ORDER OF THE MINISTER OF LABOUR AND SOCIAL PROTECTION OF THE POPULATION OF THE REPUBLIC OF KAZAKHSTAN

About modification and amendments in the order of the Minister of health and social development of the Republic of Kazakhstan of April 28, 2015 No. 279 "About approval of standards of the state services in the social and labor sphere"

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of April 28, 2015 No. 279 "About approval of standards of the state services in the social and labor sphere" (it is registered in the Register of state registration of regulatory legal acts for No. 11342, it is published on July 10, 2015 in information system of law of Ad_let) the following changes and amendments:

state Item 1 in the following edition:

"1. Approve standards of the state services:

1) "Purpose of retirement benefits on age" according to appendix 1 to this order;

2) "Purpose of lump sum payment to burial" according to appendix 2 to this order;

3) "Establishment of disability and/or extent of disability and/or determination of necessary measures of social protection" according to appendix 3 to this order;

4) "Issue of information on receipt and movement of means of the investor of the single accumulation pension fund" according to appendix 4 to this order;

5) "Purpose of the state base retirement benefit" according to appendix 5 to this order;

6) "Purpose of the public social benefits on disability and on the occasion of loss of the supporter" according to appendix 6 to this order;

9) "Purpose of benefits for the birth of the child and on child care" according to appendix 9 to this order;

10) "Purpose of special public welfare payment" according to appendix 10 to this order;

11) "Purpose of benefit of mother or to the father, the adoptive father (adopter), the guardian (custodian) who is bringing up the handicapped child" according to appendix 11 to this order;

12) "Registration of the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site, payment of immediate state monetary compensation, certification" according to appendix 12 to this order;

13) "Document creation on disabled people for provision of the prosthetic and orthopedic help by it" according to appendix 13 to this order;

14) "Providing disabled people with surdo-typhlo-technical and obligatory hygienic means" according to appendix 14 to this order;

15) "Purpose of the government address public assistance" according to appendix 15 to this order;

16) "Document creation on disabled people for provision of service of the individual assistant by it for the disabled people of the first group having difficulty in movement and the specialist of sign language for hard of hearing persons" according to appendix 16 to this order;

17) "Provision to disabled people of chair carriages" according to appendix 17 to this order;

18) "Providing disabled people with sanatorium treatment" according to appendix 18 to this order;

19) "Document creation on rendering special social services in medico-social organizations (organizations)" according to appendix 19 to this order;

20) "Document creation on rendering special social services in the conditions of home care" according to appendix 20 to this order;

21) "Purpose of the public assistance to separate categories of the needing citizens according to decisions of local representative bodies" according to appendix 21 to this order;

22) "Cost recovery on training at home handicapped children" according to appendix 22 to this order;

23) "Purpose of the public assistance to the specialists of the social sphere living and working in rural settlements on fuel acquisition" according to appendix 23 to this order;

24) "Issue of the reference confirming belonging of the applicant (family) to receivers of the address public assistance" according to appendix 24 to this order;

25) "Issue of the directions to persons on participation in active measures of assistance of employment" according to appendix 25 to this order;

26) "Assignment or prolongation of the status of the oralman" according to appendix 26 to this order;

27) "Issue and prolongation of permission to attraction of foreign labor power to employers for implementation of labor activity in the territory of the corresponding administrative and territorial unit, or within internal transfer" according to appendix 27 to this order;

28) "Certification to the rehabilitee" according to appendix 28 to this order;

29) "Purpose of the public assistance in type of monthly payments to citizens of the Republic of Kazakhstan after completion of the period of capitalization of payments on indemnification caused to life and health of workers by the legal entities liquidated owing to bankruptcy" according to appendix 29 to this order;

30) "Issue or prolongation of the reference to the foreigner or the stateless person about qualification compliance for independent employment" according to appendix 30 to this order;

31) "Registration of persons who are looking for work" according to appendix 31 to this order;

32) "Registration of persons who are looking for work as the unemployed" according to appendix 32 to this order;

33) "Payment of difference between the amount of actually brought compulsory pension contributions, compulsory professional pension contributions taking into account the rate of inflation and the amount of pension accruals" according to appendix 33 to this order;

34) "Purpose of public welfare payment to mothers having many children awarded with suspension brackets "Three-copecks piece alka", "Kum_s alka" or entitled earlier "Mother heroine", awarded with the degree awards "Maternal Glory" I and II" according to appendix 34 to this order;

35) "Purpose of attendance allowance for the disabled person of the first group since the childhood" according to appendix 35 to this order;

36) "Implementation of retirement benefits from the pension accruals created at the expense of compulsory pension contributions, compulsory professional pension contributions from the single accumulation pension fund" according to appendix 36 to this order;

37) "Issue of the certificate of registration as the unemployed" according to appendix 37 to this order.";

state Item 9 in the following edition:

"9. Uslugopoluchatel (or his representative under the notarized power of attorney) in case of the address for rendering the state service provides the statement on form according to appendix 1 to this standard of the state service, and in case of the request for retirement benefits from the single accumulation pension fund, purpose of basic pension and retirement benefits on age provides one statement in form according to appendix 1-1 to this standard of the state service and the following documents:

in the State corporation:

1) the identity document (the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan, the certificate of the stateless person, the residence permit of the foreigner, the certificate of the oralman before receipt of nationality of the Republic of Kazakhstan) (it is required for identification of the personality);

2) the document confirming registration on the permanent residence (the address reference or the reference of rural akims, for residents Baikonur - the reference of department of accounting and registration of citizens of housing of the city of Baikonur);

3) data on bank account number in banks of the second level, the organization having the license of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivision of Kazpochta joint-stock company or about the control account of cash of organization of criminal executive system;

4) the certificate of the income amounts paid to physical person and performed from the income of compulsory pension contributions in form according to appendix 2 to this standard of the state service, and for individual entrepreneurs, lawyers, private notaries, private legal executives, professional mediators - the document on the income issued by body of state revenues (in the presence).

In case of liquidation of the organization (company) the archive reference with indication of data on the income or the electronic copy of the archive document certified by the digital signature of the authorized employee of the Public Records Office or departmental archive is submitted.

In case of discrepancy of the amounts specified in the certificate of the income, the electronic statement of turnovers from the transit account of the investor, the applicant from place of employment the certificate confirmation of transfer of compulsory pension contributions in form according to appendix 5 to this standard of the state service is submitted.

Persons working in the Russian organizations of the Baikonur complex the certificate of the employer of the income paid in currency of the Russian Federation (in the presence) is submitted;

5) the documents confirming working life of the applicant:

service record;

the references of archive organizations, electronic copies of archive documents certified by the digital signature of the authorized employee of the Public Records Office or departmental archive or from place of employment in case of absence or worthlessness of the service record, lack of the corresponding employment records, availability of corrections, inaccuracies, discrepancies.

Depending on availability the following documents are submitted:

education document;

the military ID or the reference of management (department) for defense;

certificates of birth of children (the statement from the birth record, or the certificate of registration of the act of civil status, issued by bodies of civil registration);

the certificate of rehabilitation issued by bodies of prosecutor's office according to article 10 of the Law of the Republic of Kazakhstan of April 14, 1993 "About recovery of victims of mass political repressions";

certificate of military commissariat of participation in fighting;

the judgment confirming the fact of implementation and the period of care of the disabled person of the first group, the lonely disabled person of the second group and the retirement pensioner needing assistance, aged, reached eighty-year age, the handicapped child aged up to sixteen years;

the document confirming accommodation abroad of the spouse (spouse) employee of the former Soviet organizations, organizations of the Republic of Kazakhstan, the international organization;

the document confirming accommodation of the spouse (spouse) of the serviceman, employee of special state body in areas where there was no employment opportunity in the specialty.

For confirmation of care of unemployed mother of juvenile children one of the following documents is submitted (depending on their availability):

identity document of children;

the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage (in case of change of surname) children;

the certificate about the termination of average educational institution of children;

the diploma about the termination of specialized secondary or higher educational institution or the reference of educational institution confirming training of children;

the document confirming place of registration on the permanent residence of children;

the death certificate of children (or assembly record about death, or the certificate of registration of the act of civil status issued by bodies of civil registration);

the document confirming passing of military service on children;

6) the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage (in case of change of surname of the parent/guardian).

In case of purpose of retirement benefits on age to the women who gave rise (adopted, adopted) 5 and more children and brought up them to eight-year age, are in addition represented certificates of birth of children (either the birth record, or the certificate of registration of the act of civil status issued by bodies of civil registration) and the documents confirming the fact of education of children up to eight years.

For confirmation of the fact of education of children up to eight years (depending on their availability), documents according to Item 5 of Rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits on age, the public social benefits on disability, on the occasion of loss of the supporter, the public special welfare payments approved by the order of the Minister of health and social development of the Republic of Kazakhstan of April 14, 2015 No. 223 are submitted (it is registered in the Register of state registration of regulatory legal acts for No. 11110).

In case of purpose of retirement benefits on age to person living in zones of extreme and maximum radiation risk the document confirming the accommodation fact in zones of extreme and maximum radiation risk from August 29, 1949 to July 5, 1963 within 5 years is in addition submitted.

In case of establishment of guardianship (guardianship), the document confirming establishment of guardianship (guardianship) is submitted.

Submission of the identity document of uslugopoluchatel, the certificate of birth of child(children) or the statement from the birth record (on the registration made in the territory of the Republic of Kazakhstan after August 13, 2007), the document confirming registration on the permanent residence, certificates on marriage (on the registration made in the territory of the Republic of Kazakhstan after June 1, 2008), the document on establishment of guardianship (guardianship), the judgment about adoption (adoption) of child(children) is not required in case of confirmation of information containing in the specified documents, the state information systems;

on the portal:

request in electronic form, the uslugopoluchatel certified by the EDS.

Data on the identity document, the uslugopoluchatel receives from the corresponding state information system through lock of "the electronic government".

The employee of the State corporation receives the written consent of uslugopoluchatel to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.

When giving the uslugopoluchatel of all required documents to uslugopoluchatel issues the receipt on acceptance of the relevant documents.

In case of the address through the portal - in "personal account" of uslugopoluchatel the status about acceptance of request for rendering the state service is displayed.

The result of rendering the state service is issued in case of presentation of the identity document in case of personal visit of uslugopoluchatel (or his representative under the notarized power of attorney) based on the receipt on acceptance of the relevant documents.

The state corporation informs uslugopoluchatel on the made decision by means of transfer of the SMS notification on the mobile phone of uslugopoluchatel.";

in case of development to uslugopoluchatel of social and professional part of the individual program of rehabilitation - the statement from social and professional part of the individual program of rehabilitation of the disabled person;

in case of establishment to uslugopoluchatel of extent of loss of general working capacity - the certificate of extent of loss of general working capacity;

in case of establishment to uslugopoluchatel of extent of loss of professional working capacity - the certificate of extent of loss of professional working capacity, the statement from the certificate of extent of loss of professional working capacity and the act of medico-social examination;

in cases of determination of needs of the injured worker in additional types of the help and leaving - the conclusion about needs of the injured worker in additional types of the help and leaving;

to the uslugopoluchatel who is not recognized as the disabled person in case of the next re-examination - the notice on complete rehabilitation.

In case of pronouncement of the expert opinion the department of MSE and (or) department of methodology and control MSE sends to the medical organization the Notice of the organization of health care on the conclusion of MSE of the form 088/at approved by the order of the acting minister of health care of the Republic of Kazakhstan of November 23, 2010 No. 907 "About approval of forms of primary medical documentation of the organizations of health care" (it is registered in the Register of state registration of regulatory legal acts No. 6697) (further - the order No. 907), for attaching to the medical record of the ambulatory patient (in electronic or paper format).

In cases not of recognition by the disabled person in case of primary survey the duplicate of the Notice of the organization of health care on the conclusion of MSE of form 088/at is issued to the examined person or the legal representative.

Form of provision of result of rendering the state service: electronic and (or) paper;

2) on the portal information on confirmation of disability goes to "personal account" of the uslugopoluchatel in electronic form certified by the digital signature (further - the EDS) the authorized person of the service provider.";

"9. Uslugopoluchatel in case of the address for rendering the state service provides the statement on establishment of disability and/or extent of disability and/or determination of necessary measures of social protection on form according to appendix 1 to this standard of the state service and the following documents:

to the service provider:

1) the identity document (for identification of the personality).

In case of filing of application by the legal representative - the identity document of the legal representative (for identification).

The data on the identity documents confirming registration on the permanent residence, confirming the participation fact (or nonparticipations) in system of compulsory social insurance, containing in the corresponding state information systems, the service provider receives in the form of the electronic documents certified by the electronic and digital signature of authorized officers;

2) the direction for medico-social examination (the form 088/at approved by the order No. 907) no later than one month from the date of the direction specified in it (it is provided in case of survey (re-examination);

3) the copy of medical part of the individual program of rehabilitation of the patient (disabled person) (further - the International Party of Russia), in case of its development by the medical organization, in the form approved by the order No. 44;

4) the reference (in any form) confirming the fact of content of person in correctional facility of criminal executive system or the pre-trial detention center;

5) the medical record of the ambulatory patient for the analysis of dynamics of disease. In case of availability - the copy of statements from the clinical record, the conclusions of specialists and results of inspections.

Besides, the following documents are provided:

6) the leaf (reference) of temporary disability - is provided by the working person;

7) the conclusion of the medical and advisory commission (further - VKK) provided no later than one month from the date of its registration - in direction cases on consultation, need of survey (re-examination) at home, in hospital or in absentia, the directions on forming or correction of the International Party of Russia;

8) the act of inspection of domestic conditions of the disabled person - is provided by the disabled person or his legal representative for development of social and professional part of the International Party of Russia on improvement of domestic conditions;

9) the copy of the reference (coupon) of attachment to the medical organization approved by the order No. 907 - is provided in case of attachment to the organization of primary health care out of the place of permanent residence (registration);

10) the copy of the document confirming labor activity and (or) data on nature and working conditions on production - are provided (in the presence) in case of primary survey-faced working-age, provision in cases of industrial injuries or occupational diseases is obligatory;

11) the copy of the act of the accident connected with labor activity, the Minister of health and social development of the Republic of Kazakhstan approved by the order of December 28, 2015 No. 1055 "About approval of forms on registration of materials of investigation of the accidents connected with labor activity" (it is registered in the Register of state registration of regulatory legal acts No. 12655) and the original for reconciliation - is provided by person who received industrial injury or occupational disease in case of primary establishment of extent of loss of professional working capacity on this accident;

12) the copy of the document issued by the authorized body in the corresponding field of activity which established cause and effect relationship, and the original for reconciliation - is provided once for determination of the reason of the disability connected with wound, contusion, injury, mutilation, disease;

13) the copy of the conclusion of the National center of occupational health and occupational diseases (in any form) issued no later than two-year prescription and the original for reconciliation - is provided by person who got occupational disease;

14) the copy of the judgment about cause and effect relationship of injury or disease with execution of labor (office) obligations and the original for reconciliation - is provided by person who received industrial injury or occupational disease in case of the termination of activities of the employer - the individual entrepreneur or liquidation of the legal entity;

15) in case of establishment of guardianship (guardianship), the copy of the document confirming establishment of guardianship (guardianship), and originals for reconciliation is submitted;

16) the certificate of disability and the certificate of extent of loss of general working capacity - are provided in cases of early re-examination in case of deterioration in the state of health, for the purpose of change of the reason of disability, in case of identification of the facts of submission of doubtful documents, unreasonably taken out expert opinion;

17) the copy of the certificate on change of name, middle name, surname in the form approved by the order of the Minister of Justice of the Republic of Kazakhstan of January 12, 2015 No. 9 "About approval of forms of assembly books of state registration of acts of civil status and forms of the certificates granted based on entries in these books" (it is registered in the Register of state registration of regulatory legal acts at No. 10173), and the original for reconciliation - is provided in case of repeated re-examination in cases of making of state registration of change of name, middle name (in case of its availability), surnames of osvidetelstvuyemy person.

Documents are provided in the state and (or) Russian languages.

Submission of the documents specified in subitems 2) 3), 9), 11), 15) and 17) this Item is not required in case of confirmation (obtaining) of information containing in the specified documents, the state information systems through lock of "the electronic government";

on the portal:

request in electronic form, the uslugopoluchatel certified by the EDS or one-time password, in case of registration and connection of subscriber number of the uslugopoluchatel provided by mobile operator to accounting record of the portal.

Data of the identity document, the uslugopoluchatel receives from the corresponding state information system through lock of "the electronic government".

The result of rendering the state service is issued in case of presentation of the identity document in case of personal visit of uslugopoluchatel (or his legal representative).";

in organizations of criminal executive system and pre-trial detention centers, in the place of stay of uslugopoluchatel;

at home, in hospital - if person for health reasons according to the conclusion of VKK cannot be for medico-social examination;

3) in absentia - when osvidetelstvuyemy person is nontransportable and/or is on hospitalization outside the serviced region, based on the submitted documents determined by Item 9 of this standard of the state service with the consent of osvidetelstvuyemy person or the legal representative.";
