About approval of the Standard regulations on educational institution of higher education of the Republic of Tajikistan

In compliance of article 28 of the Law of the Republic of Tajikistan "About education" the Government of the Republic of Tajikistan decides:

1. Approve Standard regulations on educational institution of higher education of the Republic of Tajikistan.

2. Declare invalid:

- the resolution Government of the Republic of Tajikistan of February 21, 1996 No. 71 "About approval of the Standard regulations on educational institution of higher education of the Republic of Tajikistan";

- item 4 the resolution Government of the Republic of Tajikistan of May 6, 1997 No. 214 "About modification and amendments in some resolutions Government of the Republic of Tajikistan".

Standard regulations on educational institution of higher education of the Republic of Tajikistan

Standard regulations on educational institution of higher education of the Republic of Tajikistan (further higher educational institution) the Law of the Republic of Tajikistan "About education" and the Law "About the Higher and Postgraduate Professional Education" is drafted on the basis of the Constitution of the Republic of Tajikistan.

I. Higher educational institution, tasks and structure

1. Higher educational institution of the Republic of Tajikistan is the educational institution having the status of the legal entity and realizing professional educational programs of higher education for certain state standards, the directions of education and educational and qualification levels, providing training, education and professional training of citizens according to their calling, interests, capabilities and normative requirements in the field of the higher education, and also performing scientific and scientific and technical activities.

2. The highest state educational institution is created, will be reorganized and liquidated by the Government of the Republic of Tajikistan.

Non-state higher educational institution is created, will be reorganized and liquidated by the founder (founders),

3. Higher educational institution is legal entity, belongs to non-commercial organization.

4. The higher educational institution based by the state, financed from the government budget or from other sources belongs to the state highest professional educational institution and submits to governing body of system of education.

5. The higher educational institution based on non-state and private property belongs to non-state educational institution and submits to the founder (founders). Non-state higher educational institutions as the constituting education systems, have the same rights and obligations, as state universities.

6. The following types of educational institutions are established: university, academy, institute.

University - higher educational institution, which:

- realizes educational programs of the higher and postgraduate professional education for wide range of the directions of preparation (specialties);

- performs preparation, retraining and advanced training of workers of the top skills, scientific and scientific and pedagogical workers;

- carries out basic and applied scientific research on wide range of sciences;

- is the leading scientific and methodical center in areas of the activities.

Academy - higher educational institution, which:

- realizes educational programs of the higher and postgraduate professional education in certain field of activity;

- performs preparation and advanced training of workers of the top skills;

- carries out basic and applied scientific research in one of the fields of science or culture;

- is the leading scientific and methodical center in the field of the activities.

Institute - higher educational institution, which:

- realizes educational programs of higher education and, as a rule, educational programs of postgraduate professional education in one or several separate directions;

- performs preparation and advanced training of workers for certain area of professional activity;

- conducts basic and (or) applied scientific research.

7. The status of higher educational institution is expressed in its name.

The name of higher educational institution is established during creation and changes without fail in case of change of its status. If in the name of higher educational institution the special name (conservatory, the highest school, etc.) is used, along with it the type of higher educational institution is specified.

8. Training of citizens in public institutions of the higher education is performed according to the state order on competitive basis free of charge.

The public institution of the higher education has the right within the established license in addition to the state order on the basis of the relevant agreements with legal and individuals to train specialists.

9. The main objectives of higher educational institution are:

- satisfaction of need of the personality for intellectual, cultural and moral development by receipt of the higher and (or) postgraduate professional education;
