ingredients.
