About approval of rules of assignment of the international identification codes to manufacturers of vehicles

According to subitem 3-2) of part one of article 7 of the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" I ORDER:

1. Approve the enclosed Rules of assignment of the international identification codes to manufacturers of vehicles.

2. To provide to committee of technical regulation and metrology of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective since April 11, 2019 and is subject to official publication.

Rules of assignment of the international identification codes to manufacturers of vehicles

Chapter 1. General provisions

1. These rules of assignment of the international identification codes to manufacturers of vehicles (further - Rules) are developed according to subitem 3-2) of part one of article 7 of the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" and determine procedure for assignment of the international identification codes to manufacturers of vehicles.

2. Assignment of the international identification codes to manufacturers of vehicles is performed for the purpose of establishment of identification of manufacturers of vehicles.

3. In Rules the following concepts are used:

1) the manufacturer of the vehicle - the physical person or legal entity performing production of the vehicle, the chassis or its components with intention of their release in the address for realization or own use;

2) the certificate on assignment of the international identification code to the manufacturer of the vehicle (further - the Certificate) - the document confirming assignment of the international identification code to the manufacturer of the vehicle registered as person performing economic activity in the territory of the Republic of Kazakhstan;

3) assignment of the international identification codes to manufacturers of vehicles - fixing of separate identification marks to the manufacturer of the vehicle registered as person performing economic activity in the territory of the Republic of Kazakhstan;

4) vehicle identification number - the structured combination of seventeen signs which is appropriated by the manufacturer of the vehicle;

5) technical secretariat - the organization determined by authorized body on implementation of activities for check of correctness and justification of registration of approval like the vehicle, approvals like the chassis for assignment of the international identification codes to manufacturers of vehicles.

Chapter 2. Procedure for assignment of the international identification code to manufacturers of vehicles

4. The international identification code of the manufacturer of the vehicle is located in the first Section of vehicle identification number which is appropriated for the purpose of identification of the manufacturer of the vehicle and consists of three symbols.

The international identification code of the manufacturer of the vehicle is used for the purpose of determination of the country of the manufacturer of the vehicle. The combination of symbols of the first and second line item of the international identification code of the manufacturer of the vehicle is appropriated by the International agency operating on power of the International Organization for Standardization:

Society of automobile engineers (Society of Automotive Engineers) of the United States of America.

The international identification code of the manufacturer of the vehicle assigned for the manufacturer of the vehicle repeatedly is not appropriated to other manufacturer within thirty years.

5. The third line item of the international identification code of the manufacturer of the vehicle is filled with alphabetic or digital symbols and appropriated by technical secretariat based on the statement on receipt of the Certificate.

6. Special requirements to line items of the international identification code of the manufacturer of the vehicle:

1) in the international identification code of the manufacturer of the vehicle only the Arab figures and capital Latin letters are used:

in designation of the international identification code of the manufacturer of the vehicle use of Latin letters is inadmissible:

I, O, Q;

2) for designation of the manufacturer making less than 500 vehicles a year as the third sign of the international identification code of the manufacturer of the vehicle figure 9 is used.

In this case by technical secretariat it is appropriated the twelfth, thirteenth and fourteenth signs of vehicle identification number.

7. The manufacturer of the vehicle for receipt of the Certificate allocates the following documents in technical secretariat:

1) the statement on receipt of the certificate on assignment of the international identification code to the manufacturer of the vehicle in form, according to appendix 1 to these rules with indication of production volume (less 500, or 500 and more vehicles a year), full name of the manufacturer, the legal and actual address, details in the state, Russian and English languages;

2) the copy of the document proving the identity (for physical persons);

3) copies of constituent documents, certificates on state registration or re-registration (for legal entities) and accounting registration of branches and representations;

4) the technical description on the vehicle planned to production including:

name and purpose of the vehicle;

the drawing of the vehicle in projections (sideways, in front, behind and from above) in the A4 format with indication of overall dimensions of base and track;

general technical characteristics of the vehicle.

In the cases of representation by the manufacturer of the vehicle of incomplete document package provided by this Item, and (or) documents with the expired effective period, the technical secretariat refuses issue of the Certificate.

After receipt of refusal, the applicant corrects the revealed notes and within ten calendar days repeatedly submits documents for consideration of technical secretariat.

8. The submitted documents specified in Item 7 of these rules are considered by technical secretariat within thirty calendar days from the date of their receipt in technical secretariat.

9. The technical secretariat, in case of submission of documents of the these rules conforming to requirements, to the applicant grants the Certificate.

10. In case of change of the name of the manufacturer, the address, annual production the Certificate is subject to renewal.

11. For renewal of the Certificate the manufacturer of the vehicle submits the application for renewal of the certificate on assignment of the international identification code to the manufacturer of the vehicle in form, according to appendix 2 to these rules according to the procedure certain Item 7 of these rules.

12. Renewal of the Certificate is made according to Item 8 of these rules in time.

13. In case of loss or spoil of the Certificate the applicant addresses to technical secretariat for receipt of the duplicate of the certificate.

14. Issue of the duplicate of the Certificate is performed according to the procedure, established in Items 12 and 13 of these rules.
