About introduction of amendments to orders of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of July 28, 2009 No. 237-p "About approval of Rules of calculation of comprehensive income of person (family) applying for receipt of the government address public assistance" and of August 10, 2018 No. 347 "About approval of forms of reporting documentation in the field of the address public assistance"

I ORDER:

1. Bring in the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of July 28, 2009 No. 237-p "About approval of Rules of calculation of comprehensive income of person (family) applying for receipt of the government address public assistance" (it is registered in the Register of state registration of regulatory legal acts at No. 5757, No. 138 (1735)) the following changes is published in the Yuridicheskaya Gazeta newspaper of September 11, 2009:

in the Rules of calculation of comprehensive income of person (family) applying for receipt of the government address public assistance, approved by the specified order:

state Item 2 in the following edition:

"2. In these rules the following basic concepts are used:

1) the average per capita income - the share of comprehensive income of family falling on each family member in month;

2) comprehensive income - the amount of the income types considered in case of purpose of the address public assistance;

3) the government address public assistance (further - the address public assistance) - the payment in cash provided by the state to physical persons (families) with the monthly average per capita income below the poverty line, established in areas, the cities of republican value, the capital;

4) the central executive body - the state body performing management and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination in the field of social protection of the population;

5) family - the group of people, the connected property and personal non-property rights and obligations following from scrap (matrimony), relationship, property, adoption (adoption) or other form of acceptance of children on education and designed to promote strengthening and development of the family relations;

6) the independent worker - the physical person which is independently performing activities for production (realization) of goods, works and services for the purpose of commercialization without state registration of the activities, except for the individual entrepreneurs, persons who are engaged in private practice, founders (participants) of economic partnership and founders, shareholders (participants) of joint-stock company, members of production cooperative;

7) authorized body - the local executive body of the city of republican value, the capital, area, city of regional value, the area in the city, the cities of district value performing purpose of the address public assistance;

8) the precinct election commission - the special commission created by the decision of akims of the corresponding administrative and territorial units for carrying out inspection of financial position of persons (families) which asked for the address public assistance according to the Standard regulations on precinct election commissions approved by the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of January 28, 2009 No. 29-p (registered in the Register of state registration of regulatory legal acts No. 5562);

9) jobcenter of the population (further - the Center) - the legal entity created by local executive body of the area, the cities of regional and republican value, the capital for the purpose of realization of active measures of assistance of employment, the organization of social protection from unemployment and other measures of assistance of employment.";

8) of Item 8 to state the subitem in the following edition:

"8) charitable help;";

2) of Item 16 to state the subitem in the following edition:

"2) social payments, namely:

all types of retirement benefits, compensation payments to them appointed according to the procedure, established by the Law of the Republic of Kazakhstan of June 21, 2013 "About provision of pensions in the Republic of Kazakhstan";

the public social benefits on disability, on the occasion of loss of the supporter;

special public welfare payments;

the public special welfare payments to persons working at underground and open mining operations, and also at works with especially harmful and especially severe conditions of work or at works with harmful and severe conditions of work;

social payments from the state Social Insurance Fund;

public welfare payments on child care on achievement of one year by it;

cost recovery on training of handicapped children, students at home;

benefit to guardians or custodians on content of the orphan child (orphan children) and child(children), without parental support;

the public welfare payment granted and paid to mother or the father, the adoptive father (adopter), the guardian (custodian) who is bringing up the handicapped child (handicapped children);

social security benefits at the expense of means of the employer;

the financial (social) support on the drive in intracity public transport rendered at the expense of means of local budgets;

the cost of natural types of the help provided according to the legislation of the Republic of Kazakhstan and also the amount paid instead of this help;

allowances and the surcharges to all payment types established by legal acts of the Republic of Kazakhstan, bodies of local public administration, organizations and the organizations.";

"21. Income gained in work payment type is confirmed by references from the employer in any form.

Receipt of the income in type of social payments at the expense of means of the republican budget is confirmed by the copy of the certificate of the receiver of pension or the benefit, or the reference issued by departments of The Government for Citizens State corporation.

Income of the independent worker is confirmed by the written application in any form.";

4) of Item 22 to state the subitem in the following edition:

"4) received as a result of activities of independent workers.

Bring in the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of August 10, 2018 No. 347 "About approval of forms of reporting documentation in the field of the address public assistance" (it is registered in the Register of state registration of regulatory legal acts 17319, it is published on September 10, 2018 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan) the following changes:

1, of 2, of 3, of 4, of 5, of 6, of 7, of 8, of 9, of 10, 11 and 12 to the specified order to be reworded as follows appendices according to appendices 7, of 8, of 9, of 10, of 11, of 12, of 13, of 14, of 15, of 16, 17 and 18 to this order.

3. To provide to department of the public assistance of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

4) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Zhakupova S. K.

5. This order becomes effective after ten calendar days after day of its first official publication.
