About introduction of amendments to some resolutions of the Cabinet of Ministers of Ukraine

The Cabinet of Ministers of Ukraine decides:

Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

Approved by the Resolution of the Cabinet of Ministers of Ukraine of March 27, 2019 No. 299

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine

1. In Regulations on the procedure, conditions and criteria of establishment of disability approved by the resolution of the Cabinet of Ministers of Ukraine of December 3, 2009 No. 1317 "Questions of medico-social examination" (The Official Bulletin of Ukraine, 2009, No. 95, Art. 3265; 2016, No. 70, Art. 2356; 2018, No. 23, Art. 782, No. 37, Art. 1293):

Item 19-3 to state 1) in the following edition:

"19-3. Causal relationship of disability with wounds or other injuries of health received by persons who became persons with disability owing to wounds or other injuries of health received from explosives, ammunition and military arms in the territory of conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions till December 1, 2014, and since December 1, 2014 - in the territory of conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions where public authorities perform the powers, and in the settlements located on the line of contact during conducting anti-terrorist operation implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions it is established based on the decision of the interdepartmental commission on questions of factual determination of receipt by persons of the wounds or other injuries of health received from explosives, ammunition and military arms in the territory of conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions.";

2) in Item 26:

the tenth to state the paragraph in the following edition:

"-received in areas of fighting during World War II and from explosives, ammunition and military arms in post war period; from explosives, ammunition and military arms in the territory of conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions till December 1, 2014, and since December 1, 2014 - in the territory of conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions where public authorities perform the powers, and in the settlements located on the line of contact during conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions; during execution of the works connected with mine clearing of ammunition irrespective of time of their accomplishment;";

in the paragraph the seventeenth "ensuring its carrying out" shall be replaced with words words "implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their carrying out".

2. In the resolution of the Cabinet of Ministers of Ukraine of September 8, 2015 No. 685 "About approval of the Procedure for provision of the status of person with disability owing to war to persons who became disabled owing to wound, contusions, mutilations or diseases got during direct participation in anti-terrorist operation, ensuring its carrying out" (The Official Bulletin of Ukraine, 2015, No. 74, of Art. 2434; 2016, No. 35, Art. 1360, No. 68, Art. 2281; 2017, No. 38, Art. 1204; 2018, No. 23, Art. 782):

"Ensuring its carrying out" shall be replaced with words 1) in the name and the deciding part of the resolution of the word "implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their carrying out";

2) according to the procedure of provision of the status of person with disability owing to war to persons who became disabled owing to wound, contusions, mutilations or diseases got during direct participation in anti-terrorist operation, the ensuring its carrying out approved by the specified resolution:

in the name and Item 1 of the Procedure for the word "ensuring its carrying out" shall be replaced with words "implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their carrying out";

in Item 2:

paragraphs two and third to state in the following edition:

"contusions, mutilations or diseases got during direct participation in anti-terrorist operation, ensuring its carrying out became the serviceman (reservists, persons liable for call-up) of Armed Forces, National guard, the SSU, Service of foreign intelligence, State frontier service, State special transservice, military personnel of military prosecutor's offices, the police officer, faces of the private and the commanding structure, the military personnel of the Ministry of Internal Affairs, Management of the state protection, Gosspetssvyaz, GSChS, the Public criminal and executive service, to faces of the private and the commanding structure of divisions of operational providing anti-terrorist operation zones of GFS formed according to the laws of Ukraine of other military forming which protected independence sovereignty and territorial integrity of Ukraine and persons with disability owing to wound, being directly in areas of anti-terrorist operation during its carrying out, during direct participation in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, being directly in areas and during implementation of the specified actions;

to employees of the companies, organizations, organizations which were involved in ensuring conducting anti-terrorist operation to ensuring implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions and there were persons with disability owing to wound, contusions, mutilations or diseases got when ensuring conducting anti-terrorist operation is direct in areas and during its carrying out, during ensuring implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, being directly in areas and during implementation of the specified actions;";

to state the paragraph of the sixth in the following edition:

"to persons who voluntarily provided (voluntarily were involved in providing) conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions (including performed volunteer activities for the directions determined by the paragraph the ninth parts three of article 1 of the Law of Ukraine "About volunteer activities") and became faces with disability owing to wound, contusions, mutilations or diseases got when ensuring conducting anti-terrorist operation, being directly in areas and during its carrying out, during ensuring implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, being directly in areas and during implementation of the specified actions.";

in item 4:

third subitem 1 after the words "during its carrying out" to add the paragraph with words ", implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, being directly in areas and during implementation of the specified actions";

third subitem 2 to state the paragraph in the following edition:

3. In the resolution of the Cabinet of Ministers of Ukraine of September 23, 2015 No. 739 "Questions of provision of participant status of war to some persons" (The Official Bulletin of Ukraine, 2015, No. 78, Art. 2604; 2017, No. 50, Art. 1551):

Item 1 after the words "during its carrying out" to add 1) with words ", in ensuring implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, being directly in areas and during implementation of the specified actions";

Item 2 to state 2) in the following edition:

"2. Determine that the bases for provision of participant status of war to employees of the companies, organizations and the organizations are:

documents on direct attraction to accomplishment of tasks of anti-terrorist operation in areas of its carrying out (the statement from orders of the head of the Anti-terrorist center under the SSU or the face replacing it of the first deputy or the deputy manager of the Anti-terrorist center under the SSU about attraction to ensuring conducting anti-terrorist operation, the statement from orders of the head of operational staff on management of anti-terrorist operation, his deputies or heads of sectors (commanders of operational and tactical groups) about subordination to the head of operational staff on management of anti-terrorist operation in areas of its carrying out), and also other documents issued by state bodies, the companies, organizations, the organizations, containing data on direct we will speed up the worker in ensuring accomplishment of tasks of anti-terrorist operation in areas of its carrying out (statements from orders and orders, business trip orders, books of job specifications, materials of special (office) investigations on the facts of receipt of wounds) - for workers, for the term of at least 30 calendar days, including on set of days of stay which were attracted and were directly involved in ensuring conducting anti-terrorist operation, being directly in areas of its carrying out;

excerpts from orders of the General Staff of Armed Forces on attraction to implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, excerpts from orders of the Commander of the integrated forces, commanders of operational and tactical groups about arrival (departure) in (from) areas of implementation of such actions, documents on the direction in business trip to areas of implementation of such actions for workers, for the term of at least 30 calendar days, including on set of days of stay which were attracted and were directly involved in ensuring implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, being directly in areas and during implementation of the specified actions.".

4. According to the procedure of provision of the status of person on which operation of the Law of Ukraine "On the status of veterans of war, guarantees of their social protection", to some categories of persons, No. 740 approved by the resolution of the Cabinet of Ministers of Ukraine of September 23, 2015 (The Official Bulletin of Ukraine, 2015, No. 78, of Art. 2605 expatiates; 2016, No. 35, Art. 1360, No. 42, Art. 1575; 2017, No. 8, Art. 238, No. 38, Art. 1204; 2018, No. 23, Art. 782):

1) in Item 2:

state paragraph two in the following edition:
