In pursuance of article 40 of the Law of Ukraine "About ensuring sanitary and epidemic wellbeing of the population" for the purpose of the prevention of emergence of oncological diseases, and also I ORDER to harmonization of the domestic regulatory base with requirements of the European legislation:

1. Approve the hygienic standard rate "The list of substances, products, production processes, household and natural factors, cancerogenic for the person" it (is applied).

2. To department of the state sanitary and epidemiological surveillance (Ponomarenko A. M):

2.1. Provide this order on state registration to the Ministry of Justice of Ukraine according to the Presidential decree of Ukraine of October 3, 1992 to N493 "About State Registration of Regulatory Legal Acts of the Ministries and Other Executive Bodies" (with changes).

2.2. After registration in the Ministry of Justice of Ukraine of this order to bring it to the attention of heads of the ministries, the central executive bodies, organizations and institutions of the public sanitary and epidemiologic service, scientific institutions in accordance with the established procedure for use in work.

3. Consider by N25 which voided the order of the Ministry of Health of Ukraine of February 7, 1997 "About approval of the State hygienic standard rate "The list of substances, products, production processes, household and natural factors, cancerogenic for the person", registered in Ministry of Justice of Ukraine on March 6, 1997 N 71/1875.

4. To impose control over the implementation of the order on the director of the department of the state sanitary and epidemiological surveillance Ponomarenko A. M.

1. General provisions

1.1. The hygienic standard rate "The list of substances, products, production processes, household and natural factors, cancerogenic for the person" (further - the Standard rate) contains "List of substances, products, production processes, household and natural factors with the proved carcinogenicity for the person" (group 1) and "The list of substances, products, production processes, household and natural factors with reliable carcinogenicity for the person" (group 2), except for the radioactive materials and pesticides having the patterns of distribution in the environment, criterion for evaluation of danger and methods of regulation.

Substances (factors), cancerogenic for the person, are substances (factors) predetermining education at the person of malignant and benign tumors. Danger of specific substances or factors depends on levels and duration of action per capita, and also availability of the concurrent factors capable to modify effect of their impact.

1.2. The standard rate is obligatory for legal entities irrespective of patterns of ownership, legal form and subordination and physical persons - entrepreneurs who make, implement or use substances, products, production processes, cancerogenic for the person (further - cancerogenic substances (factors)), and also develop and take measures for the prevention of their harmful effects.

1.3. The state supervision of observance of requirements of the Standard rate is exercised by bodies and organizations of the public sanitary and epidemiologic service.

1.4. Industry (departmental) standard rates shall be brought into accord with requirements of this Standard rate.

2. The prevention of the danger caused by effect of cancerogenic substances (factors) per capita

2.1. The prevention of the danger caused by effect of cancerogenic substances (factors) per capita shall include complex of organizational, social and economic, technological, technical, sanitary and hygienic and treatment-and-prophylactic actions at the state, regional, industry levels directed to creation of proper safe and healthy working conditions, preserving life and health of the person in the course of labor activity, and also all population.
