According to the subitem 13) of Item 2 of article 100 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 I ORDER:

1. Bring in the order of the Minister of investments and development of the Republic of Kazakhstan of November 30, 2015 No. 1128 "About approval of Rules of compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods, the list of the domestic processed goods on which costs on their promotion are partially compensated" (it is registered in the Register of state registration of regulatory legal acts for No. 12730, it is published on January 25, 2016 in information system of law of Ad_let) the following change:

The rules of compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to department on development and promotion of export of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods

Chapter 1. General provisions

1. These rules of compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods (further - Rules) are developed according to the subitem 13) of Item 2 of article 100 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 and determine procedure for compensation of part of costs to subjects of industrial and innovative activities for promotion of the domestic processed goods.

2. Compensation of part of costs is provided to subjects of industrial and innovative activities based on the list of the domestic processed goods on which costs on their promotion are partially compensated (further - the list) and within the means provided on these purposes by the republican budget for the current financial year.

3. The subject of industrial and innovative activities provides completeness and reliability of the provided request and documents attached to it, information, basic data, calculations, reasons.

Chapter 2. Procedure for compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods

4. Compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods is made by the following types:

1) the costs connected with advertizing of goods abroad:

on advertizing abroad through mass media (printing, television, radio, Internet resources), specialized and advertizing magazines and catalogs;

on advertizing abroad in public places (banners, extensions, lightboxes, broadcast of audio-videos, advertizing on the outside surfaces of vehicles), advertizing in salons of public transport;

on production of the audio-videos intended on these purposes and promotional materials, lease of the advertizing structures and surfaces;

2) costs for direct participation in foreign exhibitions, fairs, festivals:

on payment of the registration fee;

on lease of the stand spaces;

on production (lease), installation/dismantle of exhibition stands, the additional equipment;

on development, design and registration of the stand spaces;

on development, design, transfer and production of advertizing and distributing materials;

on flight by economy class of 2 (two) employees of the subject of industrial and innovative activities participating in exhibitions, fairs, festivals;

on accommodation of 2 (two) employees of the subject of industrial and innovative activities participating in exhibitions, fairs, festivals in sizes, not exceeding the limiting compensation amounts of expenses on hiring of hotel rooms to the employees of subjects of industrial and innovative activities participating in foreign exhibitions, fairs, festivals in US dollars and euro (in days on one employee) specified in appendix 1 to these rules for the term of no more than five days;

3) the costs connected with development, transfer into foreign languages and the edition of the specialized catalog for distribution abroad;

4) charges of representation, floor space and warehouse abroad:

on payment of the lease/sublease of office premises of representation;

on payment of lease of floor spaces and warehouse;

5) costs for holding the procedures connected with registration of trademarks (brand) abroad;

6) costs for holding the procedures connected with certification of goods abroad;

7) the costs connected with the goods delivery:

by rail:

the costs directed to payment of rate for the high-level railway system, the locomotive draft and cargo commercial works suffered on delivery goods from the point of departure to railway check points through Frontier of the Republic of Kazakhstan are compensated;

road transport:

costs from the point of departure to the international check points through Frontier of the Republic of Kazakhstan on highways of the international and republican value are compensated.

5. Depending on category of the subjects of entrepreneurship specified in subitems 1) - 7) item 4 to subjects of industrial and innovative activities the proved and documentary confirmed costs in the following procedure are compensated:

1) to subjects of big business in the amount of 30% of the amount shown to compensation;

2) to subjects of medium business in the amount of 50% of the amount shown to compensation;

3) to small business entities in the amount of 60% of the amount shown to compensation.

6. Compensation of part of costs, by the types specified in subitems 1) - 7) item 4 of these rules, is performed without indirect taxes (the value added tax and excises) of the Republic of Kazakhstan.

The extreme amount of compensation of part of costs, by the types specified in subitems 1) - 6) item 4 of these rules cannot exceed thirteen thousand monthly settlement indicators on one subject of industrial and innovative activities in the current financial year.

The extreme amount of compensation of part of costs by the form, specified in the subitem 7) of item 4 of these rules, provided to one subject of industrial and innovative activities within the corresponding financial year on the purposes specified in Item 1 of these rules cannot exceed 1/50 from amount of the allocated financial resources the current financial year.

The limit of compensation of part of costs, on delivery goods the cargo vehicle constitutes no more than 300 (three hundred) tenges on 1 (one) kilometer of run.

7. Compensation of part of costs is made in national currency of the Republic of Kazakhstan. Recalculation of the costs incured in foreign currencies is performed at currency rates of National Bank of the Republic of Kazakhstan for date of payment transfer for the executed works/services by the subject of industrial and innovative activities for the declared costs.

8. Order taking on compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods (further - the request) is performed by National institute of development in the field of development and promotion of export (further - the Operator).

9. The operator at the request of authorized body in the field of the state support of industrial and innovative activities (further - Authorized body) places in republican mass media and on the åxport.gov.kz web portal (further - the web portal) the announcement of order taking with indication of the place of order taking and the documents which are attached to them, the name of the operator performing their acceptance, dates of completion of order taking, and also the reference to the Internet resource containing the detailed information.

Order taking shall come to the end not earlier than in month after publication of the announcement in mass media and on the web portal.

Requirements to which there shall correspond subject of industrial and innovative activities the commitment form and the list of the documents and materials attached to it are placed on Internet resource of Authorized body and the web portal.
